CHAPTER XXXIV.

An Act to amend an Act regulating the duties of the Reporter of the Supreme Court, approved February fourteenth, eighteen hundred and sixty.

SECTION 1. Reporter to take oath and give bond.

2. Duty of Reporter-name for Reports.

3. Reporter to have copyright-salary.

4. Distribution of Reports.

5. Repeal of inconsistent acts.

6. When act to take effect.

Be it enacted by the Legislature of the State of Minnesota :

SECTION 1. That "An act regulating the duties of the Reporter of the Supreme Court," approved February fourteenth, eighteen hundred and sixty, is hereby amended so as to read as follows:

Section 1. The Reporter of the Supreme Court shall take an oath or affirmation to support the constitution of the United States and of this State, and

faithfully discharge the duties of his office to the best of his ability and judgment. He shall also execute a bond to be approved by the Governor in the sum of five hundred dollars conditioned for the faithful performance of the duties of his office.

Duty of Reporter

SEC. 2. The reporter shall make careful and accurate reports of all cases argued and decided by the supreme court. He shall be entitled to the possession of the original files in all cases for a reasonable time, name for Reports. to prepare them for publication and shall report the same more or less at large according to their relative importance, so as not to unnecessarily increase the size of the volumes. The report of each case shall contain concise notes of the points decided, a statement of the facts taken from the record, when the same are not given in the opinion of the court, the names of the counsel with the points made and authorities cited (more or less at length in the discretion of the reporter) and the opinion of the court. He shall publish a volume of such reports annually: Provided, That no volume shall contain less than four hundred and fifty pages of printed matter. All volumes hereafter published shall bear the uniform title of Minnesota Reports."

SEC. 3. The reporter of each volume hereafter published, shall have and retain the exclusive copyright thereof as his own property, and the State shall purchase from him two hundred volumes of each edition bound in the ordinary style of law reports at the sum of six dollars per volume. He shall publish and bind said reports at his own expense, and shall receive an annual salary of six hundred dollars, payable quarterly as the salaries of other State officers, to commence from the first day of January, eighteen hundred and sixtyfive.

An Act for the improvement of navigation on the
Minnesota River.

SECTION 1. Amount of appropriation for the improvement of the Minnesota River.

2. Governor to appoint Commissioners-duty of Commissioners.

3. Commissioners may employ assistance.

4. Commissioners to keep a detailed and correct account of expenses.

5. To take and subscribe an oath for faithful performance of duties-compensation of Commissioners and assistants.

6. When act to take effect.

Be it enacted by the Legislature of the State of Minnesota:

SECTION 1. That there be and is hereby appropriated out of any money in the treasury not otherwise appropriated, the sum of three thousand dollars, or so much as may be necessary, under the direction of the Governor, in causing to be cut-off all snags and logs which may be found in the Minnesota River from the rapids in Carver county, to New Ulm in Brown county.

SEC. 2. The Governor is hereby authorized to appoint such commissioners as he may deem proper, for the carrying out of the provisions of this act, whose duty it shall be to proceed immediately after their ap

pointment, to discharge the duties provided for herein, at such points on the river as the Governor may desig

nate.

Amendment to section one.

2. To execute bond conditioned for faithful performance of duties-bond to be filed in the office of the Secretary of State.

3. When act to take effect.

Beit enacted by the Legislature of the State of Minnesota :

SECTION 1. Section one of an act entitled an act for the improvement of navigation on the Minnesota River is hereby amended by adding after the words "so much," on the third line, the word "thereof."

SEC. 2. The following section is hereby added to said act :

Section 7. Before entering upon the discharge of their duties under this act, or in case any commissioner has already entered upon said duties, then immediately upon request of the Governor said commissioner shall execute a bond, with sufficient sureties to be approved by the Governor, to the State of Minnesota, conditioned for the faithful performance of his duties as such commissioner, and that he shall faithfully pay out, disburse and account for all moneys which shall come into his hands as such commissioner, which bond shall be filed in the office of the Secretary of State, and all bonds heretofore executed for the performance of such duties are hereby ratified, legalized and made valid.

SEC. 3. This act shall take effect and be in force from and after its passage.
