Apprentices.

Rule 1. SHIPS not to be compelled to come into port, nor to abide there 28 Edw. 8. against the will of the masters, mariners, or merchants. [See this more fully c. 13. under TITLE 10.]

Rule 3. No vessel or boat appointed and employed ordinarily for the car-13 & 14 riage of letters and packets, shall (unless it be in such cases as shall be allowed Cha. 2. c. 11. by the proper officers of customs) import or export any goods into or out of 22. Packetthe parts beyond the seas, upon the penalty of the forfeiture of 100l. to be paid by the master of the said vessel or boat, with the loss of his place, and all goods that shall be found on board any such vessel or boat shall be forfeited. Rule 4. The rule for admeasuring vessels shall be as follows, viz. "The length shall be taken on a straight line along the rabbit of the keel of the C. 74.91. “ship, from the back of the main stern-post to a perpendicular line from the fore "part of the main stem, under the bowsprit, from which, subtracting three fifths vessels. Rule 5. Nothing herein contained shall alter the method of admeasuring § 3. coal vessels, pursuant to 6 and 7 Will. 3. (a) nor of busses or vessels employed in the white herring fishery.

Rule 6. In cases where it may be necessary to ascertain the tonnage of any 26 Geo. 3. vessel when afloat, (b) the following method shall be observed, viz.

"Drop a plumb-line over the stern of the ship, and measure the distance be"tween such line and the after part of the stern-post at the load water-mark; "then measure from the top of the said plumb-line, in a parallel direction with "the water, to a perpendicular point immediately over the load water-mark, at "the fore part of the main stem, subtracting from such measurement the above "distance, the remainder will be the ship's extreme length, from which is to be "deducted three inches for every foot of the load draught of water, for the rake "abaft, and also three fifths of the ship's breadth for the rake forward, the re"mainder shall be esteemed the just length of the keel to find the tonnage; and "the breadth shall be taken from outside to outside of the plank in the broadest "part of the ship, either above or below the main wales, exclusive of all manner "of sheathing or doubling that may be wrought upon the side of the ship; then "multiplying the length of the keel for tonnage by the breadth so taken, and that "product by half the breadth, and dividing by 94, the quotient shall be the ton"nage.”

Provided always, that it shall not be lawful to stow or place any goods (fuel engine-room. for the voyage excepted,) in the said engine-room; and if any goods be so stowed or placed, such vessel shall from thenceforth be deemed to be a vessel which has not been admeasured according to the rules of this act, and liable to all the consequences thereof.

If any vessel coming or arriving from foreign parts, within the limits of the port of London, be removed out of the stream (a) except to the lawful quays, before all the goods are discharged out of such vessel; or if any vessel, outward bound from the said port of London to any foreign parts, having port of Lon- any goods on board thereon, shall, during her continuance in the said port be so removed out of the stream, except to the lawful quays, unless upon any accident or emergent occasion, immediately to be made known to the commissioners or principal officers of customs, and their consent for those respective purposes obtained; the master of every such vessel shall forfeit 1007. for each such offence.

Rule 11. Nothing in this act shall extend to any vessel on a voyage from any part of America, or the East or West Indies, or Africa, or the Mediterranean, so as to subject the same to forfeiture, on account of her built, or for having spirits, tea, (e) or coffee on board, or for having on board arms, or amGovernment munition; nor to any vessel in the service of His Majesty's navy, victualling, ordnance, customs, excise, or post office, on account of her built, or for having on board arms or ammunition; nor to any vessel whatsoever, the owner of which shall have a licence as hereinafter described and directed for navigating the same, from the lords commissioners of the admiralty, (f) on account of her built, or for having on board such arms or ammunition as she shall be licensed to have, as hereinafter mentioned; nor to any lighters or barges, used solely in rivers or inland navigations; nor to any vessels which shall have on board Vessels with any arms or ammunition which have been regularly entered and cleared at any custom house in any of His Majesty's dominions, as merchandize, or for the use of His Majesty's stores or garrisons, and are regularly stowed in the hold of such vessels, or are put on board for the necessary use and defence of such vessels, by licence as aforesaid on account of such arms and ammunition.

(a) By 51 Geo. 3. c. 24. the above act is repealed, so far as it relates to any vessel entered inward or outward in the port of London, from or to any port in Ireland.

(b) As to length of bowsprits, see Rule 15 of this TITLE; and as to vessels of 200 tons, see Rule 63 of this title.

(c) See Rule 26 of this title. For ADJUDGED CASES, see at the end of this title. (d) By 34 Geo. 3. c. 50. § 6. so much of the above proviso as extends to permit any cutter, lugger, shallop, wherry, smack, yawl, or boat, to have arms on board, is repealed.

§ 9.

Rule 12. Every licence shall specify the tonnage of such vessel, Particulars of and describe whether she is a cutter, lugger, shallop, or wherry, or licence, § 10. what sort of built she is, and who is or are the owner or owners thereof, and for what port, harbour, or creek she is about to sail, and what quantity and number, and what sort of arms and ammunition she is licensed to take and have on board. The owners of such vessel shall owner's bond also give sufficient security, by bond, to His Majesty, in double the that vessel value of such vessel, to the satisfaction of such collector, controller, illegally en or other proper officer of customs; with condition that the said vessel ployed. shall not be employed in the importation or landing of any tea or foreign spirituous liquors, or any prohibited or other goods, contrary to this or any other act, or in the exportation of any goods which are or may be prohibited to be exported from this kingdom, or in the relanding of any goods whatsoever, contrary to law, which are entered outwards for exportation, for any drawback or bounty, or which are or may be prohibited to be used or worn in Great Britain, on failure whereof such licence shall be void and of no force or effect; and such vessel shall be liable to seizure and prosecution, in the same manner as if no such licence had been granted. (a)

Rule 14. Wherever the words British-built ship, or British-built 27 Geo. 3. ships, are inserted in the Tables annexed, (b) the same shall be under- c. 13. § 7. What ships stood to mean a British-built ship, or British-built ships, or a prize ship meant by Britaken at sea, by letters of marque or reprisal, legally condemned in a tish-built. court of admiralty, owned, navigated, and registered according to law, and none other.

