such part thereof, as they shall find necessary and convenient for such light house, and shall return their verdict to the said court. And in case the said court shall not then be in session, shall seal up their verdict, and deliver the same to the said sheriff, or his deputy, who shall make return thereof to the said court, at the next term, to be holden in and for said county; which verdict of the jury being accepted by the said court, and the amount of said verdict being paid to the owner or owners of the land appraised, and set off by the jury, or if the owner or owners shall not appear, or shall refuse to receive such amount in money, as the said court shall order, then the amount of the appraisement aforesaid shall be lodged in the office of the treasurer of the county of Suffolk, to be received by the owner, or any person legally authorized to receive the same; and the tract of land, so appraised and set off, shall be vested in the United States, and shall be taken, posUnited States. sessed, and appropriated for the purposes aforesaid: Provided, That all charges of such application and appraisement shall be paid by the United States: Provided also, That the title to the said land shall be, and continue invested in the said United States, so long as the same shall be used for the purpose of a light-house, and for the maintaining of the same, and no longer. SECT. 1. SECT. 2. Be it further enacted, That said sheriff or deputy sheriff, after being notified, in writing, by said coroner, of the lance to him, execution, in his the said coroner's hands, on which said share after deducting or interest, equity of redemption, or personal property shall prior demands have been taken, or which issued on the mesne process, whereon said share or interest, equity of redemption, or personal property had been attached, of the time of such attachment on mesne process, or taking on execution, and of the whole. amount, including fees due on said execution, shall pay over to said coroner the amount due on said execution, or so much thereof, as shall remain in his hands, after satisfying all executions in his own hands, on which said share or interest, equity of redemption, or personal property had been taken, or which issued on mesne process, whercon said share or interest, equity of redemption, or personal property had been attached, prior to the time of the attachment on mesne process, or taking on exe-. cution as aforesaid, by said coroner.

SECT. 3. Be it further enacted, That whenever any coroner shall make sale of such share or interest, equity of redemption

or personal property, which shall, before such sale, have been attached on mesne process, or taken on execution by a sheriff or deputy sheriff, such coroner shall be subject to the same duties and requirements, in relation to such sheriff or deputy sheriff, as by the first and second sections of this Act, a sheriff is, in like case subject to, in relation to a coroner.

SECT. 4. Be it further enacted, That whenever any constable shall make sale of such share or interest, equity of redemption, or personal property, which shall, before such sale, have been attached on mesne process, or taken on execution, by a sheriff or deputy sheriff, or by a coroner, such constable shall be subject to the same duties and requirements, in relation to such sheriff or deputy sheriff, or coroner, as by the first and second sections of this Act, a sheriff is, in like case subject to, in relation to a coroner. An ACT to relieve Towns from the Expenses of supporting persons imprisoned for

SECT. 1 BE it enacted by the Senate and House of Representa tives, in General Court assembled, and by the authority of the same, That when any person, committed to prison on mesne process. or execution, in any civil action, shall obtain the liberties of the prison yard, such person shall not be deemed and considered a pauper, so long as he or she shall be at large within the limits of the prison yard, nor shall the town to which such debtor belongs, nor the Commonwealth, in case such debtor has no place of legal settlement therein, be charged with his or her support.

SECT. 2. Be it further enacted, That every town or district, which shall be liable for, and shall have paid any of the charges wealth may re- of maintaining, in close prison, any person as a pauper, hereafter committed on mesne process, or execution, in any civil paid for deb action, may recover the same in an action at law against the creditor, at whose suit such debtor shall have been committed, and for the time he shall continue so imprisoned, at the suit of such creditor, at the rate of one dollar and twenty five cents, for the support of such debtor, per week; and such creditor shall also be liable to the Commonwealth for similar expenses incurred by the Commonwealth: Provided however, that said creditor may, at any time, discharge his debtor, committed as aforesaid, from prison, and such discharge shall not operate to release the debtor from the debt and costs on which he was committed; but such debt and costs, together with all sums which

the creditor may have paid for the support of the debtor, in manner as herein before provided, shall be, and remain a legal claim against the goods and estate of the debtor, his or her body being forever thereafter exempted from arrest therefor.

SECT. 3. Be it further enacted, That the keeper of the prison Gaolers' shall be entitled to receive at and after the rate of one dollar charge for board, limited. and twenty five cents per week, and no more, for the support of each debtor, being a pauper, in close confinement.
