9. That from and after the aforesaid first day of Superintend August next, the said Superintendant shall com-ant to keep mence and keep two separate books, in one of which two separate he shall fairly and accurately register the interment of all white persons, and in the other the interment of all negroes and other persons of colour, who shall be buried on the aforesaid city Burial Ground at Cannonborough. 12. 13. 14. 15. That the said Superintendant shall, agreeably to the twelfth clause of the afore cited ordinance, give sureties, and bond in the sum of six hundred dollars, for the due make oath,&c. and just performance of the duties of his office, with

such surety or sureties, as shall be approved of by the City Council; and that he shall likewise, before entering upon his station, make oath, or affirmation, before the City Council, in manner and form following, that is to say: "I, A. B. do solemnly swear, (or "affirm) that I will diligently and faithfully perform "and execute all the duties of a Superintendant of "the City Burial Ground, as prescribed, or to be "prescribed, by any ordinance or resolution of the "City Council of Charleston. So help me God."

nonborough; to visit the same from time to time, and once at least in every month; to give such instructions concerning the same to the Superintendant, as to them or any of them may appear meet and suitable; and to report to the City Council all irregularities and defects, which may come to their knowledge, relative to the said ground, or to the Superintendant thereof.

17. That it shall be the duty of the City Marshal, sit the burial to visit the City Burial Ground one at least in every week, and at any other time, when the Intendant of

city, or any member of the committee on city lands, shall require it; to report to them respectively on the state thereof, and on any special matter to him referred concerning the same; and to execute all such orders, as may be given to him in regard thereto, by the Intendant, or any member of the aforesaid committee.

Whereas, the fees and emoluments assigned to the Superintendant of the City Burial Ground, are an in- 20th, 1809. adequate compensation for the expence he incurs, and the time and trouble he is under the necessity of devoting thereto :

1. Be it ordained, That from and after the first day of February next, the Superintendant of the City Interment fees Burial Ground, shall receive for making the interment and register of every negro or person of colour, one hundred cents; and that until the fees and perquisites which are demanded by the said Superintendant are fully paid, he may refuse to receive within the enclosure of the cemetry, any corpse brought to be deposited therein; except such as are sent from the Poor or Orphan House, or Marine Hospital, under the twelfth clause of the ordinance for regulating interments within the City Burial Ground.

2. That so much of the ordinance to regulate interments within the City Burial Ground, passed the Repugnant clauses repealtwentieth day of June, in the year of our Lord one ed. thousand eight hundred and seven, as is repugnant hereto, be, and the same is hereby repealed.
