city; unless such Dog be well secured, so as to do, and cause no damage or injury in the day time; and also have fixed round the neck, a collar, with the name of some creditable white person engraved thereon, which said white person shall be considered as the owner of the dog, and shall be held responsible and liable for any damage or injury that may be committed by such dog. And every free negro, mulatto or person of colour, who shall have in his possession any dog, contrary to the condition above expressed, shall forfeit a sum not less than five dollars, and not more than ten dollars, to be recovered before the Inferior City Court, with the costs of suit; the same to be applied to the use of the informer. And in case any slave shall have in possession any dog, contrary to the condition above expressed, the said slave shall be liable to, and shall by order of one or more of the Wardens of the city, receive at the WorkHouse, a correction not exceeding twenty lashes, unless the owner of the said slave shall pay the sum of five dollars to the informer. And in case any dog in possession of a slave shall appear at large in any part of the city, the said slave shall be liable to, and shall by order of one or more of the Wardens of the city, receive at different times, as shall be prescribed, two corrections, not exceeding twenty lashes each, at the public market, unless the owner of such slave shall pay to the use of the informer the sum of ten dollars. And in case any dog, in the possession of, and kept by a free negro, mulatto, or person of colour, on the condition before expressed, shall appear at large in any part of this city, the said free negro, mulatto, or person of colour, shall be subject to the forfeiture and penalty expressed in the first clause of this ordinance, to be recovered in the manner there expressed.

5. That whenever any dog shall be removed from Dogs to be seone part of the city to another, or from any vessel cured. or boat at any wharf, to any part of the city, the said dog shall be secured by a sufficient rope, cord or chain, and one end thereof shall be held by the person or persons who shall have the charge of the dog. That every person coming to the city, by land, or going out of the city accompanied by a dog or dogs, shall cause each and every of them to be secured.That every butcher's dog shall be secured to or under the cart of the said butcher, while coming into, or going out of the city; and no dog shall appear, or be brought into the markets on any account, or in any manner. And every person who shall be accompanied by a dog in the streets, or in public, shall have the said dog secured by a sufficient rope, cord or chain, and one end thereof shall be held by the said person. And in case of neglect, each and every dog shall be considered as going at large, and shall be liable to be killed, and the owner thereof, subject to the forfeiture herein before expressed. And also in every case, where any dog, although secured in

6. That the City Marshal be, and he is hereby appointed the officer, under the direction of the Intendant, or the Intendant and Wardens, to execute and enforce this ordinance. That it shall be the duty of the City Marshal at all times, when ordered by the Intendant, or directed by the Council, to proceed agreeably to the order, direction or resolution, given and extended to him, to execute this ordinance. And in case of his neglect he shall be liable to such forfeiture and penalty, as the Council shall by resolution inflict on him for his neglect of duty.

7. That the City Marshal, and the person or persons employed by him, and acting in obedience, and in conformity hereunto, shall be indemnified and saved harmless.

8. 9. Repeal.

10. That all former ordinances passed, to prevent dogs from going at large; and all ordinances or parts thereof repugnant to this ordinance, be and the same are hereby repealed.

The penalties inflicted by this ordinance are declared to be for the use of the city, by the last clause of an ordinance passed on the 5th of July, 1814.
