MARKETS WITHIN THE CITY OF NEW YORK AND FOR PREVENTING THE FORESTALLING OF PROVISIONS COMING TO THE SAID MARKETS/.

[204] FORASMUCH as the Markets of this City are Cheifly Supplied by the Country people with Victual's and provisions By water Carriage from the neighbouring Counties and Colonies at Different Times and Seasons as the Tides, wind and weather permit By Reason whereof no particular Times or days Can Conveniently be appointed for Holding the said markets without manifest hurt and prejudice, as well to the Inhabitants of this City as [to] the Country people who Frequent and Supply the said Markets/

Every day in the week (Sunday Excepted) to be a Market day

I BE IT THEREFORE ORDAINE'D By the Mayor Aldermen and Commonalty of the City of New York, Convened in Common Council and it's hereby Ordaine'd By the Authority of the same that every day in the week (Sundays Excepted) be, and are hereby appointed publick Market days within the said City from Sun rising to Sun setting and that the Country people and others, resorting to the said market's may stand or sit in such part or parts thereof as are not from Time To Time particularly appropriated and Allotted to other person or persons and their vend their Flesh, fish, poultry, Herbs, Fruit Eggs, Butter Cheese. Bacon and other provisions and commodity's in the publick markets herein after mentioned. That is to say, at the markett House or the Slip Commonly called Coenties dock at the markett House at the Old Slip Commonly Called Burger's path at the markett House at or near Countess's Key Commonly Called the Countess's Slip and at the markett House in the Broadway Commonly called the Broad way Market all which are hereby Appointed to be the publick and Common Market's within the said City for the Selling of all Kinds of provisions meal, Corn and Grain of all kinds only Excepted and which are only to be sold at the Broad way Market, and the Old Slip Market Aforesaid,)

II And Be it Ordaine'd by the Authority aforesaid that (in regard the marketts are Intended for the Benefitt of House Keeper's who buy for their own use) the Hucksters and Retailer's within this City who Buy to Sell Again, shall not Enter into any of the Aforesaid Markets to make their provisions, and Buy to sell Again any Flesh Fish, Foul, Poultry Eggs Butter Cheese Bacon or any other Sort of

market Provision's or Goods of what Kind so ever, of any of the market people untill the Afternoon of every day, to the end the House Keeper's may provide Themselves in the Forenoon of every day at the first hand, with the aforesaid provisions or Goods at moderate Rates upon pain that every such Huckster and Retailer shall for every offence forfeit the sum of Ten shillings Current money of this Colony with Cost of suit

Authority Aforesaid that no AND BE IT FURTHER ORDAIN'D By the Huckster's, Retailer or Retailers, shall offer or Huckster or expose To sale any Provision's or other Kind of Goods in any of the said public market's of this City or in any of the streets thereof under the penalty of Ten Shillings Current money of New york for every offence, any Law usage or Custom to the contrary thereof Notwithstanding/

AND BE IT FURTHER ORDAINED By the Authority Aforesaid That to the Intent that forestalling of Victuals and other Commodities may be the Better prevented no person or person's from and After the publication Hereof Shall Buy Sell, or Cause to be Bought or Sold any victuals or other provisions or things whatsoever within the said City of New York or the Liberties thereof [204*] Coming To any of the Common Markets of the said City, or make any Contract promise or Bargain, for the selling having or Buying of the same or any part Thereof So Coming To any of the Common Markets Aforesaid Before the same shall be Brought into one of the said Markets, ready to be there sold (Fish of all kinds only Excepted) upon pain that as well every person Selling or Contradicting [contracting] as every person so Buying or Contradicting [contracting] either By themselves or their white Servant or Servants shall Respectively Forfiet for every offence the sum of Six Shillings Current money of this Colony and if any Negro or other Slave shall Be Guilty of Buying or Contracting for any Victuals or provisions so Coming To any of the Common Market's as Aforesaid such Negro or other Slave, shall receive Fifteen Lashes on the Bare Back at the Publick whipping post, or House of Correction unless the master or Mistress of such Slave do pay the sum of Six Shillings to Excuse the same

