CONTRACTS FOR WORK, AGREEMENTS OF PARTNERSHIP. 1. Contracts for Work. By these contracts the one party engages to perform certain work, and the other to pay a certain sum of money. It is, therefore, necessary, on the one part, that the work to be undertaken, should be accurately described, as to its extent, the manner in which it is to be performed, and the time when it is to be completed; on the other part, it must be particularly determined, what is to be the compensation for the work, and when it is to be paid. It is also advisable to state in the contract, the manner in which the work is to be tested, and the fine to be imposed in case such work has not been properly performed. 2. A Contract for Coal. Contract made and concluded the 30th day of June, one thousand eight hundred and fifty-three, by and between Gottlieb Grub, of the town of Reading, and State of Pennsylvania, of the first part, and George Bauer, of the same place, of the second part, in these words: The said party of the second part covenants and agrees to and with the said party of the first part, to deliver 100 tons of coal, at No. 98 street, in the city aforesaid, between the 6th and 10th days of July, in the year aforesaid. And the said party of the first part, covenants and agrees to pay unto the said party of the second part, for the same, the sum of dollars, lawfu. money of the United States, as follows: the on the 1st day of August, and the remaining sum of dollars on the 1st day of October, in said year. And for the true and faithful performance of all and every of the covenants and agreements above mentioned, the parties to these presents bind themselves, each unto the other, in the penal sum of dollars, as fixed and settled damages, to be paid by the failing party sum of schlecht behandelt hat, indem er sich geweigert hat, mich mit den nö thigen Lebensbedürfnissen und Kleidern zn versorgen. In diesen Verträgen verpflichtet sich der eine Theil zur Verrichtung etner gewissen Arbeit und der andere zur Zahlung eines bestimmten Lobnes. Es kommt also einerseits darauf an, daß die zu übernehmende Arbeit nach ihrem Umfang, so wie nach der Art, wie sie verlangt wird, und die Zeit, in welcher sie gethan sein soll, auf's Genaueste bestimmt wird, andererseits aber darauf, daß der Lohn für die Arbeit, so wie die Zeit, wann er gezahlt werden soll, gehörig festgesezt wird. Rathsam ist es auch, die Art und Weise der Prüfung, ob die Arbeit gut sei, und die Strafe, wenn die Arbeit für schlecht befunden wird, im Contract mit festzustellen. 1. Contract über die Lieferung von Steinkohlen. Contract, eingegangen und abgeschlossen den 30. Juni eintausendachthundertunddreiundfünfzig, von und zwischen Gottlob Grub aus der Stadt Reading, St. Pennsylvanien einerseits, und Georg Bauer von da anderseits,, in diesen Worten: Die besagte Partie von der zweiten Seite contrahirt mit der besagten Partie von der ersten Seite und verspricht derselben, 100 Tonnen Steinkohlen in Nr. 98--Straße in der besagten Stadt zwischen dem 6. und 10. Juli in dem vorbesagten Jahre abzuliefern. Und die besagte Partie von der erften Seite contrahirt und verspricht dafür der Partie von der zweiten Seite die Summe von-Dollars, gesezliches Vereinigte Staatengeld, wie folgt, zu bezahlen: Die Summe von Dollars den 1. This agreement made the 3d day of January, 1854, between Jacob Weiss, of Boston, and Jonathan Frock, of New Haven, witnesseth That the said Jacob Weiss for the consideration hereinafter specified, covenants and agrees, to and with the said Jonathan Frock, that he will provide good and proper lithographic stones, and will lithograph thereon separately, the map of each and every State of Mexico, according to the plans, specifications and drawings, hereunto annexed; and that he will finish and complete the same in a workmanlike manner, and deliver them to the said Jonathan Frock on or before the first day of April next. In consideration whereof, the said Jonathan Frock covenants and agrees to pay to the said Jacob Weiss, upon the delivery of each and every of the said lithographic stones, the sum of dollars, in full payment and satisfaction thereof. And for the true and faithful performance of all and every of the covenants and agreements above