and all penalties received by virtue of any such Bye-law shall be paid A.D. 1897. to the Company.

87 Any person who thinks himself aggrieved by any penalty Appeal from imposed under the authority of this Act which is recoverable in a penalties. summary manner may, unless otherwise expressly provided, appeal against the same in the mode prescribed by The Appeals Regulation

88 In the event of any dispute, question, or difference arising All disputes between the Company and the Minister, or any officer appointed by referred to the Minister, the same shall be referred to and decided by arbitration under "The Arbitration Act, 1892."

89 The Company shall, within Three months after the passing Deposit. of this Act, place at interest on fixed deposit the sum of One thousand Pounds, in the name of the Treasurer of the Colony, in some Bank in Hobart to be approved of by the said Treasurer, and shall deliver to the Treasurer the deposit receipt for such sum.

The Company shall be entitled to the interest on such deposit of One thousand Pounds during the period it remains in the name of the Treasurer in such Bank as aforesaid.

The Treasurer shall transfer or deliver the said deposit receipt to the Company as soon as the Minister shall report to him that the said Railway has been constructed in accordance with the provisions of this Act, and shall do every act reasonably required to enable the Company to obtain payment of the said deposit.

If the Railway shall not be so constructed within the time mentioned in this Act, the said sum of One thousand Pounds and all interest accrued thereon shall be absolutely forfeited to Her Majesty, and shall become part of the Consolidated Revenue Fund of the Colony.

In the event of the said sum of One thousand Pounds not being deposited as herein before mentioned, all rights, powers, privileges, and concessions conferred upon the Company by this Act shall be absolutely void and of no effect.

the Consolidated Revenue Fund to the
Service of the Colony of Tasmania for the
Year One thousand eight hundred and
ninety-eight.

BE it enacted by His Excellency the Governor of Tasmania, by and

with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows :-

1 Out of the Consolidated Revenue Fund of the Colony of Tasmania Appropriation of there shall and may be appropriated, issued, and applied the sum of Supplies. Two hundred and five thousand nine hundred and thirty-six Pounds

Six Shillings and One Penny, for the Service of the year One thousand eight hundred and ninety-eight, for the purposes expressed in the Schedule to the Act of Parliament 61 Victoria, No. 1.

2 The said sum of Two hundred and five thousand nine hundred Money in addition and thirty-six Pounds Six Shillings and One Penny shall be in to former Vote. addition to the sum of Two hundred and forty thousand Pounds voted by the Act of Parliament 61 Victoria, No. I; and notwithstanding anything to the contrary contained in the said Act, any money appropriated by the said Act may be applied from time to time for and towards similar Establishments or Services for the year 1898.

3 This Act and the said Act shall be read and construed together as Acts to be read one Act. together.

AN ACT to provide for the Payment of a A.D. 1898. Pension to Robert Patten Adams, Esquire,

a Puisne Judge of the Supreme Court of [8 July, 1898.]

Tasmania.

WHEREAS Robert Patten Adams, Esquire, a Puisne Judge of PREAMBLE. the Supreme Court of Tasmania, was appointed to the office of Solicitor-General and Crown Solicitor in Tasmania in the year One thousand eight hundred and sixty-seven, and after continuously holding those offices until the year One thousand eight hundred and eightyseven, was appointed a Puisne Judge of the said Court:

And whereas under "The Supreme Court Judges Retiring Allowances Act," a Judge is not entitled to a Retiring Allowance under that Act until he has continued in that office for a period of Fifteen years, except in certain cases :

And whereas the said Robert Patten Adams, Esquire, has retired from the said office of a Puisne Judge, and it is desirable that he should receive a Pension as hereinafter provided:

Be it therefore enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:
