1750. Wednesday October 31

The Coppice.-Ordered That notice be given to Thomas Hall the 15 Corporation Tenant to attend at the next hall, and to answer the Charge against him for plowing in the Coppice; without Licence of this Hall. 3510 fo. 13.

1750. Wednesday December 19

Appointment of Junior Councillors.-Mr Mayor informed the Hall that he had been served with a Second Writ of Mandamus; 201 relating to the Number of the Common Council which he had laid before Council above, in order to make a proper defence And it is now ordered by this Hall that the Mayor shall take care of the defence to the same; and that the same Council Agent and Attorneys shall be employed therein that have been imployed heretofore in 25 the late Mandamus Cause, and that the same Defence shall be born at the Expence of this Corporation

Ordered That the Mayor shall have power to take up any Sum that shall be necessary not exceeding the Sum of Four hundred 30

pounds for discharging the Expences of the late Mandamus and of defending against the Mandamus Suit now depending which the Mayor shall be reimbursed by this Corporation.

Mr Cotes and Mr Dymock declared their disapprobation of the 5 Order last above written because they Apprehend this Hall hath not power to make such order. 3510 fo. 17.

1750-1. Tuesday January 29.

The Mayor informed this Hall That he was advised by his Council in London who had received Briefs and met upon a Consultation for that purpose to make a General Return for the Mayor and 10 Burgesses to the Writ of Mandamus now depending whereby the Right alleged to have a Mayor and Twenty four Persons for a Common Council of this Town of Nottingham as set forth in the said Writ of Mandamus is denied and put in Issue and that according to his direction the Return for that purpose (a Copy whereof hath been 15 now read to the Hall is put into the Crown Office) in Order to be filed in the Court of Kings Bench, with which this Hall is well satisfied.

The Mayor further informed this Hall That in pursuance of the Power given him by the Common Council at the last Hall He had prevailed with Mr John Wainewright of the Six Clerks office1 20 to advance and lend to the Mayor and Burgesses of this Town The Sum of Four hundred pounds on Interest at four per Cent upon a Bond to be given by the said Mayor and Burgesses under their Common Seal And had ordered a Bond to be prepared accordingly, which being now read and dated this day, was approved by this Hall : 25 And the Common Seal was affixed this day accordingly thereto; in the presence and by the Approbation of this Hall, and the same in order for the due payment of the Interest is ordered to be entered. in the Chamberlains Book amongst the Fees and Salarys.

1751. Thursday June 13.

Election of a Common Council man.

TOWN OF NOTTINGHAM. To wit. At the Guildhall of the said Town on Thursday the Thirteenth day of June in the

In the County of Middlesex.

Year of our Lord 1751 and in the Twenty fifth Year of the Reign of King George the Second over Great Britain &c. At an Election of a Common Council man of the said Town and Corporation in the Room of Mr Joseph Wright Baker lately deceased. The Candidates proposed were Mr Benjamin Bull and 5 John Plumptre the Younger Esquire; who had both been sometime past Sheriffs of the said Town, and now both of the degree of Sheriff, And there being an objection raised against Mr Plumptre for that his residence was in or near London, and at so great a distance that he could not execute the Office of a Common Council 10 man as he ought, or to that or the like Import: And as Mr Plumptre was now at a distance and no satisfaction was given to John Burton Esquire Mayor of the said Town, That the said John Plumptre the Younger Esquire was privy to the present Matter; or would undertake to serve the said Office Therefore the said Mayor 15 Ordered his own Clerk to proceed who took down the Names of some few Voters (of the great Number here present) who voted for each of the aforesaid Candidates But the Mayor being informed that the said Mr Bull did not intend to oppose Mr Plumptre, or desire a continuance of the Poll against him And that Mr Plumptre 20 would come down to be sworn into the Office of a Common Council man of the same Town The Poll was stayed And being minded. to have the vacancy in the Common Council by virtue of this Election. in reasonable Time filled up The Mayor gave public Notice to all the Electors in the Guildhall here present That he did Appoint 25 That the said John Plumptre the Younger Esquire should attend him the said Mayor at his the said Mayor's Dwelling House in Nottingham on Friday the Twenty first day of this Instant June at four of the Clock in the Afternoon of the same day to take the Usual Oath of Office of a Common Councilman of the said Town. 30 And then the Mayor dismissed the whole Assembly.