mentioned, the parties to these presents bind themselves each unto the other in the penal sum of dollars, as fixed and settled damages, to be paid by the failing party. Agreement to build a Common Fence. This agreement, made the 16th day of July, 1852, between Henry Schultz, of and Christian Hohn, of witnesseth. That whereas the said Henry Schultz is the owner of the farm von fich die contrahirenden Theile wechselseitig zu einer Conventionalstrafe Dollars, die als Entschädigung ausgesezt und bestimmt sein soll, um von dem zuwiderhandelnden Theil bezahlt zu werden. Gottlieb Grub. (L. S.) 2. Contract über die Lithographie von Land-, farten. Dieser Vertrag, abgeschlossen am 3. Januar 1854 zwischen Jakob Weiß von Boston und Jonathan Froď von New Haven bezeugt: daß der besagte Jakob Weiß für die hiernach angeführte Gegenleistung mit dem besagten Jonathan Frock contrahirt und sich gegen ihn verpflichtet hat, daß er gute und geeignete Steinplatten anschaffen und darauf abgesondert die Karte von allen und jeden Staaten Meriko's nach den hier unten beigefügten Planen und Zeichnungen lithographiren will, und daß er dieselben in meisterhafter Weise ausführen und vollenden und sie an den besagten Jonathan Frock am oder vor dem 1. April 1854 abliefern will. Als Gegenleistung dafür verspricht und verpflichtet sich der besagte Jonathan Frock, an den besagten Jakob Weiß bei Ablieferung aller und jeder der besagten Steinplatten die Summe von -Dollars als vollständige Bezahlung und Befriedigung dafür zu entrichten. Und für die richtige und getreue Erfüllung aller und jeder der vorerwähnten Pakte und Uebereinkünfte verpflichten sich die Contrahenten wechselseitig zu einer Conventionalstrafe von Dollars, die als festgesezte und abgemachte Entschädigung von der zuwiderhandelnden Partie zu bezahlen ist. Jakob Weiß. (L. S.) Jonathan Froc. (L. S.) 8. Vertrag über die Aufführung einer gemein schaftlichen Fence. Dieser Vertrag, abgeschlossen den 6. Juli 1852 zwischen Heinrich Schulz von- und Christian Hohn von -, bezeugt: Daß, in Betracht, daß der besagte Heinrich Schulz, der Eigenthümer der Farm describe the situation, etc.); and the said Christian Hohn is the owner of the farm adjoining the same, on the southerly side thereof, on which last mentioned farm the said Christian Hohn is about to establish a vineyard: Now, therefore, the said Henry Schultz, in consideration of the sum of dollars, to tim in hand paid, the receipt whereof is hereby acknowledged, doth, for himself, his heirs, executors, administrators and as signs, covenant, grant, promise, and agree, to and with the said Christian Hohn, his heirs, executors, administrators and assigns, that he, the said Christian Hohn, his heirs and assigns, shall and may in the establishment of a vineyard, as aforesaid, freely and lawfully, but in a workmanlike manner, make use of the southerly part of the orchard of the said Henry Schultz, or so much thereof as the said Christian Hohn, his heirs or assigns, may desire, as a fence, to be continued and used as such for ever. And the said Henry Schultz and Christian Hohn do hereby mutually covenant and agree, for and with themselves, and their respective heirs and assigns, that if it shall hereafter become necessary to repair or re-build the whole, or any portion of the said fence, the expense of such repairing or rebuilding shall be borne equally by the said Henry Schultz and Christian Hohn, their respective heirs and assigns, as to so much and such portion of the said fence as the said Christian Hohn, his heirs and assigns, shall or may use for the purposes aforesaid; and that whenever the said fence, or any portion thereof, shall be re-built, it shall be erected on the same spot where it now stands, and be of the same size, and the same or similar materials, and of like quality, with the present fence. It is further mutually understood and agreed between the aforesaid parties, that this agreement shall be perpetual, and at all times be construed into a covenant running with the land; and that no part of the fee of the soil upon which the fence of the said Henry Schultz, above described, now stands, shall pass to, or be vested in, the said Christian Hohn, his heirs and assigns, in or by these presents.
