Mr. Schuyler with Mr. Wendell and Beekman this day before this Board & in the presence of Adam Yates accepted to serve as Arbitrators in the dispute with the said Yates and this Board and desired that they may be under Oath. Resolved that a proper Bond be drawn submitting the said Controversy to the Determination of the said three Gentlemen.

At a Common Council held for the City of Albany at the City Hall of the said City on Tuesday the 26th day of April, 1768.

Resolved by this Board that the Mayor sign the Bond to submit the dispute between this Board and Mr. Adam Yates to ye Arbitrators that are to settle the same, to wit, Mr. Philip Schuyler, Harmanus Wendell and John Beeckman, and that the City seal be thereto affixed. Also Resolved that Volkert P. Douw, John H. Ten Eyck, John R. Bleecker, Henry I. Bogert and Abraham Ten Broock be a Committee to manage on the part of the Corporation, the said Controversy before the said Gentlemen Arbitrators.

The following Letter came this day to the Mayor, Recorder, Aldermen and Commonalty, from the Reverend Mr. Eleazar Wheelock :

Lebanon, 8th April, 1768.

W:pful and hond Sirs-Yours of March 9th came safe to hand two days ago, in which I observe and gratefully acknowledge the unmerited expressions of your benevolence and respect towards me and your truely generous disposition towards this rising Institution. I am sorry that my unguarded manner of expressing myself in a former Letter respecting the objection so often made against fixing my school in the vicinity of your City (viz, the bad morals of the place) was received in any other light than was simply and honestly intended: my design was only to advice you, that such an objection had been frequently and strongly urged, and to give you an opportunity to obviate the same's being further improved to the disadvantage of the design proposed. I had not the least intention or disposition to reflect upon your City, or so much as express my own sentiments respecting that matter; however the careless and unguarded manner of my expression, naturally lead you to conceive, that which was very different from that entire friendship which wholly governed me in that matter, and which was so far from my intention that I never had a tho't or the least jealousy of my being so understood, till I was informed of it by my Son, and since more fully by Mr. Smith of New York. However I hope that matter is now set right, and that you will candidly ascribe it to that crow'd of affairs, which obliges me, relying upon the goodness of those to whom I write, often to dimiss even Letters of importance, without such a review as I should otherwise think expedient.

I shall take the earliest opportunity to transmit your Letters to the Earl of Dartmouth, &c., and also Capt Lansing's generous proposal at Stoneroby. It gives me sensible pleasure, Gentlemen, that your sentiments are the same with mine as to the expediency and propriety of proceeding only with the advice and approbation of the Earl of Dartmouth, and the other worthy Gentlemen of the Trust at home respecting the place to fix this school.

I am informed that some overtures are making to invite the settlement of this school in the Province of New Hampshire near Coos.

And by a Letter from home I understand that Gen' Lyman is using his endeavours to have it carried into his Government on the Ohio.

I have also lately heard that a new plan is forming to detain it in this Government. What these proposals will ripen to, I cannot say; and how Gentlemen at home will have light to satisfie them, or what expedient they will think proper to obtain light sufficient to act understandingly and safely in determining the important point, I cant tell. I desire to do all on my part to be done, and submit it to and wait upon the great Governor and disposer of all events to direct and determine the same according to his own holy and righteous will.

You may assure yourselves that the testimonials you have given me of your friendship are not the least among the many circumstances which would render the prospect of such a situation agreeable to me; as I am with much respect, Gentlemen, your most obedient

At a Comon Council held for the City of Albany at the City Hall of the said City on Fryday the 17th day of June, 1768.

Resolved by this Board that the Clerk draw orders on the Treasurar to pay the following:

One Do. in favour of Hendk Van Dyck for four Galls of Wine at 16s. Gall at Kings Birth day, £3:4.

One Do. in favour of Francis Martin for necessaries provided at Kings Birthday, £2:5.

One Do. in favour of Richard Cartwright for £11:19 for necessaries provided for this Board.

Resolved by this Board that the Clerk draw an order on the Treasurar in favour of Anthony Flensburg for three Schipple of wheat and charge the same to his Account.

