CHAPTER 16.

An Act to Provide for the Appointment of a Commission on the Use of Electricity in Mines.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. The Governor-in-Council is authorized to ap- Commission, point a Commission of not less than three nor more than five members, whose duty it shall be to enquire into and report upon the use of electricity in the mines of Nova Scotia, with especial reference to the following matters:

(a) The safety of its use in the mines of the province;

(b) the regulations and rules necessary for its use if recommended and adopted for use in the province.

2. The Commissioners shall have all the powers of Powers. a commission appointed under Chapter 12 of the Revised Statutes, 1900, "Of Inquiries Concerning Public Matters."

CHAPTER 17.

An Act to Permit Cities, Towns and Municipalities in the Province to Establish Police Super

annuation Funds.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. This Act may be cited as "The Police Superannuation Act."

2. In this Act, or in any by-law made under the Act, the following expressions shall be construed in the manner in this section mentioned: "Council" means respectively the city council, town council or municipal council of any city, town or municipality in the Province. "Police Force" means the constables or policemen employed by any city, town or municipality in this Province under salary.

3. The several cities, towns and municipalities ities may assist in the Province, on and after the coming into force of this Act, shall have power to aid and assist, by annual money grant or otherwise, as the council may deem expedient, the establishment and maintenance of superannuation funds for the benefit of members of police force.

CHAPTER 19.

An Act Respecting "The Motor Vehicle Act Road
Improvement Fund."

WHEREAS, under the provisions of Chapter 60, Acts of 1912, "An Act to Amend Chapter 44, Acts of 1907, 'The Motor Vehicle Act," it was provided that the fees paid thereunder shall be used for the improvement of the roads of the Province;

And Whereas, it is desirable that some express provision should be made for the use of said moneys in the improvement of the roads;

Be it therefore enacted by the Governor, Council, and Assembly, as follows:

All moneys heretofore or hereafter paid at the Motor Vehicle Office of the Provincial Secretary, for the use of the Province under the provisions of Chapter 60 of the Acts of 1912, entitled "An Act to Amend Chapter 44, Acts of 1907, 'The Motor Vehicle Act,"" shall be paid over to the Provincial Treasurer and shall be known as the "Motor Vehicle Act Road Improvement Fund.”

2. All moneys forming a part of "The Motor Vehicle Act Road Improvement Fund" shall be expended, according to plans and specifications to be approved of by the Road Commissioner, by an engineer or other competent person approved of by the

Road Commissioner, in the repair, maintenance and improvement of such parts of the main trunk highways of the Province as are deemed in greatest need thereof, with the object of making the said highways more suitable for through traffic.

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Any person, firm, company or corporation cut, etc., with who or that shall deface, mutilate or cut any tree or out consent of trees upon any highway, road, lane or street in any Mayor. municipality or town, without first having obtained the consent, in writing, of the warden of said municipality or mayor of said town, shall upon summary conviction be liable to a penalty of not more than ten dollars for each and every tree so cut, mutilated or defaced, and in default of payment to imprisonment for ten days, and no charter or private Act of any company or corporation, and no provision of any general Act empowering any city, town or municipality shall be construed to contravene the provisions this Act.
