ORDER FOR THE LAYING OUT PART OF RAPELJE AVENUE AND FOR The Closing of Part

OF HUNTERFLY ROAD.

At a meeting of the Commissioners of Highways of the Town of New Lots and Flatlands, in the County of Kings, at the house of W. H. Rowland, on Rockaway avenue, on the 6th day of March, 1877, all the Commissioners having been duly notified to attend the said meeting for the purpose of deliberating upon the application of Gilbert S. Thatford, a resident of the Town of New Lots, and liable to be assessed for the laying out and opening of Rapelje avenue, from Hunterfly road to Rockaway avenue, and for the closing or discontinuance of Hunterfly road, north of Rapelje avenue and east of Rockaway avenue, and on the certificate of twelve reputable treeholders of the Town of New Lots, convened and duly sworn, after due notice as required of the statute, certifying that the opening of such part of Rapelje avenue is necessary and proper and that when such part of Rapelje avenue is graded, regulated and formed, then such part of the Hunterfly road as lies north of Rapelje avenue and east of Rockaway avenue will be useless and unnecessary and may be discontinued and closed, and we having heard all the reasons for and against laying out such part of Rapelje avenue and for and against the discontinuance of such part of the Hunterfly road, it is ordered, determined and certified that the said Rapelje avenue shall be laid out as a public highway from the Hunterfly road to Rockaway avenue, and that part of the Hunterfly road lying north of Rapelje avenue and east of Rockaway avenue shall be discontinued and closed as soon as the said Gilbert S. Thatford shall grade, regulate and form Rapelje avenue, from Hunterfly road to Rockaway avenue.

On the annexed map that part of Rapelje avenue which is hereby laid out is shown by orange color, and that part of Hunterfly road which is to be closed is shown in green color (shaded lines). Witness our hands this sixth (6th) day of March, 1877.

Gilbert S. Thatford, being duly sworn, deposes and says, that the hereto annexed are the detailed statements of the land affected by the application, made by deponent, for a quit claim deed from the City, of the land lying in the Old Hunterfly road, between Riverdale and RockThe said list contains the names of the purchasers of the lots, a description of away avenues. the lots sold to them by deponent, and whether by warranty deed or otherwise. The balance of the lots are owned by deponent, and the deed he asks from the City is only for the benefit of the parties who have bought lots from deponent, and deponent wishes to make no claim to the old

road as against any of the parties who have bought lots from him, and his object in making this application is to remedy any possible question that might arise respecting the ownership by his grantees of the land lying in said street, and which deponent has conveyed to them, as is stated in the annexed list, and to avoid any further question in respect to the title of said old road.

Deponent believes that his title to said street is perfectly good, but has made this application at the request of his grantees and for their benefit mainly, and does not seek to require any right or title in said land as against his grantees, or any of them.
