SEC. 3. All such blank warrants or drafts shall be let. tered, numbered and registered in the proper books to be by auditor provided and kept by the Auditor for that purpose, and all plates or other stamps for the printing and making of the warrants provided for hereby, shall remain in the custody of the Auditor, and under his direction and control.

SEC. 4. Whenever any outstanding and unpaid Territorial Manner of paying warrants or other claims against the State, duly audited and appropriated by law, shall be presented for payment, the treasurer Treasurer shall receive from the Auditor a like amount in the aforesaid Treasury drafts or warrants which, before delivery, shall be properly signed by the Auditor, and a correct account kept thereof.

The Treasurer shall countersign, accept and issue the same to the parties entitled thereto, and the Treasurer shall enter in a book or books to be kept by him for that purpose, a correct account of all such transactions, setting forth the amount of drafts received by him from the Auditor, the numbers, letters, denominations and amounts of the same, to whom issued, and on what account, as well as any further entries necessary to exhibit the condition of the Treasury at all times, and the aggregate amount and denominations of such outstanding Treasury drafts.

SEC. 5. The said warrants or Treasury drafts shall bear and draw interest at the rate of twelve per cent. per annum, but whenever there shall be sufficient funds in the Treasury Interest on drafts for the redemption of such outstanding warrants, it shall be the duty of the Treasurer to give public notice, in one or more newspapers published at Saint Paul, that the said warrants will be redeemed upon presentation, and the interest shall cease from and after the date of such notice.

SEC. 6. A full and correct account of the redemption and payment of all such Treasury drafts shall also be kept by the Registry and canTreasurer, and no such draft shall be issued twice; but on payment they shall be marked as canceled by a cross at least one inch each way, being stamped and cut through the paper, in the manner known to bankers for destroying canceled checks.

SEC. 7. The said drafts shall always be received by the State for taxes, assessments, fines and dues of every nature whatsoever; and they shall also be received by the Treas-debts due state urer at par, and with accrument of interest, as cash, for any loan to the State of Minnesota, authorized or to be authorized by law, and the credit of the State is hereby pledged to the payment of the principal and interest of the Treasury pledged drafts or warrants mentioned in this Act.

SEC. 8. This Act shall take effect from and after its passage.

CHAPTER V.

An Act to extend the time for the collection of the
County, State and Territorial Taces for the year 1857.

SECTION 1. Time of Collection of Taxes extended to July 1, 1858.

Be it enacted by the Legislature of the State of Minnesota :

SECTION 1. That the time for the return of delinquent taxes for the year 1857, be and the same is hereby extended to the first Monday in July, 1858.

SEC. 5. Nothing in this Act shall be so construed as to, authorize or allow any Sheriff or Collector of Taxes to fail in making due diligence to collect and pay over the taxes of the year 1857 before the time specified in Section one for the return of delinquent tax lists; neither shall this Act be construed to warrant or allow any County Treasurer to reserve and keep, or appropriate to the use of his county, the State or Territorial taxes charged to his respective county for the year 1857; but the same shall be paid in gold and silver First moneys to coin and Territorial and State orders, out of the first mon- be paid into the eys collected and paid in the County Treasuries, and not la-state treasury ter than the time prescribed in Section one.

SEC. 6. All County, State, or Territorial taxes, collected Collections hereprior to the passage of this Act shall be paid over to the re- tofore made to be spective County Treasuries on or before the first Monday in or neglect subject February next, and like payment of all taxes subsequently to penalty collected shall be made in each succeeding month thereafter until final settlement is made by said Collector, and if any Sheriff or Collector fails or neglects to make a settlement of the taxes included in his assessment roll collected as hereinbefore provided, the County Treasurer of his county, shall charge such Sheriff or Collector five per cent. damages, and twelve per cent. per annum interest, from the day payment should have been made in the balance of unsettled taxes due from him, and if any Sheriff or Collector shall withhold the payment of any taxes collected by him as aforesaid, he shall be liable to pay ten per cent. damages and twelve per cent, interest as above specified on such moneys, which moneys, damages and interest shall be collected by suit brought against such Sheriff or Collector's Bond for the recovery of the sums.

SEC. 7. The provisions of this Act shall not apply to any taxes levied or assessed by law for the support of School Taxes exempt Districts, Village or City government, nor to any taxes spe- herein cially assessed or levied by a town meeting for the support

CHAPTER VI.

An Act to provide for the Assessment and Collection of a tax for State purposes, for the year eighteen hundred and fifty eight.

SECTION 1. Five mill tax authorized, together with a tax for principal and interest of $250,000 loan.

Be it enacted by the Legislature of the State of Minnesota:

SECTION 1. There shall be levied and collected on all the taxable property in the State of Minnesota for the year eighteen hundred and fifty-eight, a tax of five mille to the dollar, for the use of the State, including the sum to be raised as a sinking fund and for interest of the State debt, under the provisions of an act entitled "An Act to authorize a loan of two hundred and fifty thousand dollars to defray the current expenses of the State."

SEC. 2. It shall be the duty of the proper officers of the several counties in the State, to assess and collect said tax in their respective counties, and pay the same over to the Treasurer of State, in the manner and time prescribed by law. SEC. 3 This Act shall take effect from and after its passage.

CHAPTER VII.

An Act in relation to the Revision and Compilation of the Statutes.

SECTION 1. Appointment of Commissioners to revise the Statutes.

2. Commissioners to report as the Legislature may direct.

Be it enacted by the Legislature of the State of Minnesota :

SECTION 1. That Moses Sherburne, Aaron Goodrich and William Hollinshead, are hereby appointed Commissioners named-duties to compile, arrange and put into chapters, under appropriate heads, the public Acts now in force, including the Revised Statutes and the public Acts and laws passed since the revi sion of the Statutes, and which may be passed by this Legislature; and said Commissioners shall not enter upon their duties until instructed in reference to the Code of Practice to be adopted by this State.

SEC. 2. And be it further enacted, That said Commission- When to report ers report the result of their labors as this Legislature may direct.
