of the vessel, the affidavit of the shipper, the licence granted for the exportation of the articles, together with the clearance: but in case shipped with any of the articles enumerated in Schedule A. shall be found on board, or carried by any such vessel to the said island of Malta or the dependencies thereof, other than such as are mentioned in the said licence, then the liberty granted by such licence shall cease and become void and of none effect; and such vessel, and also the master of such vessel, and all others concerned, shall be subject to all the same penalties and forfeitures as they would have been subject to in case this act had not been made.

Rule 14. It shall be lawful for such vessel, or any other vessel being British-built, owned, navigated, and registered according to law, to load at the said island of Malta, or any of the dependencies thereof, any of the articles enumerated in the Schedule B. hereunto annexed, for exportation direct to any of His Majesty's sugar plantations in America, and any such article may be landed in any such plantation, being first duly entered with the proper officers of customs there; any thing contained in any act in force in the United Kingdom, or in Great Britain or Ireland respectively, to the contrary notwithstanding; provided always, that the said goods (wine excepted) shall, upon importation into any of the said plantations, be subject to the payment of such duties as goods of the like denomination or description are or may be subject to, upon being imported into the said plantations from Great Britain, and no other or higher duties.

Rule 15. Any sort of wine which by virtue of this act shall be imported into any of His Majesty's sugar plantations in America, from the island of Malta or the dependencies thereof, shall be subject to the payment of the like duties, and no other, as are payable on Madeira wine when imported into any of the said plantations directly from the island of Madeira.

Rule 16. Upon such licence being returned to the collector and controller of customs of the port where the articles enumerated in Schedule A. were shipped, and an account of the lading being indorsed thereon or annexed thereto, and also upon such certificate of the governor or deputy governor or principal officer of customs, being produced as aforesaid, and the several other things required by this act being duly complied with, within two years from the date of such licence, the bond given before granting such licence shall be discharged and delivered up: otherwise such bond shall be forfeited, and shall and may be prosecuted in the manner directed by this act.

Rule 17. It shall be lawful to export from Newfoundland, the island of Bermuda, or any of His Majesty's plantations in North America, any articles of the growth, production, or manufacture of such plantation, or any articles which have been legally imported into such plantation direct to the island of Malta, or the dependencies thereof, in such vessels, and under such regulations, penalties, and forfeitures, as are hereinbefore mentioned, as to exportation from His Majesty's sugar plantations in America.

Rule 18. It shall be lawful to import from the island of Malta, or any of the dependencies thereof, direct into Newfoundland, the island of Bermuda, or any of His Majesty's plantations in North America, any of the articles enumerated in Schedule B. annexed, in such vessels,

and under such regulations as are hereinbefore mentioned as to the 55 Geo. 3. importation of the said articles into any of His Majesty's sugar plan- c. 29. tations in America.

Rule 19. It shall be lawful for any person to import from the United Kingisland of Malta or the dependencies thereof, into the United King- dom, § 10. dom, any goods, not prohibited to be imported, being of the growth, produce, and manufacture of any country or place within the Streights or Levant Seas, in British-built vessels, owned, navigated, and registered according to law, and in no other vessel whatever, on payment of such duties as now are or hereafter may be due and payable on such goods when imported into Great Britain or Ireland: provided always, that all such goods, being of the growth, produce, or manufacture of any place within the dominions of the Grand Seignior, within the Levant Seas, so imported under the authority of this act, Duties to shall be subject to the payment of the same duties to the Turkey Com- Turkey company as shall be payable on the like articles when imported direct pany. from Turkey by persons being members of the said company.

Rule 20. It shall be lawful for any person admitted into and made Raw silk or free of the said company, to import into the United Kingdom from mohair yarn, the said island of Malta, or the dependencies thereof, in British-built § 11. vessels, owned, navigated, and registered, according to law, any raw silk or mohair yarn, being the growth or production of any place within the dominions of the Grand Seignior, within the Levant Seas: provided always, that all such raw silk and mohair yarn so imported into the United Kingdom under the authority of this act, shall be subject to the duties due and payable to the said Turkey Company, Duties. in like manner as if such raw silk or mohair yarn had been imported into the United Kingdom directly from Turkey.

Rule 21. It shall be lawful for any person to import from the Thrown silk, island of Malta, or the dependencies thereof, into the United Kingdom § 12. directly, any thrown silk being of the production of Italy, Sicily, or of the kingdom of Naples, in British-built vessels, owned, navigated, and registered according to law, and in no other vessel whatever, on payment of the like duties as now are, or hereafter may be, payable in Great Britain or Ireland on such thrown silk when imported directly by sea from the place of its production.

Rule 22. If any person shall grant a false certificate, or counter- Counterfeit feit, erase, or alter any licence, oath, or certificate, which shall be ing, &c. made or given pursuant to this act, or shall knowingly or wittingly $15. publish, or make use thereof, such person shall forfeit 500l.; and such licence, &c. shall be of none effect.

Rule 23. It shall be lawful for the East India Company, and also for any other of His Majesty's subjects, to carry on trade and traffic, East Indies, in ships navigated according to law, directly and circuitously between the island of Malta and its dependencies, or the port of Gibraltar, and all places within the limits of the said company's charter, except the dominions of the Emperor of China; any thing contained in any charter of the said company, or in any act of parliament, to the contrary notwithstanding: provided, that in carrying on such trade it shall not be lawful to trade to or at any place without the limits of the said company's charter, other than those with which trade is permitted by 54 Geo. 3. c. 34. (a) provided always, that nothing herein contained shall extend to authorize any of His Majesty's subjects, other than the said company, or persons properly licensed by them, to export or import from or to any such countries and places, within or without such limits, or to import into the United Kingdom, any tea, or in any manner to trade or traffic in tea, between any such places as aforesaid.

