ing the matter the railway company had decided to put in a crossing as requested and that instructions had been issued to have the work done as arly as practicable. The matter having been satisfactorily adjusted the case was formally closed.

COMPLAINT NO. 231.

In the matter of the complaint of Messrs. Shoemaker and Parsons of excessive charge for freight on wood from Pipestone, Minn., to White, South Dakota.

On May 11, 1903, a communication was received from Shoemaker & Parsons, of Brook Park, Minn., in which complaint was made of excessive charge by the C., R. I. and P. Railway Company for freight on wood from Pipestone, Minn., to "hite, South Dakota, and requesting the Commission to assist them in securing a rebate on said shipments.

In reply the complainants were informed that as the matter referred to pertained to interstate traffic the South Dakota Board of Railroad Commissioners had no jurisdiction in the case but that it might be a proper matter for investigation by the Interstate Commerce Commission, and the case was dismissed.

COMPLAINT NO. 232.

In the matter of the petition of the Canton Grain Company for an elevator site on the side track on the C., M. & St. P. Ry. Co. at Trent.

On June 18, 1903, application was made through this office by the Canton Grain Company for an elevator site on the side track of the Chicago, Milwaukee and St. Paul Railway Company at Trent, the complainants alleging that application had been made to the railway company and that such application had been refused. The matter was taken up personally by the Commission with the railway management in Chicago but owing to the delay in the negotiations and the lateness of the season the application of the grain company was withdrawn and the case dismissed.

COMPLAINT No. 233.

In the matter of the petition of Peter Johnson for a public highway crossing at Naples. (See Complaint No. 22.)

COMPLAINT NO. 234.

In the matter of the petition of John Vogel for elevator site and side track facilities at Delmont, on the line of the C., M. & St. P. Ry.

On June 18th, 1903, a communication was received from John Vogel, of Delmont, South Dakota, stating that he had made application to the Chicago, Milwaukee & St. Paul Railway company for a warehouse site at Delmont, and that the railway company had refused to lease him a site, claiming that there was already four elevators at that station and there was no demand for another. Complainant stated that he was the owner of a tract of land adjacent to the railway company's right of way and asked if the railway company could be compelled to furnish side track privileges, under the e circumstances, to a private elevator built on this tract of land adjoining the right of way.

The complainant was advised of the method of procedure in such cases and after some further correspondence on the subject the matter was considered by the Commission at a regular meeting of the Board held on June 26th and the case was referred to Commissioner LeCocq with instructions to investigate and report at the August meeting of the Board. The case, therefore, was pending at the time of the closing of this report.