§ Vessels with

Rule 15. In case any cutter, lugger, shallop, wherry, sloop, smack, 27 Geo. 3. or yawl, belonging, in the whole or in part, to any of His Majesty's c. 32. 1. subjects, shall be found within the limits of any of the ports of this bowsprits of a kingdom, or within four leagues (c) of the coasts thereof, having a bow- certain sprit which shall exceed in length more than two thirds of the length length, of such cutter, &c. from the forepart of her stem to the aft side of the stern-post aloft (whether the same shall be a standing or a running bowsprit), every such cutter, &c. with her tackle and apparel, shall be forfeited, and shall and may be seized by any officer of customs or excise. Rule 17. The owner or owners of any boat not belonging to any of boats not vessel are hereby required to paint, or cause or procure to be painted upon the stern of every such boat, in white or yellow Roman letters, of two inches in length, on a black ground, the name or names of the owner or owners of such boat, and the place to which such boat belongs, under pain of forfeiting every such boat which shall be found within the limits of any of the ports of this kingdom, or within four leagues (b) of the coasts thereof, without having the name or names of the owner or owners of such boat or boats so painted, and such boat shall and may be seized by any officer of customs or excise. (a)

Nothing in this act shall extend to forfeit any cutter, vessels, 4. lugger, shallop, wherry, sloop, smack, or yawl, nor any vessel or boat whatever in the service of His Majesty's navy, victualling, ordnance, customs, excise, or post office, nor any cutter, &c. nor any vessel whatever, the owner or owners of which shall have a licence for navigating the same from the lords commissioners of the admiralty, (c) agreeably to the regulations of the preceding act, with respect to certain vessels and boats therein-mentioned, nor any lighters or barges used solely in rivers or inland navigations.

Rule 19. Nothing in this act shall extend to forfeit any such cutter, out of limits, lugger, shallop, wherry, sloop, smack, or yawl, or any such vessel or boat, which shall be found in any place other than that to and from, or within the limits of which she shall be so confined or limited to navigate or trade, in case it shall be made appear, to the satisfaction of the commissioners of customs, that such cutter, &c. or such vessel

(d) By 38 Geo. 3. c. 33. § 12. in case any cutter, lugger, shallop, wherry, sloop, smack, or yawl, or any vessel or boat, for which there shall have been obtained from the lords commissioners of the admiralty a licence, limiting or confining the navigation of such cutter, &c, or any vessel or boat to any particular trade or employment, and such cutter, &c. or any vessel or boat, shall be engaged for or used in any other trade or employment whatever within the date of the licence, such cutter, lugger, shallop, wherry, sloop, smack, or yawl, or any vessel or boat, shall and may be seized and prosecuted in the same manner as she might or would have been in case of no licence having been procured for her.

Rule 21. Rule 22. Every cutter, lugger, shallop, wherry, smack, or yawl, 34 Geo. 3. belonging in the whole or in part to any of His Majesty's subjects, of c. 50. § 7. which the bottom is clinch work, (c) unless such cutter, &c. shall be clinch work square-rigged, or fitted with a standing bowsprit, the heel of which bottoms, &c. shall be fixed to the main deck by an iron clasp, such clasp to be without bitts, securely bolted through the bowsprit and beam of the said deck, and the said bowsprit to be steaved or elevated at least two inches in every foot from the straight line of the range of the deck, and rigged with a fixed stay for the jibb to work upon, which stay shall be not less than a two-inch rope for a vessel of twenty tons, and shall increase in size not less than half an inch for every other ten tons, and the said bowsprit to be without any traveller, or other materials, to conduct the jibb out and in upon the said bowsprit, and without any flying jibb set thereon, in any manner whatever, which shall be found or discovered to have been within the limits of any of the ports of this kingdom, or within the distance of four leagues (a) from the coast thereof, shall be forfeited, together with all the goods laden thereon, and tackle, &c. (d)

§ 11.

Rule 23. If any cutter, lugger, shallop, wherry, smack, yawl, or vessels with boat, belonging in the whole or in part to any of His Majesty's sub- arms or amjects, shall be found or discovered to have been within the limits of munition, any of the ports of this kingdom, or within the distance of four leagues (a) from the coast thereof, having on board any arms and ammunition whatever, except by licence from the lords commissioners of the admiralty, (e) as hereinafter mentioned, every such cutter, &c. shall be forfeited, together with all the goods, (if any) which shall be laden thereon, and her tackle, &c. and the same shall and may be seized by any officer of customs or excise: (b) provided always, that Exceptions.

(b). As to officers of army, navy, &c. see TITLE 5, Rules 76, 83, 99, and 100. (c) By 35 Geo. 3. c. 31. 1. the provisions of the above act are to extend to every cutter, lugger, shallop, wherry, smack, or yawl, belonging to His Majesty's subjects as aforesaid of any built whatsoever.
