CHAPTER 135.

An Act to amend an Act Respecting the Dominion
Atlantic Railway Company.

(Passed the 22nd day of April, A. D., 1910.)

SECTION 1. Chapter 134, Acts of 1910, amended.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. An Act of this present session entitled "An Act respecting the Dominion Atlantic Railway Company,'' is amended by striking out from section one of said Act all the words after the word "interest'' in said section, and substituting therefor the words "of such second debenture stock of the Dominion Atlantic Railway Company, not exceeding in the aggregate one hundred and ninety thousand pounds as is now unissued or shall hereafter be reissued,'' and also by striking out the word "unissued'' from section two of said Act.

CHAPTER 136.

An Act Respecting the North Mountain Division of the Dominion Atlantic Railway.

(Passed the 30th day of March, A. D., 1910.)

WHEREAS, at a Special Session of the Council of the Municipality of Kings County, held the sixteenth day of February, A. D. 1910, a resolution was passed by the said Council requesting that an Act be procured from the Legislature of Nova Scotia with provisions as herein contained;

Be it therefore enacted by the Governor, Council, and Assembly, as follows:

1. The moneys payable for lands for track and Aportionment. station purposes and terminals for the railway to be Wards of built in the Municipality of Kings County, under of Kings Chapter 101 of the Statutes of Canada for the year 1908, shall form a charge on the said Municipality and be assessed thereon and collected as in case of ordinary assessments, but on the different parts of the said Municipality in the respective amounts following, that is to say:-One-half the total amount of the said damages shall be assessed on Wards three, four, five and fourteen on the following basis, namely:

On Ward 3, 15 cents on the hundred dollars of the assessment of the Ward.

On Ward 4, 45 cents on the hundred dollars of the assessment of the Ward.

On Ward 5, 25 cents on the hundred dollars of the assessment of the Ward.

On Ward 14, 15 cents on the hundred dollars of the assessment of the Ward,

and so, that if there is a deficiency in the amount realized by applying this percentage once, there shall be an increase or further assessment on the Wards on the same basis so as in the event to make the amount paid by the said Wards one-half of the said total amount of such damages, and if there is an excess by applying such percentage once, then there shall be an abatement or refund to the said Wards respectively of such excess on the same basis as that on which the assessment was made; and the other half of the total amount of the said damages shall be assessed on the remaining Wards of the Municipality equally as in case of an ordinary assessment, with the exception of Ward 11, on which the rate of assessment shall only 'be one-half the rate on the hundred dollars as shall be assessed on the others of the said remaining Wards.

3. The Dominion Atlantic Railway Company, in the construction of the said railway, under Chapter 101 of the Statutes of Canada for the year 1908, shall have the right at any time without any procedure or proceedings whatever, except the filing of plans as required by The Nova Scotia Railways Act, to take the necessary lands and construct the said railway, and shall have all the powers in reference to the location and construction of the said railway applicable to any Company under The Nova Scotia Railways Act.

Arbitration. 4. The damages for the lands so taken shall be appraised and fixed by three arbitrators, one to be chosen by the proprietors of the lands taken for the railway in manner and as provided by section 164 of The Nova Scotia Railways Act, one by the Municipal Council of the said Municipality, and a third by the two arbitrators so chosen, and in the event of their disagreement, by the judge of the County Court for District No. 4, and the award or awards in writing by any two of the arbitrators shall be final and conclusive as to the amount of damages payable to the persons respectively whose lands shall have been taken for the said railway.

5. The said sums when assessed and collected shall be paid to the Treasurer of the Municipality, and shall be paid out by him to the persons whose lands have been taken for such railway, according to the amounts appraised to them respectively, on orders signed by the Warden and Clerk of the Municipality.

6. The road to be built by the said Company, to which this resolution applies, shall be constructed ready for the operation of trains in two years from the first day of June, A. D. 1910.

7. All Acts or parts of Acts inconsistent with the provisions of this Act are hereby repealed.

CHAPTER 137.

An Act to Amend Chapter 139 of the Acts of the
Legislature of Nova Scotia, 1899, entitled, "An
Act to Incorporate the Dominion Iron and

Steel Company, Limited.''

(Passed the 22nd day of April, A. D., 1910.)

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Sub-section (f) of section 2 of Chapter 139 of Repeal and the Acts of the Legislature of the Province of Nova Scotia, 1899, is struck out and the following is substituted:

(f) To construct, purchase, operate and main- Powers

the use of the company only; to manufacture
and sell gas of every kind and description, and to
generate electricity for the use of the Company,
and to sell the same to the Dominion Coal Com-
pany, Limited, and to any Company now having
a franchise from the Legislature of Nova Scotia
for the sale of electricity.

2. Section 1 of Chapter 151 of the Acts of 1907, Chapter 151. is hereby amended by substituting (1) for (b) in the amended. third line thereof.

CHAPTER 138.

An Act to Amend Chapter 181, Acts of 1901, entitled, "An Act to Incorporate the Presbyterian Congregation of Earltown and the Falls, in Connection with the Church of Scotland.''

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 4 of said Act is amended by striking Acts of 1901, out the words "two thirds'' in the second line of said section and substituting the word "majority" therefor.

Meeting, how called.

2. Section 5 of said Act is repealed, and the following substituted therefor:

(5) Members of said congregation in good standing, and male adherents of said congregation above the age of twenty-one years, resident within the bounds of said congregation, and no other, shall be eligible to be elected as trustees, or to vote at any meeting for the purpose of electing trustees, or for the transaction of any business in connection with the congregation.

3. Whereas, none of the trustees named in the first section of said Act now hold office, and no successors have been appointed, and the said congregation has no settled minister and no regular services, the first meeting of the congregation to be held after the passing of this Act shall be held as soon as convenient thereafter, and such meeting shall be called by a committee, consisting of Donald Sutherland, one of the elders of said congregation, and any two members of said congregation, or a majority of such committee, by notices posted up in at least two of the most public places in said congregation for at least two weeks previous to such meeting, and by the pub
