TITLE IX.-MANIFESTS.

Baltic.

Rule 1. WHERE any British or Irish vessel shall sail from 17 Geo. 3. Great Britain or Ireland, or any other part of His Majesty's domi- c. 41. § 5. nions, to any place in the Baltic where any consul now is, or hereafter may be appointed for his Majesty's subjects trading thither, the master of the vessel shall, within 10 days after her arrival at such place, deliver to the said consul residing there, or to such other person as shall be appointed for that purpose by him, a true manifest in writing, upon oath, specifying the particulars of the whole of the vessel, with the marks and numbers of the packages containing the same, if delivered there, or of such part thereof as shall be so delivered there, and to whom consigned. In case any master refuse or neglect to deliver such manifest, such consul, or person, is required to detain the clearance outwards of the vessel, and not deliver any dispatch, passport, or bill of health, for any such vessel.

Norway, and

Rule 2. Such part of the foregoing act of 17 Geo. 3. as requires 18 Geo. 3. the master of any British or Irish vessel, sailing from Great Britain or c. 40. § 2. Ireland, or any other part of His Majesty's dominions, to any place in Denmark, the Baltic, to deliver to the British consul residing there, or to such Archangel. other person as shall be appointed for that purpose by him, a true manifest, in writing, upon oath, specifying the particulars of the whole cargo of such vessel, with the marks and numbers of the package containing the same, shall extend to such British or Irish vessels as shall sail from Great Britain or Ireland, or any other part of His Majesty's dominions, to any of the ports of Denmark, Norway, and Archangel, in the same manner, and under the same restrictions, in all respects, as are directed by the said act, with regard to such vessels sailing to any place in the Baltic.

Manifest.

Rule 3. No goods shall be imported into Great Britain, from any 26 Geo. 3. place whatever, in parts beyond the seas, in any vessel whatever, c. 40. L. belonging in the whole or in part to His Majesty's subjects, unless the master of every such vessel, importing such goods, shall have on board

Wine, 2.

a manifest, (a) in writing, signed by such master, containing the name or names of the respective places where the goods in such manifest mentioned shall have been respectively laden or taken on board, the name and built of such vessel, and the true admeasurement or tonnage thereof, according to the register of the same, together with the christian and surname of the master of such vessel, and the place to which such vessel truly belongs, and a just, true, correct, and particular account of all the cargo, and of all packages of goods so laden or taken on board, with the respective marks (6) thereon, and of the particulars of the cargo which is stowed loose, and of the following particulars, in words at length; that is to say, the respective numbers of the packages, with a particular description thereof, whether leaguer, pipe, butt, puncheon, hogshead, barrel, or other cask or package, describing such other cask or package by its usual or ordinary name; or whether case, bale, pack, truss, chest, box, bundle, or other package, or by such other name or description as the same is usually called or known.

Rule 4. No wine (c) of any sort shall be imported into Great Bri

(a) Where the word manifest is used under this title, the terms in the act are "a manifest or manifests, content or contents."

As to dispensing, in certain instances, with the manifest for tobacco, see TITLE 186, Rule 52.

As to manifests for vessels in the East India trade, see TITLE 90.

CUSTOM HOUSE, LONDON, Feb. 20, 1816.

Notice. It having been represented to the Commissioners of His Majesty's Customs, that the masters of British ships and vessels entering inwards from Senegal and other British settlements on the coast of Africa, have not been required to produce a manifest or content of the cargo, agreeably to the above act, and this practice not having been sanctioned by any authority of the Lords of His Majesty's treasury or of this Board, The Commissioners of His Majesty's Customs hereby give notice, that if, after the expiration of nine months from the date hereof, any goods shall be imported or brought into Great Britain in any ship or vessel belonging in the whole or in part to His Majesty's subjects, from any part of Africa, without the manifest or content in writing required by the said act, the master of the ship or vessel importing such goods will be prosecuted for the penalty, as the law directs. (b) It appearing that a diversity of practice has prevailed on the subject of requiring the the marks and numbers on hogsheads of sugar, imported from the West Indies, to be inserted in the manifests produced by the masters of the importing vessels, and also in the reports of their cargoes; and it appearing that the insertion of these particulars in both documents is required by 13 & 14 Cha. 2. c. 11. [TITLE 10.] and 26 Geo. 3. c. 40. and is therefore indispensable, and that in the form of the master's reports the same is specially provided for; it is directed that the same be regularly required in future. Order of the Board of Customs, dated Dec. 4, 1813.

