7. That one or more of the City Wardens, shall in such rotation, as may from time to time be established by the City Council, for the arrangement of the Captain to pre guard committee, visit the main guard house every morning between six and nine o'clock, to whom the captain of the City Guard, shall then and there present a true and accurate list (subscribed, and if required, to be sworn to by him) containing the names of every officer, sergeant, private, fifer and drummer, who on the preceding night or day was absent from duty, or guilty of intemperance or other misconduct, or had lost or damaged any of the arms or other articles, furnished at the expence of the city for the use of the City Guard. And such Warden or Warden's duty or Wardens, when visiting the main guard house in the morning as aforesaid, or either of the two guard houses at any other time by day or night, are, and each of them is, hereby authorized and required, to order every one, whose name is contained in the said list, or who may be otherwise known to him or them as a defaulter or delinquent, although not mentioned in the said list to appear before him or them, and to adjudge the fine or fines and other punishment, to be sustained by any one, who was or is absent, or guilty of intemperance or other misconduct, or charged with having lost or damaged any of the arms or other articles, belonging to the City Guard, as aforesaid; which fines and punishments such Warden or Wardens shall note in the aforesaid list, opposite to the name of those, so fined or punished respectively. Provided however, That every officer, charged with misconduct, shall be reported to the Intendant, to be by him summoned before the City Council: And provided also, that neither the fine, payable by a sergeant, private, fifer or drummer, shall exceed his monthly pay, nor the punishment of any such sergeant, private, fifer or drummer, shall be no

8. That the captain of the City Guard shall at the end of the term, for which any guard committee is appointed, prepare a rank roll, specifying the sums Captain's duty o be respectively deducted from the salary of any officer, or from the pay of any sergeant, private, fifer or drummer, for absence or other offences, for which any of them hath been during the said term fined or punished as aforesaid; which rank roll, after having been examined by the said guard committee, or any of its members, shall then be signed by the captain, and countersigned by the member or members of the guard committee, being present; whereupon the captain shall deliver the same to the Intendant. At the beginning of every month, the captain of the City Guard shall make out a pay roll, stating therein the presence and absence of every member of the said guard, and noting the nights or days, on which any one has neglected his duty in the course of the preceding month, together with the deductions to be made from the salary of any officer, and from the pay of any serjeant, private, fifer or drummer, in conformity with the above mentioned rank rolls.To the said pay roll, the captain of the City Guard shall likewise annex a true and accurate return of the number and condition of the muskets, bayonets, cartouch boxes, ammunition, clothing, and all other articles furnished at the expence of the city, for the use of the City Guard, and for which he is hereby made accountable; and the said pay roll and return, he shall, on or before the fifth day of every month, present, duly attested, to the Warden, who may be chairman of the committee on accounts, to be examined by him, and compared with the rank roll or rank rolls as aforesaid, if furnished with the latter by the Intendant, in order that the same may be laid before the City Council at the next meeting. And if the captain of the City Guard should neglect, to deliver such pay roll and return to the chairman of the committee on accounts, as aforesaid, he shall forfeit out of his salary, the sum of five dollars for every day, while he neglects such delivery.

9. That the captain of the City Guard shall have his fixed residence in the main guard house, but may reside elsewhere in the city, if one of the lieute nants of the City Guard takes up his residence in the said guard house, and the City Council approves thereof. And the said captain shall take special care, that the two guard houses, and the appartments of the prisoners be always kept in a decent and whole some state, and good order and proper discipline be maintained in the same. He shall also, at all times attend to such orders, as he may receive from the Intendant of the city, and shall carry such orders into effect, and have them strictly enforced: He shall, at proper times, call on the Intendant for instructions, on any occasion or emergency, where he may want them. He shall every morning make a report in writing to the Intendant, in such form and of such tenor, as the latter may, from time to time, prescribe to him. He shall, in general, perform with punctuality and vigilance, all the duties enjoined on him by this ordinance, and shall use his best authority, to make the men under his command, prompt and diligent in the services required of them. Three days before the end of every month, the captain of the City Guard shall present a return of the whole company to the Intendant, who shall have power to disapprove of any of the sergeants, privates, fifers, and drummers, and order others to be substituted or enlisted in their stead.

10. That the captain of the City Guard shall cause the whole company, properly armed and accoutred, to assemble at the main guard house at seven o'clock in the evening, from the twentieth day of September to the twentieth day of March, and at eight o'clock in the evening, from the twentieth day of March, to the twentieth day of September; at which respective hours, the roll shall be called in his presence, and he shall then detach, one lieutenant, six sergeants, twenty-seven privates, one fifer and one drummer, to the picquet guard house, there to take post, and to duty, until the next morning; and to the said lieutenant he sall give such orders, not repugnant to any city ordinance or guard regulation, or

11. enabled to send, towards the first division of the city, extending from South-Bay to Tradd-street inclusive, and another sergeant, with a like number of privates, towards the second division of the city, extending from Tradd-street to Amen, Moore, Clifford, and Magazine-streets. And the commanding officer of the picquet guard house, shall at the same time, dispatch from thence, a sergeant, with a like number of privates, towards the third division of the city, extending from Amen and Moore-streets, through King-street, and that part of the city situated to the eastward of King-street; and another sergeant, with a like number of privates, towards the fourth division of the city, extending from Clifford and Magazinestreets, through King-street, and that part of the city situated to the west of King-street. And every sergeant, when patrolling, as as aforesaid, shall wear a sword at his side and carry a halbert in his hand; and every private shall carry a gun and bayonet, and one of them also a rattle; and thus armed, they shall constantly remain together, and patrole through every street, lane, alley, and open court, within their respective divisions, until relieved, as hereinafter directed. Every night, fresh parties of relief, consisting of like numbers, provided with like weapons, and bound to perform like services, shall be dispatched at twelve o'clock, from the two guard houses, towards the aforesaid four divisions of the city, to be relieved by like parties, at three o'clock, which last reliefs shall return at the beating of the reveille. And it shall be the duty of every sergeant, after being relieved with his party, as aforesaid, to report to the commanding officer of the guard house, the conduct of the privates under his charge, and other ocSergeants to report on their currences during their tour. At the same time when the sergeants return to the guard houses, with the privates relieved as aforesaid, the centinels shall likewise be successively relieved.
