deed to Nicholas Young for 87 acres, and he the said Young executed a Note for £8 payable to the Bord for two years rent in arrears for said Land.

The Mayor executed a Deed to Peter Benneway for 8 acres of Ground, and he the said Benneway executed the counterpart and also paid to the Chamberlain £10 for the use of the Board, being the consideration money.

Agreed with Jacob Fort that the Land formerly promised to him be surveyed, the rent seven Skipple, that he also include an hill laying between his old farm and that he the said Fort intented paying therefor in proportion.

Abraham Beeker declined a purchase heretofore made from the Corporation 11 July, 1773 in favour of Lewis Viele.

At a Common Council held at the City Hall of the City of Albany the 22d day of July, 1773.

Resolved by this Board the Clerk draw an order on the Treasurer in favour of Gerrit T. V. Den Bergh for £10:4.

It is resolved by this Board that a Peice of Ground at Schagkook of sixteen Acres and thirty-nine Perches surveyed by Jeremiah Van Renselaer for Marte Winne be granted to him on an annual rent of eight shillings, agreeable to the return made by the said surveyor.

Resolved by this Board that a Peice of Ground at Schagkook of 107 Acres and 24 Perches, surveyed by Jerh Van Renselaer for Lewis Van Antwerp be granted to him on an annual rent of two pounds thirteen shillings and six pence, agreeable to the return made by the said Surveyor.

Resolved by this Board that a Peice of Ground at Schagkook of fortyone Acres three Roods and thirty-six Perches, surveyed by Jeremiah Van Renselaer for Peter Winne be granted to him on the annual rent of twenty-one shillings, agreeable to the return made by the said Surveyor.

Also Resolved by this Board that a peice of Ground of thirteen acres at Schagkook, surveyed by Jeremiah Van Renselaer for Nicholas Young be granted to him on an annual rent of thirteen shillings, agreeable to the return made by the said Surveyor.

Also Resolved by this Board that a Peice of Land lately surveyed by Jeremiah Van Renselaer and containing twenty-six Acres three Roods and fifteen Perches be granted to John Knickerbacker, Peter Yates, Marte Winne, Lewis Van Antwerp, Lewis Mago and Wouter Groosbeek and to their heirs and assigns. Intrus for the use of the reformed protestant Dutch Church of Schaghkook.

Also Resolved by this Board that a Peice of Land at Schaghkook of thirty-five Acres and fourteen Perches, surveyed by Jeremiah V. Renselaer for Dirck V. Veghten be granted to him on the annual rent of twenty shillings, agreeable to the return made by the said Surveyor.

Resolved Likewise that Jacob Fort is to have two small Peices of Land agreeable to the survey of Jerh V. Renselaer at six pence the acre Annum.

Resolved that Mr. Jeremiah Van Renselaer have leave to examin all the counter parts of the Deeds for Lands at Schaghkook which are now in the possession of the Chamberlain.

It is Resolved by this Board that to Johannes Knickerbaker, Jun', be granted a Peice of Ground of fifty acres, bounded east by his own Land and on the south by a Tract laid out for Marte Winne and on the west by

Abraham Deforeest, by the east the Land of Lewis Van Antwerp and a road on an annual rent of six pence for every acre. Yet that previous to the granting thereof it is farther resolved that an actual survey be thereof made, upon the return thereof the land be granted.

It is Resolved that whenever the road proposed to be made from Cumberland county to Pownel for the sake of carrying on a Trade and Commerce, &c. with this City is certified by the representatives of said county to be duly compleated, then the Treasurer of this Board shall advance towards it fifteen pounds.

Resolved by this Board that the Clerk give an order to John Radlieff on the Chamberlain for three Skipples of wheat.

Likewise an order in favour of John Ostrander for six Skipples of wheat.

At a Common Councill held at the City Hall of the City of Albany the 24th day of July, 1773.

Resolved by this Board that Jerh Van Renselaer and Cornelius Van Schulluyne be appointed a Committe to inspect the account of Thos Williams and make a final settlement of the same.

Resolved by this Board that the Chamberlain sell the wheat belonging to the Corporation (only reserving 100 Skipples) to the highest bidder. Henry Van Veghten is appointed to sell the above mentioned wheat at 5s. if he can get no more by Monday next.

At a Common Council held at the City Hall of the said City on Thursday the 2d day of September, 1773.

