ESTABLISHMENT OF TOWN LINES

RESOLUTION NO. THIRTY NINE

A RESOLUTION establishing and defining the boundary line between the Town of Hempstead and the Town of Oyster Bay, in the County of Nassau, As the same runs from the monument at the head of Meinell's Brook, or Seaford Creek, Southerly to the Atlantic Ocean, adopted pursuant to Section 37 of the County Law, constituting Chapter XI of the Consolidated Laws of the State of New York.

Section 1. WHEREAS, the boundary line between the Town. of Hempstead and the Town of Oyster Bay, in the County of Nassau as the same runs from the monument at the head of Meinell's Brook, or Seaford Creek, southerly to the Atlantic Ocean, has been in dispute, and application has been made to the Board of Supervisors of the County of Nassau, by the members of the Town Board of the Town of Hempstead, to establish and define such boundary line, and notice of intention to so apply, has been duly given as provided by law, and published for four consecutive weeks, next preceding the meeting of this Board, at which such application was presented, in three newspapers, published in the County in said Towns, and a copy of such notice was served personally, at least fifteen days before the meeting of this Board, at which such application was presented, on the Supervisor and Town Clerk of the Town of Oyster Bay, and the Town of Oyster Bay has appeared before the Supervisors of the County of Nassau, by its Attorney, and the Board of Supervisors of the County of Nassau has heard the applicants and also the Attorney for the Town of Oyster Bay, in connection with the establishing and defining of such boundary line above mentioned,

NOW, THEREFORE, BE IT

RESOLVED, that the boundary line between the Town of Hempstead and the Town of Oyster Bay, in the County of Nassau, as the same runs from the monument at the head of Meinell's Brook, or Seaford Creek, southerly to the Atlantic Ocean, be and the same hereby is defined as follows:

BEGINNING at a monument standing at the head of Meinell's Brook, also known as Seaford Creek, which monument is a short distance northerly from the Highway known as Jerusalem Avenue, which said Highway runs westerly from the South Oyster Bay and Hicksville Road to the northerly line of Washington Avenue, and from said monument, running southerly through the center of said Meinell's Brook, or Seaford Creek, to the former mouth of said Seaford Creek, at a point due south from a certain boulder marked "Range Boulder" lying at the bottom of the main land meadow a short distance east of the mouth of Seaford Creek, as

now located, and from said point running due south to the Auantic Ocean; which said boundary line as herein established and defined, is shown on a certain map entitled "Map showing a portion of boundary line between Towns of Hempstead & Oyster Bay, compiled from records and surveys, by Alvin G. Smith, C. E., Freeport, L. I., Dec. 12, 1924", and hereby made a part hereof, and this day filed in the office of the Clerk of the Board of Supervisors of the County of Nassau.

Section 2. This resolution shall take effect immediately.

RESOLUTION NO. ONE

A RESOLUTION to amend Resolution Number 39, entitled "A Resolution establishing and defining the Boundary line between the Town of Hempstead and the Town of Oyster Bay, in the County of Nassau, as the same runs from the monument at the head of Meinell's Brook, or Seaford Creek, southerly to the Atlantic Ocean, adopted pursuant to Sec. 37 of the County Law, Constituting Chapter XI of the Consolidated Laws of the State of New York," adopted December 13th, 1924.

RESOLVED, that the resolution entitled, "A resolution establishing and defining the boundary line between the Town of Henpstead* and the Town of Oyster Bay, in the County of Nassau, as the same runs from the nomument* at the head of Meinell's Brook, or Seaford Creek, southerly to the Atlantic Ocean, adopted pursuant to Sec. 37 of the County Law, constituting Chapter XI of the Consolidated Laws of the State of New York "adopted December 13th, 1924, be, and the same hereby is, amended to read as follows:

Sec. 1. BEGINNING, at a monument standing at the head of Meinell's Brook, also known as Seaford Creek, which monument is a short distance northerly from the Highway known as Jerusalem Avenue, which said Highway runs westerly from the South Oyster Bay and Hicksville Road to the northerly line of Washington Avenue, and from said monument, running southerly through the center of said Meinell's Brook, or Seaford Creek, a distance of Fifteen thousand sixteen (15,016) feet, to the former mouth of said Seaford Creek, at a point Five hundred eighty five (585) feet due south from a certain range boulder marked "R B", lying at the bottom of the main land meadow, a short distance east of the mouth of Seaford Creek, as now located, and from said point running due south, a distance of nineteen thousand nine hundred fifty seven & eighty four hundredths feet (19,957.84) from the said range boulder marked "R B", last mentioned, to a concrete monument on Jones' Beach and from said concrete monument last mentioned, running due south to the Atlantic Ocean, a distance of two thousand five hundred fifty feet (2550), more or less, which said boundary line as herein established and defined is shown on a certain map entitled, "Map showing a portion of boundary line between Towns of Hempstead and Oyster Bay, compiled from records and surveys by Alvin G. Smith, Freeport, N, Y., Dec. 12, 1924," and hereby made a part hereof and filed in the office of the Clerk of the Board of Supervisors of the County of Nassau on Dec. 13th, 1924, and on a certain map entitled "Map showing a portion of boundary line between Towns of Hempstead and Oyster Bay compiled from records and surveys by Alvin G. Smith, Freeport, N. Y., Dec. 12, 1924", and hereby made a part hereof, and this day filed in the office of the Clerk of the Board of Supervisors of the County of Nassau.

Sec. 2. This resolution shall take effect immediately.
