SEC. 4. The State Auditor shall have authority, and it is Auditing of ac- hereafter made his duty, during the progress of the public counts-issuing printing and, binding, and in accordance with such regulations as will secure the State from loss, to audit the accounts for the State printing and binding, and to issue his warrants therefor, against any moneys in the State Treasury which may have been appropriated for such purpose, to the amount of seventy-five per cent. of the printing or binding so done and audited; but the said Auditor shall withhold his warrants for the remaining twenty-five per cent. on each job of printing and binding, until the whole of such job shall be completed and delivered to the proper officer authorized to receive the same.

SEC. 5. All acts and parts of acts, contravening the provisions of this Act are hereby repealed.

SEC. 6. This Act shall take effect and be in force from and after its passage.

Be it enacted by the Legislature of the State of Minnesota:

SECTION 1. That the sum of forty thousand dollars ($40,000) or as much thereof as may be necessary, be and the same is hereby appropriated to be applied to the payment of mem-ature bers and officers of the present Legislature.

SEC. 2. That the sum of fifty-five thousand dollars, or so much thereof as may be necessary, be and the same is here- Constitutional by appropriated for the payment of the members, officers, and incidental expenses of both branches of the Constitutional Convention held in St. Paul in July and August, 1857. SEC. 3. That the sum of four thousand, eight hundred dollars be and the same is hereby appropriated for the payment of the principal and interest of bonds issued by Act of the Interest on terriTerritorial Legislature approved May 23d, 1857, and falling torial bonds due on or about May 23, 1858, to be paid to the holders of said bonds or their legal representatives on the said day of maturity.

SEC. 4. That the sum of one thousand seven hundred and sixty-five dollars and eleven cents ($1765 11) be and the same is hereby appropriated to Goodrich, Somers & Co. assignees of Earle S. Goodrich, for preparing sectional headings, side-notes, and index, and for copying and printing the Laws of the Extra Session of 1857; and the farther sum of five hundred and forty-five dollars and forty-nine cents ($545 49) for printing the Journals of the Council and House of Representatives for the Extra Session of 1857; and the further sum of three hundred dollars for copying and preparing sectional headings, side-notes and index to the Laws of the Regular Session of 1857; and the further sum of one thousand, six hundred and ten dollars and

fifty cents ($1,610 50) for publishing the Laws of the Regu lar and Extra Sessions of 1857 in the Pioneer and Democrat.

SEC. 5. That the sum of nine hundred and seventy-four Territorial bind-dollars and fifty cents ($974 50) be and the same is hereby appropriated to Goodrich, Somers & Co. assignees of M. H. Abbott, for binding the Laws and Journals of the two houses for the Extra Session of 1857, and for the incidental binding of said session.

H. H. Sibley; and the further sum of seven thousand dollars, or as much thereof as may be necessary, for the printing and publication ordered by, and incidental to the business of the Constitutional Conven. tion presided over by, Hon. St. A. D. Balcombe.

SEC. 9. That the appropriations specified in Sections one and two of this Act be paid by the Treasurer out of any bors of the legis moneys coming into the Treasury not otherwise appropriated, upon presentation of certificates signed by the presiding officers and attested by the Secretaries of the respective bodies named in said sections; and that all other bills and demands for which moneys are herein appropriated shall be audited by the officers appointed by law and shall be paid only on certificates being duly issued.

SEC. 11. The further sum of three thousand dollars is ap propriated to pay the stationery and postage certificates ordered by the House and Senate of the present Legislature. SEC. 12. This Act shall take effect and be in force from and after its passage.

The sum of seven thousand five hundred dollars, or so much thereof as may be necessary, is hereby appropriated for payment of the salaries of the Judges of the Supreme Court, and one thousand eight hundred dollars, or so much thereof as may be necessary for the payment of the salary of the Clerk of the Supreme Court; also, two hundred dollars for contingent expenses of said Court.

SEC. 8. The sum of twelve thousand dollars, or so much thereof as may be necessary, is hereby appropriated for the payment of the salaries of the Judges of the District Court.

SEC. 9. The following sums are likewise hereby appropriated, to be paid out of any moneys in the Treasury, not otherwise appropriated, on presentation of proper vouchers, or certificates for the same, to wit:

For contingent fund to the order of the Auditor of State, to be used for State purposes, three hundred dollars.