Whereas Mr. Peter W. Yates, agreeable to a late Resolution of this Board, has revised, corrected and amended the Ordinances and had the same printed which being now presented and approved of, and it is Resolved that the same commence to be in full force and effect from this day.

It is further resolved that Messrs. Peter W. Yates and Jeremiah Van Renselaer do agree with the Printers about the Prices and Expences of the Paper and Printing of the said Ordinance.

Mr. Ebenezar Jessup presented a Petition to this Board praying them to grant to him a Peice of vacant ground covered with water, lying on the north side of the upper warf beginning at the east end of Mr. Quackenboss, &c. Whereupon it is resolved that the Prayer of the Petitioner be granted subject to a yearly rent charge of 40 shillings and that Mr. Robert Yates present the Deeds thereof by the next meeting then to be executed.

Watson having applyed to this Board by Alderman Ten Broeck for liberty to cut a quantity of Logs off of the Land belonging to the Corporation lying at Resolved that he have leave to what quantity he shall think fitt on consideration that he deliver an attested account thereof and pay the usual price.

Resolved by this Board that agreeable to the Ordinance in that case made and provided no meat is to be exposed to sale on Sunday after the second Sunday in September instant.

At a Common Council held at the City Hall of the City of Albany on Monday the 13th of Sept., 1773.

Resolved by this Board that the Clerk draw Orders on the Treasurer to pay the following Accounts:

One in favour of Philip Lansing for £15:10:11.

One in favour of John Donaldson for attending the Town Clock from the year 1769 to the year this Board agreed with Mr. John J. Abbot. One in favour of the City Night Watch for four months wagers. Aldm Peter W. Yates and Messrs. Van Veghten and Roseboom presented to this Board the following Accounts:

It is Resolved by this Board that at the next insuing election of the different Officers of this Board that there be elected in each of the wards of this City one additional Constables who are to execute that office for the ensuing year.

That John Redliff may receive from the Chamberlain of this City three Schipples of wheat on account, and it is hereby ordered that the Chamberlain deliver him the said quantity.

That the Mayor execute Deeds in behalf of this Board to John James Abbot for Lot K in foxes Creek.

And to Philip Wendell for Lot L, situate in the same place, and that he affix or order the affixing the City Seal thereto respectively.

At a Common Council held for the City of Albany at the City Hall of the said City on Wednesday the 29th Sept. 1773-Present, the Mayor, Recorder, Robert Yates, John Ten Broeck, Guysbert Merselis, Peter W. Yates, Abraham Yates, Junr, Gerret Van Sante, Corns Van Schulluyne, Jacob Roseboom, Isaac Deforeest, Abraham Ten Eyck.

This day being appointed by Charter for the clection of Aldermen, Assistants and Constables, the following is the order in which they were elected and returned.

First Ward-Peter W. Yates, Gerrit Van Sante, Aldermen; Jacob Roseboom, Henry Van Veghten, Assistants; James Green, Luke Cashady, Constables.

Second Ward-Robert Yates, Guysbert G. Merselis, Aldermen; Corns Van Schulluyne, Jeremiah Van Renselaer, Assistants; John Grozier, William Adams, Constables.

Third Ward-John Ten Broeck, Thomas Hun, Aldermen; Abraham Ten Eyck, Leonard Gansevoort, Assistants; Abraham A. Lansing, Albert Hansen, Constables.

William Adams having been chosen Constable for the second ward and

refused to serve, whereupon John Ostrander offering himself to serve in his stead, is appointed for that purpose.

This Board have appointed Henry Bleecker, Esq. Chamberlain, John Ostrander Marchel, and James Green High Constable.

Upon the Return of the Poll for the third ward, Aldm Abraham Yates in behalf of himself and William Winne, complained of the illegality of several Votes at the said election and therefore prayed a scrutiny of this Board to inquire into the same.

Resolved by this Board that the same be granted, and that all the parties interested in the said election be heard on the second day of October next, and that leave be given to the said Parties to take Copies of the said Poll.

At a Common Council held at the City Hall of the City of Albany on Saturday the 2d day of October, 1773.

Mr. Henry Bleecker, Treasurer, informed the Board that he was desired to attend on Monday next at a Tryal with some of the Books belonging to the Corporation and applied to this Board for leave to attend with the same. Resolved by the Board that leave be given accordingly.

Agreeable to a former resolve of this Board the scrutiny between Alderman Abraham Yates, William Winne and John Ten Broeck and Thomas Hun came on before this Board for their determination.