Resolved by this Board that the Clerk draw an order for the Treasurar to sell one hundred Schiple of the City wheat.

The following Ordinances were this day published and renewed:
A Law for the due observance of the Lords day called Sunday.

An ordinance for selling Flesh in the Market.

A law appointing, establishing and regulating a good and sufficient watch in this City.

A law for paveing and cleaning the streets, lanes and alleys within the City of Albany and for preventing nuisances within the same.

An ordinance for regulating the Carmen.

A law for regulating Negroes, Mulattoes and other Slaves.

A law to appoint a sworn Surveyor for this City.

An ordinance for selling of meat by weight and at the prizes following:

All kinds of meat at 4d pound.

Every head & pluck of a Calf, 1s. 6d.
Every head & pluck of a Sheep, 9d.
Every head & pluck of a Lamb, 6d.

An ordinance to regulate Tavern Keepers.

An ordinance for the better preventing extinguishing of Fires that may happen within this City of Albany.

A law for marking Bread in this City.

At a Common Council held for the City of Albany at the City Hall of the said City on Monday the 20th day of June, 1768.

Resolved by this Board that the Clerk draw an order on the Treasurar in favour of Rob' Yates, Esq', a Surveyor & drawing several copy's concerning the dispute with Adam Yates, for the sum of £5:5:6.

The arbitrators brought in the following award the 1st June, 1768 : We do award, arbitrate and determine by these presents that, First, that a line be drawn from the north east Corner of the House of Wilhelmus Van den Bergh westerly along his House and Fence twenty-two Rods to a stake by us drove in the Ground, that from thence a line is to be drawn still westerly to a stake drove in the Ground at the Cellar of Adam Yates, distant from the north east Corner of the said Cellar along the easterly front thereof seven feet two inches and a half, that then a line is to be drawn from the said stake last mentioned to a stake by us affixed in the rear of the Lot of the said Adam Yates, which last mentioned stake is distant from the north west Corner of the said Lot one rod seven foot and three inches, all Ryland Measure; and we do award, arbitrate and determine that the Ground lying to the north and next adjoining to the last mentioned line the property thereof is vested in the Corporation of the City of Albany, and that Ground lying to the south and next adjoining the said last mentioned line the property thereof is vested in the said Adam Yates; and we the said Arbitrators do also award, order and determine that the said parties in difference within twenty days from the date hereof shall execute each to the other General Releases in writing of the premises agreeable to the award by us as above made.

Memorandum, that in order to determine and assertain the Bounds of the Lands in Controversey we have fixed on a point in the front of the Shed adjoining to the House of Wessel Van Schaick at five feet nine inches distant from the north east Corner of said House, from whence we began to survey.

The above award was sworn to by the Arbitrators above mentioned before me the above date. ISAAC SWITS, Justice.

Resolved by this Board that a Deed be given unto Adam Yates and that the City seal be affixed thereto according to the award made by the said arbitrators the 1st June, 1768. The Mayor in behalf of this Board acknowledged the Seal of the City affixed to the said deed given to Adam Yates in presence of Francis Martin & Paul Hogstroser.

At a Common Council held for the City of Albany at the City Hall of the said City on Thursday the 30th June, 1768.

Resolved by this Board that the Treasurar collect in all the City debts in a month from this day and that the Clerk give an order for the same. Resolved by this Board that the Clerk draw an order on the Treasurar in favour of Thomas Seeger for six Schipple of wheat and the same be charged to his Account.

The following Petition being presented to this Board:

To the Worshipful the Mayor, Aldermen and Commonalty of the
City of Albany, the Petition of the Subscribers

Most humbly sheweth,

That your Petitioners being inclined to have Lotts the East of the Lott of Jacob H. Ten Eyck, Esqr, on the Gallows Hill.

Your Petitioners therefore beg that your Worships will grant them the said Lotts on such Conditions as your Worships shall think most reasonably. And your Petitioners as in duty bound shall ever pray. Gysbert Marselis, Hendrick Marselis, Martin Mynderse, Abraham Mynderse.

The above Petition being presented to this Board it is Resolved that a number of Acres and House lotts be surveyed on Saturday next by John R. Bleecker, Esq, and that the same be sold at publick Vendue on the Wednesday following, and that the Clerk advertise the same.

