AN ORDINANCE

In the Interest of the Public Health, Safety and General Welfare, Regulating and Limiting the Height and Bulk of Buildings Hereinafter Erected or Altered; Regulating and Determining the Area of Yards and Other Open Spaces in Connection with Buildings Hereafter Erected or Altered; Regulating and Restricting the Location of Trades and Industries and the Location of Buildings Designed for Specified Uses, and for These Purposes Dividing the City Into Districts or Zones with Regulations and Restrictions Differing as Between Different Districts; and for the Purpose of Enforcing This Ordinance, Imposing Duties Upon Certain Municipal Officers, Providing Penalties, and Establishing a Board of Zoning Appeals with Powers and Jurisdiction Herein Defined.

ARTICLE I.—ESTABLISHMENT OF ZONES—

DEFINITIONS.

SECTION 1. Zone Regulations Ordained. The Council of the City of Scranton ordains that from and after the passage and approval of this ordinance, the following districts or zones shall be established, and the following regulations for the purpose of regulating and restricting the location of trades and industries, and the location of buildings designed for specified uses and regulating and limiting the height and bulk of buildings hereafter erected or altered and regulating and determining the area of yards and other open spaces shall be in full force and effect.

SECTION 2. Short Title. This ordinance shall be known as the "Zoning Ordinance of 1924" and the map mentioned herein shall be known as the "Zoning Map."

SECTION 3. Definitions. For the purposes of of this ordinance certain words and terms are hereby defined as follows:

Words used in the present tense include the future; the singular number includes the plural, and the plural includes the singular; the word "lot" includes the word "plot"; the word "shall" is mandatory and not directory.

"Alley": A public highway for pedestrian or vehicular traffic of a width of 18 feet or less.

"Automobile Service Station": A building designed primarily for supplying motor fuel and oil to motor vehicles.

"Billboard": Any structure or part thereof primarily designed for the display of lettered or pictorial matter for advertising purposes.

"Board": The Board of Zoning Appeals as herein established.

"Building": As used in the title of this ordinance is to be given its widest meaning, synonymous with "structure." Where used elsewhere it shall be defined as: A structure having a roof supported by walls or columns for the shelter, support or enclosure of persons, animals or chattels, and including also tanks or containers permanently placed for petroleum products or illuminating gas and containing more than 100 cubic feet.

"Dwelling": Any building or portion thereof designed or used for residence purposes. A "two-family dwelling" is a dwelling standing separate from all other buildings other than outbuildings and divided either vertically or horizontally for use as a dwelling by only two families.

"Garage": Any structure or portion thereof in which one or more motor vehicles are housed, kept or repaired; not including exhibition or show rooms or storage of new cars for sale.

"Private Garage": Garages not designed for the use of transients or for the accommodation of the traveling public and not containing power driven machinery for repair work.

"Public Garage": Any garage not a private garage.

"Height": As applied to structures, the vertical distance measured from the center of the street or alley opposite the center of the front of the structure to the highest point of the structure. Where a lot abuts on two or more streets or upon two or more alleys at their junction, the one having the highest level shall govern, but where a lot abuts upon a street, and also upon one or more alleys, the street level shall govern. In the case of through lots, the

street level of each abutting street shall govern to one-half the depth of the lot.

"Lot": The land occupied, or to be occupied by a building and accessory buildings including the open spaces required under this ordinance. A lot shall not include any part of a street or other public highway upon which the same fronts or abuts. A "corner lot" is a lot fronting or abutting on two or more streets at their junction. A lot abutting upon one street and also upon one or more alleys shall not be considered a corner lot. An "inside lot" is any lot not a corner lot. A "through lot" is an inside lot having a frontage on two streets.

"Lot Lines": The lines bounding a "lot" as defined herein.

"Non-Conforming Use": A use of property that does not agree with the regulations applicable to the zone in which it is situated.

"Public Notice": Of a hearing or proceeding means at least ten days notice of the time and place thereof, printed in a newspaper of general circulation that is published in the City of Scranton.

"Stable": Any structure or portion thereof used or designed for the shelter or care of horses, cattle or similar animals, either permanently or transiently.

"Street": Includes streets, roads, avenues, Street. boulevards and other public highways for vehicular traffic other than "alleys" as herein defined.

"Street Line": The division line between the street and lot.

"Structure": Anything constructed or erected the use of which demands a permanent location on the soil or attached to something having a permanent location on the soil.

"Superintendent": The Superintendent of the Bureau of Building Inspection.

"Telephone Central Office": A building and its equipment, erected and used for the purpose of facilitating transmission and exchange of telephone messages between subscribers, and other business of the Telephone Company; but in a residential district not to include public business facilities, storage

The location and boundaries of said zones are Zoning map. hereby established as shown on the "Zoning Map" which accompanies this ordinance and is hereby declared to be a part thereof. Said map and all notations, references and designations shown thereon shall be as much a part of this ordinance as if the same were all fully described and set forth herein.

ARTICLE II.-REGULATION OF USES.

SECTION 5. Uses in "A" Zones. In the "A" Zones no building, structure or premises shall be used and no building or structure shall be erected or altered which is arranged, intended or designed to be used except for the following uses or purposes: Dwellings.

(e) Schools and libraries.

(f) Hospitals, orphanages, asylums and other charitable or public institutions, other than such as are intended for the insane or feeble-minded, or for the custody, correction, reformation or detention of persons for any cause.

(g) Buildings, structures, highways, parks and playgrounds which are property of the City of Scran

ton.

(h) Meeting halls and club houses not primarily devoted to business purposes.

(i)

Farming, gardening or green houses.

(j) Structures or facilities of public service companies other than buildings or gas tanks.

SECTION 6. Accessory Uses in "A" Zones. In the "A" Zones the following uses and no others shall be permitted as accessory to the principal uses and purposes as set forth in Section 5 hereof:

(a) Outbuildings, customarily used in connection with or accessory to the principal use and not conflicting with existing laws or ordinances.

(b) Private garages.