Rule 24. Provided, that His Majesty's settlement at the Cape of Good Hope shall, as to all trade allowed by this act to be carried on, be deemed to be within the limits of the East India Company's charter: provided also, that nothing herein contained, as to the said settlement being deemed as to such trade as aforesaid to be within such limits, shall extend to prevent, or in any manner to limit or affect, any other trade which now may or which may hereafter be allowed to be carried on between the said settlement and any other countries or places whatever.

entry at any port in the United Kingdom, the registered measurement 57 Geo. 3. of which vessel shall be under the burden prescribed by 58 Geo, 3, c. 36. c. 155. (a) or which may be prescribed by any act hereafter to be passed for vessels carrying on trade between the United Kingdom and the places within the limits of the East India Company's charter. Rule 26. "And whereas by the said act of 53 Geo. 3. c. 155. (b) Licences, § 4. "it is enacted, that no vessel engaged in private trade under "the authority of that act, shall proceed to any place situate on "the continent of Asia, from the river Indus to the town of Ma"lacca inclusive, or in any island under the government of the "said company lying to the north of the equator, or to the said com"pany's factory of Bencoolen or its dependencies, or to any other place situate more to the northward than 11 degrees of south lati❝tude, and between the 64th and 150th degrees of east longitude "from London, without a licence from the court of directors of the "said company, or from the board of commissioners for the affairs "of India (as the case may be);" it is further enacted, that the governors and lieutenant governors of the said island of Malta and port of Gibraltar respectively, are hereby authorized to grant licences to vessels so proceeding from the said island of Malta or port of Gibraltar, in the same manner and under the same regulations, in regard to the grant and form thereof, as are under the said recited act applicable to licences granted by the said court of directors and board of commissioners respectively: provided that the said governors and lieutenant governors shall not be empowered to grant any licence specially authorizing any vessel to proceed to any place upon the continent of Asia from the river Indus to the said town of Malacca inclusive, except the said company's principal settlements; and that in regard for such licences as are under the provisions of the said recited act to be granted by the said board of commissioners, the said governors and lieutenant governors shall conform themselves, as far as the case may admit, to such regulations in that behalf as may from time to time be framed and published by the said commissioners.

Each such governor or lieutenant governor shall transmit Lists of to one of His Majesty's principal secretaries of state annual lists of licences, § 5. all such licences as shall have been granted by him as aforesaid, and of all licences (if any) which such governor or lieutenant governor may, in consequence of any instructions which he may have received in regard to such licences, have refused to grant, together with his reasons for such refusal.

Rule 28. names, capacities, and descriptions of all persons embarked or intended to be embarked on board such vessel, and all arms on board or intended to be put on board the same; nor shall any such vessel be admitted to entry at the said island or port, until the master of such vessel shall in the like manner have made out and exhibited to the principal officer of customs, or other person thereunto duly authorized, upon oath, a true and perfect list, in form to be settled as aforesaid, specifying the names, capacities, and descriptions of all persons on board, or who shall have been on board such vessel, from the time of the sailing thereof to the time of arrival, and of all arms on board or which shall during that time have been on board such vessel, and the several times and places at which such of the said persons as may have died or left the said vessel, shall have so died or left such vessel, or such of the said arms as may have been disposed of, have been so disposed of.

Rule 29. Such governors or lieutenant governors shall cause every of lists, § 7. such list, which shall be so received at the said island or port, to be transmitted with all reasonable dispatch to the court of directors of Former acts. the said company; and all such vessels trading under the authority of this act shall, on their arrival at any place under the government of the said company in India, be subject to all the regulations precribed by the said acts (a) of 53 Geo. 3.; and all trade with all places upon the continent of Asia, from the river Indus to the town of Malacca inclusive, or any island under the government of the said company lying to the north of the equator, or the said company's factory at Bencoolen and its dependencies, shall remain subject to all such regulations, as shall from time to time be in force in relation to trade, at any such places under the authority of any of the governments of the said company at their several presidencies in India.

§ 8.

Rule 30. It shall be lawful for the said company, and for any other of His Majesty's subjects, to trade (in ships navigated according to law, and proceeding upon any voyage between any places within the limits of the said company's charter and the United Kingdom) to and at the said island of Malta and port of Gibraltar, and for that purpose to discharge the whole or any part of the cargo of any Other places, such vessel at such island or port, and in the prosecution of such circuitous voyage to take on board any other goods, which can be legally carried from such places within the limits aforesaid, to such island or port; and in like manner to trade in any such vessel, in any voyage from the United Kingdom to any places within the limits aforesaid, to and at the said island of Malta and port of Gibraltar: that all such vessels shall be subject to all the regulations to which vessels carrying on trade circuitously, between the United Kingdom and the limits of the said company's charter, are by the said acts of 53 and 54 Geo. 3. made liable.

Rule 31. All goods so imported into the island of Malta or its deexported to pendencies, or into the port of Gibraltar, from any places within the limits of the said company's charter, may be re-exported from the said island of Malta or its dependencies, or the port of Gibraltar, to the United Kingdom, and imported at any of the ports where such goods may lawfully be imported, in like manner, and subject to all such regulations, as if such goods were imported directly from the
