AN ACT Supplementary to the Act for appro- A.D. 1898. priating a Sum arising from the Consolidated Revenue Fund to the Service of the Colony of Tasmania for the Year 1898.

[29 October, 1898.] BE it enacted by His Excellency the Governor of Tasmania, by and

with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1 Out of the Consolidated Revenue Fund of the Colony of Tasmania Appropriation. there shall and may be appropriated, issued, and applied, for the service of the Year 1898, the sum of Three hundred Pounds, as compensation to Mr. A. T. Morrison, late Government Surveyor, for loss of office.

2 The Treasurer shall issue and pay the said sum to the said Money payable Mr. A. T. Morrison upon such day as the Governor, by any Warrant by Warrant of under his hand, orders and directs; and the payment so to be made Governor. shall be charged upon and payable out of the Consolidated Revenue

Fund of the said Colony.

3 The said Treasurer shall be allowed credit in his Accounts for Credit to be given such sum of money paid by him in pursuance of any such Warrant as to the Treasurer aforesaid; and the receipt of the said Mr. A. T. Morrison shall be a full and valid discharge to the said Treasurer in passing his said Accounts for any such sum, and he shall receive credit for the same accordingly.

AN ACT to provide for the Execution of A.D. 1898. certain Public Works. [29 October, 1898.]

E it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1 In this Act, unless the context otherwise determines

"The Minister" means the Minister of Lands and Works for
the time being, and includes any person appointed by him
or acting under his orders.

2 It shall be lawful for the Minister to cause to be constructed, Minister to cause improved, executed, or completed, the Works mentioned in the Schedule Works to be (1.), at a cost for each separate Work not exceeding the amounts set forth in the said Schedule (1.).

3 The cost of the several Works specified in the Schedule (1.) shall Appropriation be defrayed partly out of moneys provided by Parliament for the several Works mentioned in the Schedule (2.), and it shall be lawful for the Treasurer to appropriate the same accordingly, and partly out of moneys to be provided by Parliament for that purpose.

4 The Minister shall not expend the sum of One thousand Pounds mentioned in the Second Part of Schedule (1.), unless he is satisfied expend certain 1. That the sum of One Pound is locally raised and expended on any work; or

II. That land or material is provided for or labour done locally on
any work to the value of One Pound,

for every One Pound expended by the Minister thereon.
Provided, that no part of such sum of One thousand Pounds shall be
expended, except as hereinafter provided, in any year by the Minister

moneys unless

equal money raised locally.

Public Works Execution.

in any Road District in which a Road Rate of One Shilling has not been levied and collected during such year, but such Road Rate shall be in addition to, and shall not form any part of, the moneys raised for the purposes of this Act.

Provided further, that the Minister may expend in any year any part of the said sum of One thousand Pounds mentioned in the said Schedule (1.) upon any work in any portion of a Road District in which a Road Rate of One Shilling has not been levied and collected during such year, if the landholders in such portion raise a sum of money to be expended upon such work equal to the difference between the amount of the Road Rate levied and collected in such portion and an amount which could be raised by a Road Rate of One Shilling in the Pound upon the annual value of the properties in such portion; but such contribution shall be in addition to, and shall not form part of, any money upon which a vote of Pound for Pound is granted under this Act.

The Minister shall determine what properties are included in any portion of a District affected by any such work.

5 The Minister may expend any part of the said sum of One thousand Pounds mentioned in the Second Part of Schedule (1.) upon any jetty, provided that the Road Trust having the control of such jetty expends out of money collected from any Road Rate the sum of One Pound on such jetty for every One Pound expended by the Minister thereon, notwithstanding such Road Trust shall not have levied and collected a Road Rate of One Shilling in the year in which such money is expended.

6 Out of the moneys voted by the Act of Parliament 61 Victoria, No. 17, (item 252), for the construction of a Jetty at Little Oyster Cove (extension), the Minister may expend the sum of Sixty Pounds towards the construction or completion of a Jetty at Great Oyster Cove.

7 Any moneys contributed by

1. The Marine Board of Launceston for and towards the construction of" Beauty Point Jetty ";

II. The Marine Board of Leven for and towards the construction of" Leven Training Wall,"

shall, for the purposes of the Act of Parliament 61 Victoriæ, No. 17, (items 257 and 265), be deemed respectively to have been "locally contributed or "provided locally."

8 If the Minister at any time reports to the Governor in Council that the whole or any portion of the money mentioned in the Schedule (1.) is not required to be expended upon the Work for which such money is by this Act voted, it shall be lawful for the Minister to expend such balance, provided it does not exceed Ten Pounds, upon any other Work mentioned in Schedule (1.) as he may think fit: Provided that such last-mentioned Work is situated in the same Assembly Electoral District as the Work for which such money was originally voted.

9 All the provisions contained in "The Public Works Construction Act, 1880," and The Branch Roads Construction Act, 1881," shall extend and apply to the Works mentioned in the said Schedule (1.) as fully in all respects as if the said provisions had been incorporated in this Act.