On which said Twenty first day of June 1751 the said John Plumptre did not attend according to the said Appointment : Neither did the Mayor hear or received any Message from himself to excuse his not attending or to desire longer Time. Nor hath 35 he the said John Plumptre the Younger ever wrote; or sent from himself any Message to the Mayor since, to signify that he would accept the Office of a Common Council Man, or to let the Mayor know what was his Mind concerning that Affair. 3510 fo. 30.

Tuesday 9 July 1751.

Samuel Smith Esquire of the City of London Banker having requested to be made a Freeman of this Corporacion and William Bury Esquire having made the like request for himself, both the said Gentlemen were Sworn Burgesses of this Corporation, Mr Bury 5 being of Windsor in the County of Berks And Certificates of both were now given under the Common Seal of this Corporation.

The Cleansing of the Leen.-Ordered That the Mayor and any five besides of the members of this Hall who can attend upon the Mayors 10 Summons shall be a Committee to view the Dyke by the Leen Side by the Kings Acre in the upper Meadows; the back Leen by John Pettys Workhouse and the Issue in Grey fryars gate down to the Leen, and to see what cleansing or Repairs are necessary, and what obstructions there are to the Water Course or what damage 15 is done to ye Leen, or otherwise; and the said Committee are hereby impowered To order what is amiss to be amended and all obstruccions to be removed in Such way and manner that the said Committee shall think fit. 3510 fo. 34.

Apprentices and Burgess-ship.-Ordered That for the future such 20 who have been Apprentices and come to be made Burgesses and have not got their Indentures inrolled as they ought to be, shall pay for that Neglect before they be admitted Burgesses one Shilling to the Poor's box and one Shilling to the Town Clerk: And that this shall be a standing order. 3510 fo. 36.

1751. Wednesday August 28.

The Boat Company and the warehousing of goods.-Upon Complaint of Mr James Huthwait and Mr Robie Swann (who together with Mr John Huthwaite are the present Nottingham Boat Company) That some Doubts have arisen about the Time: what shall be esteemed a convenient Time for Burgesses or others to take away 30 their Goods or Merchandizes from of the Wharfe now in lease from this Corporation to the said Boat Company. Now to explain that Covenant in the Boat Companys Lease: It is ordered That a Months Time shall be a convenient Time for taking away such Goods, unless hindred by Floods or Stress of Weather: And that if 35 any Goods or Merchandizes shall continue upon the said Wharfe or

within the Warehouse for longer time This Hall doth allow the said Lessees to take fourpence a Month for a Tun afterwards and so in proportion; without being deemed to act against the Covenants in their said Lease which bears date the 31st December 1737.

3510 fo. 44. 5 The Sheriffs and the alteration of the Calendar.-Mr Alderman Butler the Mayor nominate moved this Hall: that in regard it is doubtfull at present whether or no the Sheriffs which are to be for the Year to commence at Michaelmas next shall have any Fair in September 1752; and so, much of the profits of the next year will 10 be lessened: It is now declared to be the Lease of this Hall that the ensuing Sheriffs shall not be Sufferers upon that Account; but that any loss that may happen for want of that Fair, Shall be made up to them by this Hall upon proper application for the purpose. 1751. Tuesday September 25.

Ordered that an Account be taken of the clear profits of the Tolls that shall be made for the first Eleven days by the Sheriffs who shall enter at Michaelmas 1752 New Style: and that Sum shall be the Measure of the Allowance that this Hall shall make to the Sheriffs who are to enter at Michaelmas next for the whole loss they 20 may sustain by reason of the Shortning of the Month of September Eleven days the next Year; by reason of the Act of Parliament for changing the style. 3510 fo. 48. Appointment of Junior Councillors.-A Copy of the Inrolment of the Mandamus sued forth against the Mayor and Burgesses in 25 Michaelmas Term 1750 and of the Return.

Michaelmas Term 24th George the 2d.

Our Lord the King hath sent to the Mayor and Burgesses of his Town of Nottingham in the County of his Town of Nottingham his Writ closed in these Words, that is to say,

[Commencing at line 27 on p. 225 to end and concluding] at Westminster the twenty fifth day of October in the Twenty fourth Year of our Reign.

[Commencing at line 25 on p. 227 beginning slightly differently] Upon which said Thursday next after the Morrow of all Souls to end.2
