the contrary hath been an Ancient Town and Borough And that the Burgesses and Inhabitants of the said Town for all the said Time whereof the Memory of Man is not to the contrary have been a Body Corporate and Politick in Deed and Name by various Names of Incorporation But we do further most humbly Certifie and 5 Return to our said present most Serene Sovereign Lord the King That from time whereof the Memory of Man is not to the contrary there hath not been nor hath been Used and accustomed to be nor now ought to be within the said Town a Common Council of the said Town consisting of the Mayor and Twenty four persons chosen out 10 of the Burgesses of the said Town into the said office by the Mayor and Burgesses of the said Town Eighteen of which said Twenty four persons were distinguished and known at different Times by the several Names of the Cloathing Council, the Cloathing Council of the Mayor, the Head Council, and the Senior Council of the said 15 Town And the remaining Six of the said Twenty four Persons were distinguished and known by the several Names of the Common Council and the Junior Council of the said Town as by the said annexed Writ is supposed And we do further most humbly Certify and Return to our said present most serene Sovereign Lord the King 20 That by the Constitution of the said Town The Mayor and Burgesses of the said Town are not bound nor are they in any Respect whatsoever Compellable to Elect and Swear Six persons out of the Burgesses of the said Town into the Place and Office of the Common Council otherwise Junior Council of the said Town and Therefore 25 we the said Mayor and Burgesses of the said Town cannot Elect chuse Admit and Swear Six of the Burgesses of the said Town into the place and office of Common Council otherwise Junior Council of the said Town as by the said annexed Writ We are Commanded to do.

When the above Record was copied into this Book it was apprehended that the Entry of it by the Clerks in the King's Bench Office was sufficient; but it was found afterwards that 35 the Court must be moved by Council to fyle it before it could be a Record, which was done by the Council for the Prosecutor. See afterwards in the next Hall Book.

You shall now and from time to time untill the Next General Quarter Session make due Inquiry and observance of all Public Nusances Lewd and dissorderly Houses and Places Incroach- 20 ments Unlicensed Alehouses And all Trespass Misdemeanours and Offences against the Statutes and Common Law of this Realm and shall duly and truly present the same to this Court or at the Monthly Session or any Adjournment of this Court According as the Same Shall Come to your Knowledge and whensoever howsoever and by 25 whomsoever done Committed or Suffered within the Limitts of this Town of Nottingham or the County of the Same You shall Present no Person out of Envy or ill will Nor leave any Unpresented for favour or Affection.

Cordwainers' Company.-At the Request of the Wardens of the Cordwainers to be forgiven their last years Rent of Twenty Shillings because the Company have not received any profits this year to answer the same; This Hall doth order That the said last years 15 Rent of Twenty Shillings be now remitted and allowed to the late Chamberlains; and abated in the ballance of their Accounts.

The meaning of this expression is doubtful. It probably means 'parcel of prickings.' Parcel means a heap or bundle. The word 'prickings' has two meanings: (1) Short thorn bushes stuck on top of an earthen fence when the thorn hedge, cut down so that it may grow afresh, forms an insecure barrier, the stronger stems are cut into short pieces (prickins) and thrust in close rows along the top of the hedge on each side.

2 The most likely explanation of this is that 'soap' in this very crudely written document is a mistake for 'heap.' However it has been suggested that Mr. Burton may have been a soap maker and that the ashes were of a kind used in the manufacture of this article, perhaps beech ash. 3 Cleaning. + Through. 5 Sic.

1749. Friday November 24.

Appointment of Junior Councillors.—Mr Seagrave the Town Clerk read to this Hall the Return of the Mayor and Burgesses to the Writ of Mandamus for chusing Six Junior Council as setled by Council and put into the Crown Office by Mr Thomas Masterman their Attorney in the Office; purporting to be a denial of the prescription 5 as set forth in the Mandamus for a Common Council; And further that by the Constitution of this Town the Mayor and Burgesses are not bound or in any Respect whatsoever compellable to elect six persons out of the Burgesses into the place and office of Common Council, which Return is now approved of by all this Hall; And it 10 is ordered that Mr Seagrave and Mr Egginton do take all proper Care of the fyling of the Return; and do or cause to be done whatever farther is needfull and shall be advised by Council to be done in this affair with respect to the said Return or the proper Recording of the said Mandamus and Return.

It is also ordered by this Hall That if the prosecutors proceed to Argument, or to an Information upon the said Return, or the Record when filed in this Cause That the said Mr Egginton and Mr Seagrave shall take all proper care thereof and proceed in every respect as their Council shall advise: And that they shall take 20 care in Case of a Tryall to move for a Trial at the Bar of the Court of King's Bench and a Special Jury

3509 fo. 8. Here follows an Entry of the Return of the Mayor and Burgesses to the Writ of Mandamus which was read to the Members at this Hall as above mentioned Indorsed upon the Mandamus thus :

The Execution of this Writ appeareth in a certain Schedule to this Writ annexed The Answer of the Mayor and Burgesses of the Town and County of the Town of Nottingham within mentioned to the Writ. Thomas Masterman Attorney for the Defendants.

Then upon a Separate Piece of Parchment annexed to the Mandamus the said Return as setled by Mr Serjeant Willis Mr Henley, Mr Ford, Mr Pratt and Mr Evans, the Council for the Corporation (after a Consultation together, and a Consideration of Briefs given them for that purpose) was Ingrossed, and written 35 thus:
