tion of the Commission may be transferred without change of grade to a similar position in another group, or to a position in the same or a lower grade involving essential tests or qualifications lower than those required for original entrance to the position held by such person.

2. A person holding a position in the competitive class who did not enter the service by qualifying in an open competitive examination may be transferred in accordance with section 1 of this rule, provided he has served continuously for at least three years in a position in the same group and three months in the same grade as that from which transfer is proposed.

AMENDMENTS TO STATE CIVIL SERVICE

CLASSIFICATION

District Attorney, Onondaga County

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the District Attorney of Onondaga county be and hereby is amended by adding thereto the words "third assistant district attorney," for the reason that competitive or noncompetitive examination has heretofore been found to be impracticable for filling the position of assistant district attorney.

Board of Supervisors, Westchester County

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class of the Civil Service of the county of Westchester be and hereby is amended by adding thereto the following:

"In the Office of the Board of Supervisors:

The county attorney,"

for the reason that competitive or noncompetitive examination has heretofore been found to be impracticable for filling the position of county attorney.

Noncompetitive Class

Resolved, That, subject to the approval of the Governor, the classification of positions in the noncompetitive class in the Craig Colony at Sonyea be and hereby is amended by adding thereto the words "assistant baker," for the reason that competitive examination is hereby found to be impracticable for filling said position.

Resolved, That, subject to the approval of the Governor, the classification of positions in the noncompetitive class in the Woman's Relief Corps Home at Oxford be and hereby is amended by adding thereto the words "head laundress," for the reason that competitive examination is hereby found to be impracticable for filling said position.

Resolved, That, subject to the approval of the Governor, the classification of positions in the noncompetitive class in the House of Refuge for Women at Albion be and hereby is amended by adding thereto the word "farmer," for the reason that competitive examination is hereby found to be impracticable for filling said position.

District Attorney, Erie County

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the District Attorney of Erie county be and hereby is amended by striking out the words, "Three assistant district attorneys, first deputy assistant district attorney, second deputy assistant district attorney, three stenographers," and inserting in lieu thereof the words, "Six assistant district attorneys, two stenographers," for the purpose of changing titles of positions in accordance with action of the board of supervisors without increasing the number of positions in the exempt class.

Department of Excise

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the Department of Excise be and hereby is amended by striking out the words, "The deputy and six special deputy commissioners," and inserting in lieu thereof the words, "The deputy and thirteen special deputy commissioners," for the reason that competitive or non competitive examination has heretofore been found to be im

practicable for filling the position of special deputy commissioner of excise.

State Custodial Asylum, Rome

Resolved, That, subject to the approval of the Governor, the classification of positions in the noncompetitive class in the Custodial Asylum at Rome be and hereby is amended by adding thereto the word "shoemaker," for the reason that competitive examination is hereby found to be impracticable for filling said position.

Department of Highways

Resolved, That, subject to the approval of the Governor, and in accordance with the provisions of section 12 of the Civil Service Law, the classification of positions in the exempt class be amended by adding thereto the following:

Treasurer, Onondaga County

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Treasurer, Onondaga county, be amended by adding thereto the words, "the cashier," for the reason that competitive or noncompetitive examination is hereby found to be impracticable for filling said position.

Insurance Department

State Engineer and Surveyor

Resolved, That subject to the approval of the Governor, the classification of positions in the exempt class in the office of the State Engineer and Surveyor be and hereby is amended by striking out "one special examiner," the position having been abolished by reason of the transfer of the highway bureau of the Department of the State Engineer and Surveyor to the State Commission of Highways.

Insurance Department

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the Insurance Department be and hereby is amended by adding thereto the words, "the counsel," for the reason that competitive or noncompetitive examination is hereby found to be impracticable for filling said position.

Public Service Commission, First District

Resolved, That, subject to the approval of the Governor, the classification of positions in the exempt class in the office of the Public Service Commission for the First District be and hereby is amended by striking out the following: "one mechanical engineer," for the reason that the department being fully organized, competitive examination is now practicable for filling said position.