V AND BE IT FURther ordaine'd By the aforesaid that no unwholesome or Stale Victuals, no Blown meat, or Leprous Swine be sold or Exposed to sale in any of the said Market's or within any part of this City under

the penalty of Forty shilling's to be paid by every Offender, for every such offense

and be it also FURTHER ORDAINED, By the same Authority that all Butter Expose'd to Sale in any of the market's Aforesaid either in Pounds Rolls pot's dishes or other Vessel's not Exceeding six pounds Shall have the Quantity of the weight the same Contain's marke'd thereon, and if any Butter be Exposed to Sale in any of the market's Aforesaid not so marke'd or that shall be found deficient in the weight so marke'd Thereon or other Frauds discovere'd in the weight Thereof the same shall be Forfieted to the poor of this City and it shall and may be Lawfull for any person or persons whatsoever to Seize the same and (the offender Being First Convicted of the Fraud, Before one or more of the magistrate's of this City) To Convert it to the use Before mentioned.

VII AND BE IT FURTHER ORDAINE'D By the Authority Aforesaid that All and every of the Butchers and others resorting and Comeing to any of the publick markets Aforesaid Shall pay or Cause to be paid for their Stalls Standing's Places Boards Shelter, and other Things necessary for their Standing's, in any of the Market places within this City, and Cleansing and keeping Clean the same and Also For defraying the Incidental Charges of repairing and maintaining the same market's and rewarding the Care and Attendance of the Farmer of the said market's or such other person or persons as the Common Councill for the Time Being Shall for that purpose appoint the rates and Sums of money following, to witt/

FOR all Cattle Kille'd and Brought into any of the publick market's for Four quarters one Shilling and so in proportion for a Greater or Lesser Number or Quantity. For every Hog Shoat or pig Brought into and Cut up for Sale in any of the said market Houses three pence! And for every Calf, Sheep or Lamb, Two pence/

AND THE FARMER of the said Markets or such other person or persons as the Common Council for the Time Being shall Thereunto Appoint, is, and are hereby Authorized and Impowere'd to have Take

demand and receive, from the Butchers or Those that Buy or sell again resorting and Coming to any of the said Markets the rates and Sums of money Aforesaid, in the Quantity and proportion Aforesaid and if any Butcher or Butcher's or others as Aforesaid shall neglect deny refuse or delay to pay [205] The Severall Sums of money Aforesaid when Thereunto required as Aforesaid Such Butcher or Butcher's or otherwise neglecting, denying, refusing or delaying Shall forfiet and pay double the sum so by him her or Them, due and owing to the said Farmer of the market's

VIII AND BE IT FURTHER ORDAIN'D BY the same Authority that it shall and may be Law full To and For the Country people to Sell or expose to sale in all or any of the publick market's of this City Beef, Pork, Veal, mutton and Lamb by the Joint, or in pieces or Cut up the same in Great or Small Quantities or parcells as they shall Seem Convenient, first paying the fees or rate's Aforesaid to the Farmer of the market's or such other person or persons as by the Common Councill, for The Time Being, shall be Thereunto Appointed (who Alone and no other Person or Person's whatsoever has any right to Receive the said fees) in the same manner Quantity and proportion that the Butchers and other's as Aforesaid are to do

IX PROVIDED NEVERTHELESS AND BE IT FURTHER ORDAINED by the Authority Aforesaid that all Country People Resorting and Coming to any of the publick Market's of this City, Shall and may sell, or expose to sale, any Beef, Pork, Veal, mutton or Lamb by the Quarter without paying any Thing for the same if such Beef, Pork, Veal, mutton or Lamb, Be Really and Truly raised or produce'd on the Farm or Plantation of such Country people, and not Bought, To Sell Again as Aforesaid, any Thing herein Contained to the Contrary in any wise notwithstanding

X AND BE IT FURTHER ORDAINED BY the same Authority that all and Every the penalty's and forfieture's, Sum and Sums of money which Shall Happen at any time hereafter to Be Incurred and Forfiete'd By Vertue of this Law and Touching which no particular direction is Herein Before Given, Shall be recovere'd Before the mayor, Recorder or any one of the

Aldermen of this City, with Costs of Suit to be paid to such persons who shall sue and prosecute for the same.

UPON reading which it is approved of by this Board, and it is Resolved and ORDER'D by this Board that the Same ordinance do Forthwith pass and the Same is accordingly passed into a Law of this Corporation and that the Same be Forthwith published, and be also printed in all the public Newspapers of this City until the Time Limitted in the said ordinance for the Same to take Effect.
