A DRAFT OF A PROPOSED PROVISION PERTAINING TO AN EXISTING APPROPRIATION FOR THE WAR DEPARTMENT FOR NATIONAL CEMETERIES, FISCAL YEAR 1929

SIR: I have the honor to transmit herewith for the consideration of Congress a draft of a proposed provision pertaining to an existing appropriation for the War Department for national cemeteries, fiscal year 1929.

The details of this proposed provision, the necessity therefor, and the reasons for its transmission at this time are set forth in the letter of the Director of the Bureau of the Budget transmitted herewith, with whose comments and observations thereon I concur.

SIR: I have the honor to submit for your consideration a draft of a proposed provision pertaining to an existing appropriation for the War Department, for national cemeteries, fiscal year 1929, as follows:

National cemeteries: The sum of $126 of the appropriation "National cemeteries, fiscal year 1929," is hereby continued and made available until June 30,

1932, for the payment of obligations incurred under contract executed prior to July 1, 1929 (U. S. C., p. 686, sec. 274; p. 687, sec. 278; act March 23, 1928, vol. 45, p. 354).

Under the terms of a contract made June 27, 1929, for the construction of warehouses at the Meuse-Argonne American Cemetery in France, provision is made for the retention of $126 of the contract price for one year after the completion and acceptance of a central heating system as a guarantee of the proper functioning of such system. Under this arrangement payment of this $126 will become due some time during the fiscal year 1932. In the meantime, however, the unexpended balance of the appropriation concerned will have reverted to the Treasury on June 30, 1931, by operation of law. It is therefore necessary that $126 of the appropriation chargeable with this liability be continued and made available until June 30, 1932.

The above draft of a proposed provision pertaining to an existing appropriation is to meet a situation which has arisen since the transmission of the Budget for the fiscal year 1931. I recommend that it be transmitted to Congress.

The details of this estimate, the necessity therefor, and the reason for its transmission at this time are set forth in the letter of the Director of the Bureau of the Budget, transmitted herewith, with whose comments and observations thereon I concur.

Bureau of Standards, for the fiscal year 1932, to be immediately available, amounting to $147,000, as follows:

Facilities for radio research investigations, Bureau of Standards: For carrying out the provisions of the act entitled "An act to authorize the Secretary of Commerce to purchase land and to construct buildings and facilities suitable for radio research investigations." approved February 20, 1931, $147,000, to be immediately available and to remain available until June 30, 1932 (submitted).

Submission of the estimate is made at this time to enable the Secretary of Commerce to comply as soon as possible with the provisions of legislation enacted subsequent to transmission of the Budget for the fiscal year 1932.

I recommend approval of this estimate.
