Burthen or Tonnage Shall be Settled as Near as May be, by the Oath of the Person or Persons Suing and Prosecuting; any other Law, usage or Custom of the Mayor, aldermen and Commonalty To the Contrary thereof, in any wise notwithstanding,

Vessells not to Lie in the mouth of the Docks or Slips

IV AND BE IT FURTHER ORDAINED by the Authority aforesaid, that. no Sloops, Boats, Crafts, or other Vessels, Shall lie in the aforesaid Slips or mole, a longer Time then for Convenient lading and unlading; nor Shail lie in the aforesaid Slips, mole, or mouth of the Great dock, at any Time affloat, So as To Shut up the Same, or Prevent any other Sloops, Boats Crafts or Vessels, from Coming into, and going out of the Same, under the Penalty of Twenty Shillings for every Tide

none to make fast or hall down at the Bridge, or Careen at any of the Docks. or in the Slips, Nor to keep fire on board. in the Night.

V AND BE IT FURTHER ORDAINED by the authority aforesaid that no Sloop Boats or other Vessels Whatsoever, do or Shall make fast unto, or hall down by the Bridge in the Great Dock, nor lade or unlade any Ballast, flour or goods, Whatsoever, on the Same or Careen by the Same; nor Shall any Vessels Careen at, To or Within any of the docks Wharfs, Peers, Keys, Mole, or Slips, belonging To this Corporation, or make or keep any fire on board of any Vessel lying at. To or Within any of the Same or to any other Wharf Key peer or Mole within the bounds of this City, Except the Outward, at any other Time, then from daylight in the morning, Till Eight oClock at Night, under the Penalty of Twenty Shillings for every offence; To be paid by the Master owner or Posesser of such Vessel

VI AND BE IT FURTHER ORDAINED by the Authority aforesaid, that if any Person or Persons do Cast any anchor Graplin or Killick into or near any of the Docks Wharffs Peers Keys Mole or Slips of this City Such Person or persons so offending Shall forfeit. and pay for every offence the Sum of Ten Shillings: and if any person or persons Shall Cast any Dung, ashes Draught Filth dirt or keep any Masts Yards Spars pump Wood or any Kind of Timber whatsoever in or Take away any Stones Earth or Ballast from or Throw the Same into any of the aforespid Decks Wharffs Peers Keys Mole or Slips [53] every Such Person Shall forfeit and pay for Each and every Offence the Sum of Twenty Shilings

VII and be it further ordained by the Authority aforesaid that no Sloop Boat or Vessel except Small Craft Such as ferry Boats Market Boats Pettiaugers and Canoes, Shall Come within the Slip at the end of the Common Sewer, that Leads under the Market house Commonly Called and known by the Name of the fly Market, and empties itself into the East River, under the penalty of Forty Shillings for every Tide they Shall lie within the Same

VIII and be it Further ordained by the Authority aforesaid that no Vessel or Vessels Whatsoever Except Such as are hereinbefore permitted Shall Come into or lie at or Within any of the docks Wharffs Peers Keys mole or Slips Belonging to this Corporation at any other Time then from the Twentieth day of december, to the Twentieth day of March under the penalty of Twenty Shillings for every day to be forfeited and paid by the Master owner or Possessor of every Such Vessel, and for their lying at to or within the Same from the Said Twentieth day of december, to the Twentieth day of March, the master owner or possessor Shall pay for lying their as aforesaid, to the dock Master or to Such Person or Persons appointed or to be appointed by this Corporation, at and after the Rates following that is to Say, for every day Such Vessel Shall Load or unload the Sum of Six Shillings and for every day not lading or unlading one Shilling and Six Pence per day

IX and Be it Further ordained by the authority aforesaid that in order to Prevent disputes between persons using the Said docks Wharffs peers keys mole and Slips that it Shall and may be Law full for the dock Master or person or persons appointed or to be appointed by this Corporation to Give Such directions and orders from Time to Time Relating to the lying fastining and Births. of Boats or other Vessels as they Shall think Just and every person Refusing to Comply with Such orders or directions Shall forfeit Twenty Shillings for Each offence/

X and Be it Further ordained by the Authority aforesaid that the dock Master or other Person or Persons appointed or to be appointed for the Purpose aforesaid by this Corporation take Care to See this Law and the Severall matters therein Mentioned kent cbserved and duly put in

Execution and do Collect and Receive all the penalties and forfeitures arising thereby the one half of all which penalties and forfeitures the Said dock Master or other person or persons appointed or to be appointed as aforesaid or Such other person or persons as [54] upon his or their Neglect or Refusal will inform and prosecute for the Same Shall upon Recovery thereof pay into the hands of the Church Wardens of and for this City for the use of the poor thereof and the other half thereof Retain to his and their own use and Shall and may be Recovered before the Mayor Recorder or any one of the Aldermen of this City with Costs of Suit; which Law was Read & approved of by this Board and ORDER'D to be published%

ORDER'D that the Clerk of this Board prepare a Warrant of attorney To alderman Scott to Enable him to Bring an Action of Trespass and Ejectments in the Name of the Mayor aldermen and Commonalty of the City of New York against the Executors or Devisees of David Jonathan Provoost Deceased and that the Said Clerk Affix the Seal of this Corporation thereto to be Signed by Mr Mayor and further ORDER'D that Mr Nicoll be appointed to assist Mr Scott in the Carrying on and Prosecuting of the Said Action to Effect/

This being the Day appointed by this Board for farming by Publick Outcry Severall Lotts Belonging to this Corporation which lie Be

tween the Goal house and The house of Thomas Brown Near the palisades and the above Severall Members, being present the four following Lotts were Farmed Vizt Numbers one Two Fifteen and Sixteen the Lotts one and Two were [55] Farmed To Joseph Paulding Lott Number one for Three Pounds five Shillings Lott Number Two for three Pounds Eight Shillings for the Term of Twenty One Years and the Lott Number Fifteen for three Pounds five Shillings and the Lott Number Sixteen for Four Pounds Two Shillings were also farmed to William Creland for the Term of Twenty one Years To Commence the first day of May Next the abovesaid Severall Sums to be pd yearly for each Lott during the sd Term of Twenty one Years to the Treasurer or Chamberlain of this Corporation for the time being; ORDERD the Clerk prepare Leases accordingly and that he be allowed by this Board for the Counterpart of every Lease, for each Lott Granted,
