2. That the said Commissioners be, and they are To appoint hereby empowered to appoint, and at their pleasure perintenda to discharge, a superintendant of the said bake-house, who shall act under their directions, and agreeable to their orders: also to appoint and employ, and to discharge when they judge proper, a baker or bakers, and such servant or servants, as shall be required by them for accomplishing the objects of the bake-house; so that the aforesaid institutions be always furnished with bread, of a good and wholesome quality: Provided however, that the appointments aforesaid, made by the said commissioners, shall always be submitted by them for the approbation of the City Council.

4. That the superintendant, and the baker or bakers, to be employed as aforesaid, shall, if required by Baker, &c. to the said commissioners, or by Council, give bond or bonds to the City Council, in such sum or sums, and with such security, as shall be, from time to time thought sufficient, the said bond or bonds to be conditioned for the faithful discharge of his or their respective duties.

5. That the said Commissioners be, and they are hereby authorized to draw on the City Treasurer, for Sums to be ada sum not exceeding four hundred dollars, to enable them to make every arrangement for carrying the objects of the said bake-house into effect.

6. That the said Commissioners be, and they are hereby authorized to draw every three months on the City Treasurer, for a sum not exceeding one thousand dollars, for the purpose of supplying the said bakehouse with flour and other materials, required for making bread and should the said sum be not suf ficient to purchase the supplies required for each quarter, that the said Commissioners shall then report to Council, the further sum that will be requisite, in

7. That the said Commissioners shall report, and rendered. render their accounts, at the expiration of each fiscal quarter in the same manner as the reports and accounts are made and rendered by the other boards of Commissioners, annually appointed by Council.

Whereas, it is expedient, in order to preserve the 24, 1815. Health of this city, that a Board of Health should be constituted:

and in every year, on the same day that other commissioners are elected: and, that the said commissioners of health shall be so chosen, that three of them shall be elected from Ward No. 1-three of them from Ward No. 2-three of them from Ward No. 3 and four of them from Ward No. 4. And every person, who, being elected, shall refuse to serve, shall forfeit and pay the sum of fifty dollars, for such refusal. Provided, that no person shall be obliged to serve more than one year in five.

2. That the Commissioners of Health, of whom seven shall constitute a quorum, shall meet as a board at least once a week, from the first day of June, to the first day of November, (and at such other times as they may deem necessary) at the city-hall, or other place convenient for them, for the purpose of receiving and communicating all possible information relative to the health of the city, and to advise and consult together, respecting the preservation of the same; to perform the duties herein mentioned, and to adopt such further regulations and measures in discharging the trust confided to them, as may appear proper and necessary; and each and every practicing physician within the city, is requested to give immediate information of the existence, of any contagious or ma

lignant disease, to the Commissioners of Health, or any of them, and at at all convenient times to aid and assist the said Commissioners, with their counsel and advice, in all matters that relate to the preservation of the health of the inhabitants, and the prevention of malignant diseases.

3. 4. That the said Commissioners of Health, collectively, or any one of them, accompanied by the Intendant or any Warden,* shall have full power and authority, to enter upon any lot, grounds and possessions of any person or persons, and thoroughly to examine the same: And whenever the said commissioners, or any of them, shall have cause to suspect Commissionthat foul air or noxious effluvia originate or are collected, in any house, cellar, vault or enclosure, shut up from public view, they, or any of them, accompanied as aforesaid, may demand entry therein, in the day time, and may direct the same to be opened and ventilated, as often as they may deem it necessary: And if the owner or occupant of any lot, ground, house, cellar, vault or enclosure, shall refuse or delay to open the same, and suffer it to be examined and ventilated, as aforesaid, or shall in anywise, obstruct the said commisssioners, or any of them, in the discharge of their duty, he, she or they, shall be liable to a fine of one hundred dollars, for every such offence: And if the owner or occupant of the premises on which any nuisance shall be found, which in the

in the said notice, he, she or they so refusing or neglecting, shall forfeit and pay the sum of fifty dollars, for the use of the corporation, and the further sum of twenty-five dollars for each and every day the said nuisance shall remain thereafter, contrary to said notice: And the said owner or occupant shall moreover defray and pay the expences incurred, in case such premises should be filled up, or such nuisance corrected or removed, by any person employed under the authority, and by the direction of the Commissioners of Health, with the consent of Council: And if the person or persons, liable to such expence, shall refuse or delay the payment thereof, the same shall be paid out of the City Treasury, and be afterwards recovered by an action of debt, from the person offending or refusing as aforesaid, in any court, having competent jurisdiction.

ceive such salary and emolument, as are hereinafter specified. It shall be the duty of the said Clerk to make diligent enquiry with respect to all nuisances which exist within the city; to receive all complaints which may be made to him upon such subjects; to examine, personally, all premises on which nuisances may be found, or supposed to exist, and to report to a commissioner or the commissioners of the ward in which such premises are, all the information which he or they may acquire. And it shall be the duty of the said Clerk to attend the meetings of the Board of Health, record their proceedings, and obey such instructions as they may give in relation to the health of the city; and the said Clerk shall receive as a compensation for his services, the annual salary of three hundred dollars, payable quarterly, and one half of the fines that may be collected under this ordinance.

6.