By letter from the board of treasury, dated the 11th of Aug. 1814, it is directed, that if, upon the delivery of cargoes of vessels, it shall appear that any packages which may be erroneously marked, do in substance and contents correspond with the report and the manifest, neither such goods nor vessels shall be deemed liable to seizure by officers of customs, on account of such error.

(c) By order of the board of customs, dated Nov. 29, 1817, where an error or omis. sion is discovered in a master's report on the day on which it is made, and before any seizure, stop, or detention has taken place, the collector and controller may, on being satisfied that no fraud was intended, permit the report to be amended.

Notice, as to the Importation of Wine.-Whereas since the passing of the act 26th of His present Majesty, c. 40. wines have frequently been imported into this country, from places not belonging to, or under the dominion of the crown

tain, from any place whatever in foreign parts, not belonging to or 26 Geo, 3. under the dominion of the crown of Great Britain, in any vessel what- c. 40. ever, unless the master of the vessel in which such wine shall be laden, shall have on board, in like manner, a manifest in writing, made out and signed by such master, on or before the clearing or departure of every such vessel from each such place where such wine shall be laden on board, containing the names of the respective places where the wine mentioned in such manifest shall have been so respectively laden or taken on board, the name and built of such vessel, and the true admeasurement or tonnage thereof, together with the christian and surname of the master of such vessel, and the place to which such vessel truly belongs, and a just, true, correct, and particular account of the whole quantity of wine, distinguishing the quantity of each different kind, so taken on board, and of the respective marks upon the different packages respectively, and, if known, the names of the persons to whom the wines are respectively consigned; and also, in words at length, the respective numbers of the packages, with a particular description thereof, whether leaguer, pipe, butt, puncheon, hogshead, barrel, or other cask or package, or by what name or description such other cask or package may be usually called or known: provided Documents. always, that nothing in this act shall extend to permit any goods whatever, which are now by law required to be accompanied with certificates or other documents, to be imported into Great Britain without every such certificate or other document so required; but the same shall be accompanied, as well with such certificate or other document as with the manifest hereinbefore directed; and, on failure thereof, the goods shall respectively continue to be liable to all the duties, regulations, and restrictions, and to the fines, penalties, and forfeitures, in all respects, to which the same are or shall be subject by law, as if this act had not been made.

Clearing out

Rule 5. Before any vessel shall be cleared out for Great Britain with any goods whatever, from any place in any colony, plantation, from foreign island, or territory in foreign parts, belonging to or under the dominion parts, § 3. of the crown of Great Britain, the master of every such vessel shall deliver the manifest in writing hereinbefore required to the collector of customs (if there be such an officer at or near to such place); and if there shall not be a collector of customs there, then to the chief officer of customs; and if there shall not be any officer of customs

of Great Britain, without being accompanied by the manifest directed by the said act.

And since the passing of the act 54 Geo. 3. c. 36. [TITLE 90.] wines have also been imported from the East Indies, and the Cape of Good Hope, without being manifested, as required by the last-mentioned act.

And whereas it is expedient, after the expiration of a certain time, to enforce the laws with respect to wine so irregularly imported.

This is therefore to give notice, that if any wine shall be imported into this kingdom, from any port or place not belonging to, or under the dominion of the crown of Great Britain, after the expiration of three months from the date hereof, not having the manifest required by the said act of 26 Geo. 3. c. 40. such wine will not be admitted to entry,

And if any wine be imported from the East Indies, or from the Cape of Good Hope, after the expiration of six months from the date hereof, not being manifested as required by the said act of 54 Geo. 3. c. 36. such wine will be seized and prosecuted according to the directions of the said last-mentioned act.