Resolved that Abraham E. Wandel remove his fence from where it now stands, upon the line settled between him and the Corporation in two months from this date and that he be served with a Copy of the same.

Resolved that John Foster, David Rottery, John McKinsey and John McDonald pay at the rate of twenty-four shillings a year for the Lotts now in their possession, to commence from the first day of May last, to continue for twenty-one years. It is also further Resolved that if any of the above persons shall keep a bad house or sell Liquor to Negroes, upon proof they shall forfiet their Lotts.

Resolved by this Board that the Clerk draw an order on the Treasurar in favour of Abraham Ten Broock to pay the Account of £15:13:6 in full. Resolved by this Board that the Mayor, Aldermen Bleecker and Ten Broock be appointed a Committee to go and view the road which was agreed to be made by the Corporation and the Committee appointed for the Township of Lansbury according to the Resolve made the 25th March, 1768. Also farther Resolved by this Board that the Committee appointed agree and get the Road made from the old Saw mill to this City.

Resolved by this Board that the several Lots of Ground be sold at publick Vendue according to the Resolution made the 30th June last, with a Quit Rent for each Acre Lot the sum of twenty shillings, and for every house Lot the sum of eight shillings.

At a Comon Council held for the City of Albany at the City Hall of the said City on Fryday the 8th July, 1768.

Resolved by this Board that the Clerk draw an order on the Treasurar in favour of Eanos Hammer and Ebenezer Loomis for thirty pounds New York currency, being in part of payment for making the Road from the Township of Lansbury to old Schootack mill.

One Do in favour of Isaac a Negro to keep Benjamin Gable the publick whipper at the rate of six shillingsweek from the 25th November to the 28th March last, £2:8.

One Do in favour of Wilhelmus Monsious for riding 23 loads of Ground for the dock at 6d each Load, £11:6:0.

At a Comon Council held for the City of Albany at the City Hall of the said City on Monday the 11th July, 1768.

A Petition of the Minister, Church Wardens and Vestry of St. Peters Church in the said City being presented to this Board which is in the following manner :

To the Worshipfull Mayor, Recorder and Commonalty of the City of Albany in Common Council convened, the Petition of the Minister, Church Wardens and Vestry of St. Peters Church in the City, Humbly Sheweth,

That your Petitioners intend when their Circumstances will permit, to erect a Parsonage House for their Minister, and would willingly in season secure as proper and commodious a Scituation for that purpose as they can, and if possible of such an extent and bigness as to afford a small spot for a Glebe, and having fixed in their own minds upon a piece of Ground belonging to this Board that in some measure may be answerable for the intended design, being the vacancy scituated between the Free Masons building and the street leading down past the Hospital, in rear adjoining to the Burial place of the said Church. May it therefore please the Gentlemen of this Board to grant unto your Petitioners the said piece of Ground for the use aforesaid. And your Petitioners as in duty bound will ever pray, &c. Harry Monro, Min; Christopher Hegerman, Daniel Hewson, Jun', John Barckley, Will Benson, Cornelius Cadmus, Isaac Fryer.

At a Comon Council held for the City of Albany at the City Hall of the said City on Fryday the 5th August, 1768.

Resolved by this Board that John Van Alen, John N. Bleecker, Naning Visher & John Ten Broock be appointed a Committee to go and view the road which was agreed to be made by this Corporation and the Committee for the Township of Lansbury.

Resolved by this Board that the Treasurar settle with Comfort Seevers and John Roff, & if they do not pay the money that he secure the debt by taking a mortgage for the Corporation.

At a Common Council held for the City of Albany at the City Hall of the said City on Fryday the 12th of August, 1768.

Resolved by this Board that the Clerk draw an order on the Treasurar in favour of Ebenezer Lomis and Noah Kent for £7:9:3 New York currency, being for laying out a new Road, marking the trees and drawing the Chain from the old Schotack mill to the City of Albany.

At a Comon Council held for the City of Albany at the City Hall of the said City on the 6th day of Sep, 1768.

Resolved by this Board that the following Accounts be allowed and that the Clerk give orders on the Treasurar to pay the same:
