ants are in harmony with the character of the immediate neighborhood and with the general intent and spirit of this ordinance. The Superintendent, however, shall be under no obligation to consider the state of title to any premises or the existence of such covenants therein unless the same are brought to his attention by some person interested therein.

SECTION 21. Permitted Re-Construction. Where buildings or structures are devoted to a non-conforming use at the date of the passage of this ordinance and are subsequently destroyed or damaged or fallen into disrepair, they may be reconstructed and again devoted to the same use upon the same site in the following cases and no others:

(a) Railroad stations or other structures devoted to the service of the public by any public service company.

(b) Buildings or structures used in connection with mining operations or manufacturing establishments.

(c) Any building of which at least 50 per cent. remains intact, either in bulk or value, at the time of the proposed reconstruction.

SECTION 22. Change of Use. No buildings, structures or premises devoted to a non-conforming use at the date of the passage of this ordinance shall be re-constructed, altered, added to, or used for any other non conforming use except one of a similar class, and in case such building, structure, or premises ceases to be devoted to such non-conforming use, except as a result of vacancy it shall not thereafter be reconstructed, altered, added to, or used for any non-conforming use.

ARTICLE III.-REGULATION OF HEIGHTS.

SECTION 23. Height of Structures.

(a) In the "A" and "B" Zones no buildings or structures shall be erected of a height in excess of 60 feet.

(c) In the "D" and "E" Zones no buildings or structures shall be erected of a height in excess of 150 feet.

(d) In the "D" Zones no building shall be erected less than two stories in height, except automobile service stations, garages, meeting halls,

churches, schools and public buildings.

SECTION 24. Height Exceptions.

(a)

In the "A" and "B" Zones restrictions as to height of structures shall not apply to structures intended solely for religious or charitable purposes, and in other zones restrictions as to height of structures shall not apply to structures intended solely for religious, charitable or public purposes, nor to wireless towers, poles or towers for transmission of electricity, chimneys, water tanks, elevator bulk heads, flag poles or coal breakers.

(b)

Any building completely erected prior to the passage of this ordinance, designed and adapted for the construction of additional stories, may have not to exceed two additional stories added thereto notwithstanding sections of this ordinance restricting heights.

(c) In all cases where terraces exist, the height of the terrace may be added to the height of the building, provided the building is set back from the street line a distance equal to the height of the terrace.

ARTICLE IV.-REGULATION OF AREAS.

SECTION 25. Conformity Required. No building or structure shall be erected or altered, nor shall any open space adjoining any building be encroached upon or reduced in any manner except in conformity with the regulations hereby established for the zones in which such building, structure or open space is located.

Areas in "A" Zones. In the "A"

SECTION 26.
Zones there shall be:

(a) A front yard adjoining each abutting street

of at least 20 feet in width, of which the 10 feet nearest the street shall be left open and unobstructed except by trees and poles or other public service facilities. The remaining portion of such front yards may be occupied by fences, hedges, awnings, eaves, cornices or porches, provided that no porch shall be constructed closer to an adjoining property line than the required width of the side yard.

(b) A rear yard having a depth of not less than fifteen per cent. of the depth of the lot, but the depth of such rear yard need not exceed 25 feet.

(c) A side yard on each side of the principal building or structure with a width on one side of not less than three feet and a total width on both sides of not less than ten feet with no structure thereon other than a fence or overhanging cornice or eaves not exceeding two feet in width.

(d) A total of not less than fifty per cent. of the lot not occupied by buildings either principal or accessory.

SECTION 27. Areas in "B" and "C" Zones. In the "B" and "C" Zones there shall be:

(a) A front yard adjoining each abutting street of at least 15 feet in width, of which the 10 feet nearest the street shall be left open and unobstructed except by trees and shrubbery. The remaining portion of such front yard may be occupied by fences, awnings, eaves, cornices, or porches, provided that the same shall not be constructed closer to an adjoining property line than the required width of the side yard..

(b) A rear yard having a depth of not less than 121⁄2 per cent. of the depth of the lot; but the depth of such rear yard need not exceed 20 feet.

(c) A side yard on each side of the principal building or structure with a width of not less than three feet, with no structure thereon other than a fence or overhanging eaves or cornice not exceeding two feet in width.

(d) A total of not less than 45 per cent. of the lot not occupied by buildings either principal or ac

cessory.

SECTION 28. Areas in "D" and "E" Zones. In the "D" and "E" Zones there shall be:

(a) A front yard adjoining each abutting street at least ten feet in width which shall be left open and unobstructed. Vaults may be constructed thereunder provided that the tops of such vaults shall be on a level with the adjoining public sidewalk.

(b) A rear and side yards for premises used or intended for residential purposes complying with the regulations for the "B" and "C" Zones. For premises not used or intended for residential purposes, there need be no rear or side yards.

SECTION 29. Area Exceptions.

(a) Dwellings for three families shall have combined rear and side yards of not less than 1,400 square feet, with an additional 100 square feet for each additional family. In computing the number of square feet aforesaid so much of the side and rear yard as may be occupied by structures of any kind shall be excluded.

(b)

Where terraces exist, the height of the terrace not exceeding fifteen feet shall be added to the unobstructed portion of the front yard.

(c) In the case of a lot held under a distinct ownership from the adjacent lots, at the time of the passage of this ordinance, having a less width or a less area than required to accommodate or make provision for a single family dwelling in the zone in which the lot is located, the area restrictions of this ordinance shall apply only so far as it may be possible or practicable to apply them without depriving the owner of the use of his property for a single family dwelling.

(d) Where 80 per cent. or more of the lots on one side of a street between two intersecting streets have been or shall hereafter be improved with buildings in such a manner as to establish front yards of an average depth greater than that hereinafter required, such depth of front yard shall be the required depth in such block.

(e) In the "D" and "E" Zones where at least 80 per cent. of the frontage on one side of a street

between two intersecting streets has been heretofore improved with buildings the main walls of which extend to within eight feet or less of the street line, buildings may hereafter be erected to within eight feet of the street line.

(f) Cornices with not over 21⁄2 feet projection, advertising signs not over 3 feet wide with a projection not to exceed one foot, and awnings of reasonable size may be permitted in the "D" and "E" Zones, and upon commercial and industrial structures in the "A," "B," and "C" Zones to project beyond the main front wall of the building; provided that all such projections shall be at a height of at least eight feet above the sidewalk.

(g) In the "D" and "E" Zones marquises or roofs projecting over the sidewalk may be permitted, subject to revocation without compensation, by special resolution of the Council in each case, provided that no such resolution shall be passed until opportunity to be heard thereon has been given to the City Planning Commission.

SECTION 30.

Successive Computations of Yard Areas. No yard or open space provided about any building now or hereafter erected complying with the provisions of this ordinance shall again be considered in computing the area of a yard or open space for any other building or structure located upon an adjoining property, notwithstanding change of ownership.

ARTICLE V.-ADMINISTRATION.

SECTION 31. Certificate of Compliance. No excavation for building purposes shall be made, nor shall any building, billboard, advertising sign or structure of any kind be erected or altered unless there shall have been previously issued by the Superintendent of the Bureau of Building Inspection a certificate of compliance certifying that plans therefor have been filed with him, and that the same comply with the terms of this ordinance. Such certificates of compliance may be combined with the building permits required by existing laws and ordi
