AN ACT to regulate the Payment of certain A.D. 1898. Town Board. [7 September, 1898.] BE it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1 Notwithstanding anything contained in an Act of the Parliament Moneys in of Tasmania, intituled "An Act to regulate the payment of certain Schedule to be Moneys in aid of Road Rates in certain Road Districts and Towns," paid to the Road there shall be payable out of the Seven thousand Pounds appropriated Town Board from the Consolidated Revenue Fund for the year One thousand eight therein mentioned. hundred and ninety-eight, as "Grants-in-aid to Road Trusts and Town 61 Vict. No. 15. Boards," by the Treasurer to the Trustees of the Road Districts and to the Board of the Town mentioned in the Schedule hereto, the several sums of money therein set forth, for and towards the construction and repair of roads, streets, and bridges in the said Districts and Town. AN ACT to secure the Rights of the riparian A.D. 1898. [7 September, 1898.] WHEREAS under the provisions of "The Hobart Water Act, 1893," PREAMBLE. and certain Acts thereby repealed, the waters of certain tributaries of the North West Bay River, hereinafter referred to as "the said river," have been and are now being diverted and taken for the purposes of the water supply of the City and Port of Hobart and the places adjacent thereto : And whereas it is desirable that the waters of the said river and its tributaries, except as is hereinafter mentioned, should be preserved in perpetuity for the use and benefit of the residents upon and near the said river: Be it therefore enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows :— 1 Nothing contained in "The Hobart Water Act, 1893," shall Rights of be construed to entitle any Corporation or person to take, divert, riparian residents or impound any water of the said river or any tributaries thereof, or preserved. to diminish the flow of water in the said river or any tributary thereof, excepting so far as such Corporation or person would be entitled to the use of the water of the said river or tributary at Common Law, and excepting to the extent that the waters of any tributaries of the said river are, at the date of the passing of this Act, being taken, diverted, or impounded by the Corporation of the City of Hobart.
