§ 2. The commissioners of the land office shall, within thirty days after the passage of this act, advertise for at least four successive weeks in three daily newspapers published in the city of Albany, also in three daily newspapers published in the city of New-York, the time, place and terms of such sale; and at the time appointed therefor one or more of such commissioners shall attend to superintend such sale; and in case such property is not sold at such time and place, such sale may be adjourned from time to time, in the discretion of the said commissioners, not exceeding, however, six months in the whole. §3. If the mayor, aldermen and commonalty, or the Central commissioners of the Central park of the city of NewYork, shall elect to purchase the same for the purposes of the said Central park, and shall give notice to that effect in writing to the commissioners hereinafter appointed, ten days before the day designated for such sale by public auction as provided in the first section, the commissioners of the land office are hereby directed to convey the same to the said mayor, aldermen and commonalty of the city of New-York, on receiving from said city the sum of two hundred and seventy-five thousand dollars, and for the purpose of making such purchase, the mayor, aldermen and commonalty of the city of New-York, are hereby authorised to issue bonds to provide means for the payment thereof, in accordance with the provisions of the act to alter the map of the city of New-York, by laying out thereon a public place and to authorise the taking of the same, passed July twenty-first, eighteen hundred and fifty-three.

§4. There is hereby appropriated out of the proceeds of such sale, the following sums, or so much thereof as in the opinion of the commissioners named in the fifth section of this act, shall be necessary for the purposes named, which shall be paid by the treasurer on the warrant of the comptroller, in the manner hereinafter provided:

For the erection and completion of an arsenal in the city of Brooklyn, and for the purchase of the land therefor, forty thousand dollars.

For the improvement of the state arsenal at Albany, so as to render the same fit for the purposes of a state arsenal, and for the erection of an armory and the purchase of the land therefor, the sum of twenty-five thousand dollars.

For the erection and completion of a new state arsenal, and the purchase of the land therefor, in the city of Buffalo, the sum of forty-five thousand dollars.

For the erection and completion of an arsenal in the city of New-York, and the purchase of the land therefor, the sum of one hundred thousand dollars.

For the erection and completion of a new state arsenal in the village of Corning, fourteen thousand dollars.

For the erection and completion of an armory in the village of Dunkirk, three thousand dollars.

For the erection and completion of an armory in the city of Rochester, five thousand dollars.

For the erection and completion of an armory in the city of Utica, four thousand dollars.

For the erection and completion of an armory in the city of Syracuse, four thousand dollars.

For the erection and completion of an armory in the city of Troy, five thousand dollars.

For the erection and completion of an armory in the city of Auburn, four thousand dollars.

For the erection and completion of an armory in the city of Oswego, three thousand dollars.

For the erection and completion of an armory in the village of Ballston Spa, three thousand dollars.

For the erection and completion of an armory in the village of Ogdensburgh, three thousand dollars.

For the purchase of Stone fort in the village of Schoharie, three thousand dollars.

If the said commissioners hereinafter appointed shall consider it more for the interest of the state to sell the arsenal now erected in the city of Albany, and the grounds connected therewith, rather than to improve the same, they shall certify that fact to the commissioners of the land office; and the said commissioners of the

land office shall thereupon, within thirty days, proceed in the same manner as is provided with reference to the arsenal and grounds in the city of New-York, to advertise, sell and convey the said arsenal and grounds to the highest bidder therefor, and the proceeds of such sale are hereby appropriated, together with such portion as may be necessary of the amount appropriated by this act for the improvement of said arsenal, and for the erection of an armory in said city and the purchase of the land therefor, for the purchase of a site, and the erection of a new arsenal upon such site at the city of Albany; and such amount shall be paid by the treasurer on the warrant of the comptroller to the commissioners by this act appointed, in like manner as hereinbefore provided, to be by them expended for such purchase and in such erection.

§ 5. The adjutant general, the inspector general and Commis the commissary general, are hereby constituted and appointed commissioners to select or procure the necessary ground's for the sites of such arsenals; to make and approve of contracts for the purchase of the same, and to accept conveyances to the state therefor; and to contract for the erection, completion and improvement of such arsenals and armories. They shall cause plans and estimates of said erections and improvements to be made, and shall let the work and contract for furnishing the materials; such contracts to be made with the person or persons who will do and furnish the same at the lowest bid, and give satisfactory security for the faithful performance of the contracts. Previous to such letting, the said commissioners shall give reasonable public notic by advertising in newspapers published in the city or village where the work is to be done or materials furnished, of the time and place of such letting, and the work to be done and materials furnished; and at the time and place of such letting, shall attend in person and openly canvass the propositions, and thereupon proceed to make the contracts as is in this section provided; but no money shall be expended by the commissioners for the construction of any arsenal as provided by this act, except the necessary expenses incurred in preparing the plans for such constructions until a contract shall have been made for the com

pletion of such arsenal within the amount appropriated therefor by this act.

§6. Before the issuing of the warrant upon the treasurer, as provided in the fourth section of this act, the said commissioners shall make and file with the comptroller their certificate, signed by each of said commissioners, stating that the appropriation so asked and to be drawn for is actually due for the purposes in said certificate particularly mentioned and set forth, unless the same has accrued upon some contract in writing, in which case the certificate shall state that upon said contract, describing the same, the amount asked for is actually due according to the terms thereof at the date of said certificate, and the said certificate shall thereupon, by the comptroller, be attached to the duplicate of such contract required by this act to be filed in his office; and after, or, should the comptroller so require, at any time before the labor of said commissioners shall have been completed according to the intent and meaning of this act, said commissioners shall file with the comptroller all vouchers and receipts taken by them in the performance of their duties.

7. The said commissioner shall file in the office of the comptroller, certified copies of all contracts entered into by them for work and materials, and shall present to the comptroller on the last day of each month, an abstract of their expenditures during the preceding month.

§ 8. The said commissioners shall receive no compensation for their services as such commissioners, but shall be allowed and paid by the treasurer on the certificate of the commander-in-chief, the actual necessary expenses incurred by them in the duties of their commission.

§ 9. Any balance which may remain unexpended of the proceeds of said sale, after the expenditures authorized by this act, is hereby appropriated for military purposes, and shall from time to time be paid by the treasurer on the warrant of the comptroller, for such purposes as shall be certified by the commander-in-chief to be proper and necessary.

10. This act shall take effect immediately.

AN ACT to provide for the completion of the
State culvert in the city of Syracuse.

Passed April 15, 1857, three-fifths being present.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The canal commissioners are hereby autho- Extension rized, if in their opinion the interests of the state require, to continue the state culvert which carries off the waste water from the weigh lock at Syracuse, from its present termination on the west side of the state of* salt office, standing on the west side of Salina street, through Noxon street to Onondaga creek; and the same shall be completed within two years from the passage of this act.

§2. The sum of nine thousand dollars, or so much Amount of thereof as may be necessary for that purpose, is hereby on. appropriated to pay for the completion of said culvert, payable in two equal annual payments, from the first day of February, eighteen hundred and fifty-seven, provided the work shall then be finished, out of any money in the treasury applicable to the repair of the canals.

§3. The said work shall not be commenced until the city and owners of block F and J, through which said culvert is to pass, release all claims for damages which may arise or accrue to them in consequence of the building of said culvert.
