CHAPTER 98.

An Act to Enable the Town of Middleton Further to
Borrow Money for Sewerage Purposes.

WHEREAS, by Chapter 74 of the Acts of 1911 of the Province of Nova Scotia the Town of Middleton was empowered to borrow money to purchase the rights, franchises and property of The Middleton Sewerage Company, Limited, and to extend and improve the general system of sewerage in the town, and

Whereas, a meeting of the ratepayers of the said town, called in accordance with the provisions of Section 143 of "The Towns' Incorporation Act," and held on the 28th day of April 1913, by a unanimous vote of 33 to 0, passed a resolution in the words following:-"Resolved that the Town Council be authorized to borrow a sum not exceeding $6,000.00 to be used in the construction of sewers within the town and to apply to the Legislature for legislation authorizing the borrowing of such sum of $6,000.00;'

Be it therefore enacted by the Governor, Council, and Assembly, as follows:

1. The Town Council of the Town of Middleton is hereby authorized and empowered to borrow, on the credit of the town and the real and personal property therein, a sum of money, not exceeding six thousand dollars, for the purpose mentioned in the preamble to this Act.

2. Such sum of six thousand dollars, or any required portion thereof, shall be borrowed on debentures as provided by Section 4 of Chapter 74 of the Acts of 1911.

3. All the other provisions of said Chapter 74 of the Acts of 1911, so far as the same are applicable hereto, shall govern all matters and things to be done, and all the procedure to be taken under this Act.

CHAPTER 99.

An Act to Enable the Town of New Glasgow to Borrow Money for Fire Equipment.

Be it enacted by the Governor, Council, and

Assembly, as follows:

1. The Town of New Glasgow is hereby authorized Authority to and empowered to borrow, on the credit of the town, the sum of three thousand dollars, for the purpose of adding to the equipment of the fire department.

2. (1) For the purpose of effecting the loan au- Debentures. thorized by this Act, the Town Council of the Town of New Glasgow is empowered to make and issue, subject to the provisions of the "Muncipal Debentures Act, 1902," and amendments thereto, at any one time, or from time to time, as determined by resolution of the Town Council, debentures as hereinafter mentioned, bearing interest at a rate not exceeding five per centum per annum, and payable at such time, not exceeding ten years from the issue thereof, and such. place or places, either in Canada or Great Britian, as the Council determines.

(a) the sum of one hundred dollars, money of Canada, or some multiple thereof; or

(b) the sum of twenty pounds (20) sterling money of Great Britain, or some multiple thereof.

(3) They may be issued in such amounts as the Council determines, provided that the total amount issued does not exceed the amount expressed at its value in Canadian money authorized to be borrowed by this Act.

3. Such debentures shall form a lien upon and be charged against all the property liable to taxation within the Town of New Glasgow, and all the revenues of the town.

4. The money so borrowed under the provisions of this Act shall be paid into the hands of the Treasurer of the Town of New Glasgow, and shall be by him paid out for the purpose mentioned in this Act, and for no other purpose.

5. The Town Council shall annually add to the amount to be assessed and levied upon the real and personal property of the town, for general purposes, a sum sufficient to pay the interest on said debentures, and the expense of collecting and disbursing the same, and shall also provide for the payment of the principal of said debentures as herein provided.

6. In order to provide a sinking fund for the payment of the debentures authorized to be issued under this Act, the Town Council shall annually add to the general assessment to be levied upon the ratepayers of the said town, such sum as may be fixed by resolution of the Town Council, not, however, to be less than five per cent. of the amount borrowed under the provisions of this Act, and sufficient to retire said debentures within ten years from the issue thereof, and such sums shall be rated and collected in the same manner and with the same remedies as other rates and taxes of the said town are rated and collected.

7. This Act shall only take effect after a resolution has been passed approving of the borrowing of the sum aforesaid at a meeting of the ratepayers of the said Town of New Glasgow, convened in accordance with the provisions of Sections 143 and 144 of "The Towns' Incorporation Act."

8. A certificate, under the hand of the Mayor and Town Clerk, and under the corporate seal of the Town, of a resolution passed under the next preceding section of this Act, shall be conclusive evidence of the adoption of this Act, and of the passing of the resolution provided for in said section.

CHAPTER 100.

An Act Respecting the Supply of Water to the
Eastern Car Company, Limited, by the Town
of New Glasgow.

(Passed the 13th day of May, A. D., 1913).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. The Town Council of the Town of New Glas- Council gow is hereby authorized to grant to the Eastern Car authorized to Company, Limited, free water for manufacturing water. and fire purposes, to an amount not exceeding fifty million gallons per annum, for a period of twenty

years.

2. This Act shall be subject to the provisions of Act subject to Chapter 8 of the Acts of 1912.

CHAPTER 101.

An Act to Legalize and Confirm the Assessment
Roll of the Town of New Glasgow, for 1913.

(Passed the 13th day of May, A. D., 1913).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. That the assessment roll for the Town of New Assessment roll legalized. Glasgow, in the County of Pictou, for the current year is legalized and confirmed, notwithstanding any errors, omissions or irregularities with regard to the notice required by Section 17, sub-section (b) of the Assessment Act, and notwithstanding any errors, omissions or irregularities in the proceedings of the Assessment Appeal Court.

CHAPTER 102.

An Act Relating to Sewerage in the Town of New

4. Time limit for bringing action.

Be it enacted by the Governor, Council, and Assembly, as follows:

Power to enter 1. In carrying on the work of constructing or extending the construction of a sewerage system for the Town of New Glasgow under authority of Chapter 116 of the Acts of 1890, or of Chapter 107 of the Acts of 1891, or any other law or by-law in that behalf, the Town of New Glasgow shall have power to enter upon any lands, public or private, within the Town of New Glasgow or beyond the lines of the said town if necessary, and to open and excavate the same and lay sewerage pipes thereunder, and to occupy such lands and use the same so long, and in such manner, as is necessary for such purposes, or for the purposes of repairing such sewers and restoring such lands as nearly as may be to the condition in which the same were before being entered upon, occupied and used.

2. Any person claiming to be entitled to compensation for any lands taken, occupied or used under the provisions of section 1 hereof, may give notice of such claim to the Town Council of the Town of New Glasgow, and thereupon the Council shall appoint an appraiser, and the person so claiming shall appoint one appraiser, and the two appraisers, so appointed, shall appoint a third appraiser. In the event of the person so claiming failing to appoint an appraiser, or of the appraiser appointed by him refusing or neglecting to act, after ten days' notice given to him by the appraiser appointed by the Council the Judge of the County Court for District No. Five shall, by writing under his hand, appoint an appraiser
