An Act to require Clerks of District Courts, Judges of
District Courts and District Attorneys to file copies of
their official bonds and oaths in the office of the Clerk
of the Supreme Court.

SEC. 2. It is hereby made the duty of the Clerk of the Supreme Court to file the said oaths and bonds in his said office, free of all charges whatsoever, and it is further made Duty of supreme the duty of the Clerk of the Supreme Court, in case of the failure of any of the officers herein enumerated so to do, to notify said officers of this requirement, and request compliance with the same.

SEC. 3. The certificate of the Clerk of the Supreme Court to the official acts of any of the said officers shall be taken as prima facie evidence of their official character, in any of the Courts of this State.

SEC. 4. This Act shall take effect and be in force from and after its passage.

An Act to Provide for the Creation and Regulation of
Emigrant Aid Societies.

SECTION 1. Incorporation of Associations to promote emigration.

Be it enacted by the Legislature of the State of Minnesota :

SECTION 1. Any number of persons may associate themIncorporation of selves and become incorporated for the purpose of aiding to encourage, procure and protect emigration in and within the State of Minnesota, with power to make, hold and use a common seal, also to contract and be contracted with, to sue and be sued, plead and be impleaded, answer and be answered, in all Courts of competent jurisdiction, and shall have all other powers and privileges necessary to fulfil the objects of their incorporation.

SEC. 2. Such persons forming an association under this Filing of certifi Act, shall file in the office of the Secretary of State, and also in the Register of Deeds office of such county where such association may be formed, a certificate, in writing, signed by the Board of Directors of such association, expressing their intention to create and form such Emigration Aid Society, which certificate shall also comprise a copy of their Constitution and by-laws adopted by them.

SEC. 3. The object of such institution shall be to provide for the encouragement of emigration to the State of Minnesota, and to aid and protect emigrants on their arrival in and their passing through this State.

SEC. 4. Such association shall make by-laws in accordance with their objects, provided that such by-laws be not in contravention of the laws of this State, or the laws and Constitution of the United States.

SEC. 5. At the annual meetings of such association, there shall be chosen a Board of Directors and such number of officers as their by-laws may provide, which officers and directors shall hold their respective offices for one year and until the regular annual meetings of the association, when their successors shall be chosen. The association shall, at their

first annual meeting, fix the time for holding their subsequent annual meetings.

SEC. 6. It shall be the duty of the Board of Directors to present to the association at every annual meeting, or at Annual report ‹ ↑ any time the by-laws that such institutions may provide, a full report of their proceedings, and give a faithful exhibit of the state of the institutions with regard to their financial and other interests.

SEC. 7. The Directors shall have power, and it shall be Donations and their duty to receive funds and donations of whatever subscriptions source; they shall also have power, and it shall be their duty, to fix the rates of subscription of members, to appoint and employ all officers and agents requisite to promote the object of such institutions, and to remove any and all of them, as the interests of such institutions may require.

SEC. 8. The Directors shall be authorized to expend such amount of the funds under their control, as they may deem expedient, for the printing and distribution of pamphlets or tribution of other papers, for the instruction of emigrants, and for the pamphlets aid and assistance of emigrants, whenever they may deem

CHAPTER LXV.

An Act prescribing the general duties of Auditor of
State.

SECTION 1. State Auditor to be elected every three years-Annual salary-Bond-Oath

Be it enacted by the Legislature of the State of Minnesota :

SECTION 1. That there shall be elected by the qualified Term of office- voters of the State, every three years, one Auditor of State, who shall have an annual salary of one thousand dollars per annum, payable quarterly, and who, previous to entering on the duties of his office, shall enter into bond with one or more securities, to be approved by the Governor, in the sum of twenty thousand dollars, payable to the State of Minnesota, conditioned for the faithful discharge of his official duties; and he shall take and subscribe an oath or affirmation to faithfully discharge the duties of his office, which oath, together with his bond, shall be deposited in the office of Secretary of State.

SEC. 2. The Auditor shall keep his office at the seat of government, and do and perform all the duties appertaining therto which are, or may be, required of him by law or resolution of the Legislature.

SEC. 3. The Auditor shall keep a seal, with the device, "the seal of the Auditor for Minnesota," and all official copies Seal of Auditor taken from the Records, or other documents in his office, shall be under said seal, and shall be certified and signed by the Auditor.

SEC. 5. That the bills or warrants to be so issued, shall be printed on separate sheets of paper, and each bill or war-Form and manner rant shall be entered and numbered, and the number corresponding therewith shall be on the part of the sheet from which such bill shall be cut; and all such parts of sheets containing the corresponding numbers, shall be carefully preserved by the Auditor in his office.

SEC. 8. The Auditor shall enter, in progressive order, in. a book or books to be by him provided for that purpose, the number of each bill or warrant by him issued, the amount thereof, the date of its issue, and the name of the person to whom issued.

The Auditor shall make and preserve in his office in suitable books, to be procured at the expense of the State, fair and accurate records of all such public accounts and other documents as have been or may be by law made returnable to his office, and shall keep a file in progressive order of all receipts and other vouchers relative to the business of his office.

SEC. 10. The Auditor shall keep a regular account with the Treasurer of this State, in suitable books, to be provided as aforesaid, in which he shall charge the Treasurer with all treasurer to be moneys by him received, and credit him with all bills or war- kept rants by him redeemed and deposited in the office of the Auditor.
