First, second and third class postmasters are appointed by the President, subject to confirmation by the Senate, and are commissioned for four years. But if the revenues of third class offices relegate them to fourth class, the term of the incumbent appointed by the President ceases, and an appointment by the Postmaster General will be made. Postmasters at fourth class offices are appointed by the Postmaster General, and their term of tenure has no specified limit, and under the law their compensation consists of: 1. All the box rents, if there are any. 2. Commissions on the amount of postage-due stamps, ordinary postage stamps, stamped envelopes, postal cards, and newspaper and periodical stamps canceled on matter actually mailed at their offices, and on amounts received from sales of waste paper, dead newspapers, printed matter, and twine sold at the following rates: On the first $50 or less, 100 per cent. ; on the next $100 or less, 60 per cent.; on the next $200 or less, 50 per cent. ; on the excess above $350, 40 per cent. In no case is the compensation of a postmaster of this class to exceed $250 in any one quarter. QUALIFICATIONS, ETC. A member of a State Legislature cannot hold the office of postmaster. The wife of a contractor is ineligible to the position of postmaster, but there is no objection to the appointment of the wife of a route agent. An alien may be appointed postmaster, provided he has declared in proper form his intention to become a citizen of the United States and can take the oath as prescribed in section 24 P. L. & R. This ruling shall also apply to assistants or clerks. A postmaster must reside within the delivery of the post-office to which he is appointed. Under the Act of March 3, 1883, the salaries of postmasters at offices of the first, second and third classes are adjusted and fixed to take effect at the beginning of each fiscal year, upon the gross receipts as shown by the returns for the four quarters immediately preceding such adjustment. There is no assessment upon postmasters for political purposes known to or recognized by the Post-Office Department. The salary of a postmaster is fixed by law, and when he has earned and received it no one but himself can direct the disposition thereof. He is at liberty to devote as much of it as he pleases to political purposes, and he may refuse to pay anything therefor, without affecting his tenure of office, so long as he discharges faithfully the duties imposed upon him by the Laws and Regulations.