Anthony Wolf Reylen, Christopher Beeckman, objected to for Bribery. In support whereof Jacob Henderer was sworn as a witness and saith, that the day before yesterday Wolf came to Martin for a saddle and said to this witness he had made a good days work of it the day before, for he and Beeckman had received £40 to give their votes for Hun and Ten Broeck by one Mr. Ten Broeck, and that he would be damned if he would vote before he had the money and that he was going to buy cattle for it.

William Pemberton sworn says, that the day before yesterday about five o'clock in the morning he saw the above witness and Wolf in discourse tegether and were very merry and asked them the reason of it, that Wolf said by Jesus I have got the Shiners to vote; that he asked him how many have you, more than one or two. Yes, by J.. s, a good many more; that the said Wolf had before the election declared he would vote Abraham Yates; that Wolf afterwards said he received only a bottle of wine.

James Pearce sworn saith, that on the day of election he was at Cartwrights; that up stairs Beeckman, Wolf, Austin and J. Williamson and this witness; that Harm Gansevoort, P. Gansevoort and Richard Ten Broeck severally came there to request them to vote; that Wolf said he would vote for Alderman Yates; that they would not vote without interest; that he does not know that any money was offered by any of those Gentlemen; that Wolf bought a horse next morning; that he the witness had left the room and left the others there; that he does not know to his own knowledge that money was received for their votes by them.

John Roorbach sworn, that he understood Williams had voted for Ten Broeck and Hun, that he went to Williams's slaughter house and said they were all off as he had got something for their votes; that he had heard they would not vote before they had got money, to which Beeckman said Indeed would not we; that James Williams said he had none of it. That when in (this deponent was in) his Garden John O'Bryan said there was

a good deal of work about voting in the 2d ward, the had also given his vote in said election. Why says he have you a vote? Why indeed says he I have only lived in the ward about eight days and my Beeding and several of my things are at one Ryans in the first ward.

Richard Hilton sworn saith, that Patrick Gahegan lived there before he came to the house of Mrs. M'Cew, that he left the said house on the 28th day of August last (the house he means is Mrs. M'Cews); that he is positive that it is this day 5 weeks; that he does not know where he went to, tho he did not go out of town; that he lived at Mrs. M'Cews above a twelve month; that he has a Bed with all his Clothes yet at Mrs. M'Cews, the has not slept there these last five weeks; that he has seen him at work at James Mans and that he has worked at Mr. Burcks but he generally is about Mans house, and he believes he does lodge there; lives up at Graveraedts in the Vosin Kill.

John Friend sworn saith, that John O'Bryan had his Bed and Bedding and Chest and Saw at this Deponents house; that he has worked at a well at Capt. Schuylers in the Country; that he lodged at times at one M'Kinsies, to which place he removed from this Deponents: that he has been the most part of last Summer since the 1st of May at Albany at one Ryans, and at times in the country at his work, and that he goes from one place to another as he thinks to work. On the part of Ten Broeck and Hun in objection to the above.

James Moore, that he lives in a house of Graveraedt in the. 3d ward; knows one John O'Brian who has lodged about seven or eight days agoe at this Deponents house, he has agreed to pay him so much a week for his Board: that he has known him about two years, that he is a labouring man and has been out at work at Courtland Schuylers; that he calls this Deponents house his home as he supposes as long as he stays there. That he has heard of O'Brian he had hired a Seller of John McKinsey that he does not know.

Knows also Patrick Gahigen, that he now lives at his house and has lived there since the 27th of August last; that before that time he lived at Mrs. M'Cews; that he is a Taylor by trade and follows his Business, that he now works at Burks.

Adam Craft sworn says, Mr. Yates asked Rees whether he received money, he answered that Leonard Gansevoort said he would give him a Dollar he owed him and be his security in a suit.

N. B. This Dollar was part of a fee left unpaid.

That Rees's family lives at Nestigcuna but that he has been at work for 5 months at Hogstrossers, and that he sometimes goes to see his family there; that the said Rees was born in Pennsilvania; that the Deponent lives at Mr. Hogstrossers and has voted on the late election, that he is born in Germany and was never naturalized; that he has been 20 years in America, that he has lived 1 year and 4 months in Albany, that he voted last year for Abraham Yates and John Ten Broeck. Adjourned to Monday 8 o'clock in the morning.

Jereh Van Renselaer is also entered as a member just before John Roorback was for the second time examined.

Henry Tremper sworn said, he was going to prove what Williams's wife had said in regard to Bribery (which was objected to on the part of Mr.
