In the Catalogue of the New York Historical manuscripts, vol. I, p. 3, is a list of those who refused to sign the General Association of August 15, 1775, in which list appear the names of

JOHANNES VAN VOORHIS,
ELIAS VAN VOORHIS,

from which it appears that the two sons of Johannis Van Voorhees, Junior, favored the Tory party at the commencement of the War for Independence, and preferred to remain loyal to the king.

No will or letters of administration upon the estate of John Van Voorhis have been found by the writer.

Ransie or Ranche Nostrand, the second wife of John Van Voorhis, married after his death Cornelius Cooper, of Fishkill, and is buried in the churchyard of the Dutch Church, Fishkill Village.

John Van Voorhis was buried in the Van Voorhis burying-ground at Fishkill Landing.

... In the name of God, Amen! I, Daniel Southerd, of Rombouts Precinct, Duchess County, and State of New York, being weak in body, but of sound mind and memory, thanks be given to God for the same, and calling to mind that it is appointed for all men once to die, do make and ordain this my last Will and Testament in manner following, that is to say: First, I recommend my soul to God who gave it to me, and my body to the earth, to be buried in a christianlike manner at the discretion of my Executors, who shall hereafter be nominated, viz. :

First, I give to my son, Richard Southerd, my fowlingpiece and yellow mare, and when he shall come of age Fifty pounds current lawful money of the State of New York, to him and his heirs forever-his birthright.

Secondly, That it is my will that my beloved wife, Sarah Southerd, be real master of all my estate for the bringing up of all of my children while she remains my widow; but if she should come to marry, then, if my Executors should think it most for the advantage of the estate and the benefit of the children, to sell the whole of my estate, both real and personal, and to divide the same, share and share alike, with my beloved wife Sarah, Richard, Sarah, Jane, Catherine, Elizabeth, each to have an equal share and share alike between my wife and five children; but if any should die before they come of age, and unmarried, so that they have no heirs, that moiety or share shall be equally divided among the remaining that are alive, share and share alike, to them,

their heirs and assigns forever, except that what was above given, and my honest debts and funeral first paid. And I do hereby make and ordain my beloved wife Sarah Southerd and dear brothers Richard Southerd and Zebulon Southerd and Gilbert Southerd my sole Executors to this my last Will and Testament.

In witness whereof, I have hereunto set my hand and seal this twelfth day of November, One thousand seven hundred and seventy-nine.

Elias Van Voorhis, although he appears to have favored the Tory party at the commencement of the Revolution, was nevertheless for some reason taken prisoner by the British in 1776, sent to New York City, and confined in the old Sugar-house Prison, where he died some time during the year 1778. He left no will, but an inventory of his personal ·

estate is recorded in the office of the Surrogate of the City and County of New York.
