At a Common Council held for the City of Albany at the City Hall of the said City on the 22 day of May, 1756-Present, the Mayor, Johs H. Ten Eyck, Johs Van Sante, Gerrit Marselis, John R. Bleeker, John Beekman, Jacob Van Schaick, Evert Wendell, Abraham Yates, Ha: Gansevoort.

The following Ordinances were this day published:

For regulating Cartmen.

For cleaning the Streets and the repairing of the same before the 18 day of June next.

Ordered that the Clerk draw a Petition and send Johs Seger round by the Mayor, Aldermen and Commonalty to have it signed, to be sent to his Excellency Sir Charles Hardy, K', &c. The Petition is as follows, viz'. To his Excellency Sir Charles Hardy, K', Captain General and Governor in Chief of the Province of New York and Territories depending thereon in America, and Vice Admiral of the same. The Humble Petition of the Mayor, Recorder, Aldermen and Commonalty of the City of Albany,

Humbly Sheweth,

That whereas this Corporation have for several times heretofore petitioned to your Excellency's predecessors setting forth the ruinous condition of the Fortifications about this City, we therefore take the liberty again to acquaint your Excellency of the poor condition of the Fortifications about this City are in, the Stockadoes which were two years ago in a manner mended by putting up new ones in the room of the old and rotten, but to our grief the most part have been distroyed last winter by the regulars, and the Block houses converted into Barracks for the Soldiers and can not be of any use for a defence of this City, and the poor Inhabitants are in no condition to get new Stockadoes, for all our waggons and horses are imployed in either the King's or Country's service, so that our City lays open and defenceless; it is true here is a Regiment of regular Soldiers incamped at present out the City on the hill, which is as yett some dependance, but very apparent that they will in a short time go on their march and we left without a sufficient number of men to guard us, as our City will then lay open and defenceless, the greater part of our young men are imployed in the service out of town, and a small number of Indians may come and russ in a surprise the City and sett it on fire, which may be thought by some people as a desperate undertakeing, but in reality it is easely to be done. And should our Army that goes to Crown Point be attacked as probably they will be and overpowed, what an eseay thing will it be for the Enemy to come and take Albany, with our own provisions, amonition, artillery, &c.

We therefore pray such relief in the premises as your Excellency shall think meet, and your Excellency's Petitioners as in duty bound shall ever

pray.

At a Common Council held for the City of Albany on the 22 day of June, 1756-Present, the Mayor, Volkert P. Douw, Johs H. Ten Eyck, Gerrit Marselis, John R. Bleeker, John Beekman, Abraham Yates, Jun', Jacob Van Schaick, Evert Wendell.

An Ordinance published for selling of Flesh runt* as followeth :

Be it ordained by the Mayor, Aldermen and Comonalty of the City of Albany in Comon Council convened and be it ordained by authority of the same, that from and after the twenty-fifth day of June, that no person or persons shall ask or demand more than four pence for a lb of Mutton, four pence half penny for a lb of Beaf, Veal or Lamb, and for every head and pluck of a Calf one shilling and sixpence, for head and pluck of a Sheep ninepence, for head and pluck of a Lamb sixpence; if any of the Butchers or other person or persons shall presume to ask or offer to sell for more as above rated shall forfeit the sum of ten shillings for every offence, to be recovered by any person for his own use that shall sue for ye same before ye Mayor, Recorder or any one of ye Aldermen of this city. Dated ye 22 June, 1756.

At a Common Council held for the City of Albany at the City Hall of the said City on ye 10 July, 1756-Present, the Mayor, Recorder, Johs H. Ten Eyck, Johs Van Sante, Gerrit Marselis, John Beekman, Jun', Jacob Van Schaick, John R. Bleeker, Evert Wendell, Ha: Gansevoort.

An Ordinance published for regulateing Tavernkeepers, which runs thus: Be it ordained by the Mayor, Aldermen and Comonalty of the City of Albany in Comon Council convened, and be it ordained by the authority of the same, that no Tavernkeeper or any other person or persons whatsoever, from and after the publication hereof presume to sell any strong Liquor, harbour or entertain any of his Majesties regular Troops, or to any other Soldier now in his Majesties service after nine of the clock at night, on forfeiting the sum of twenty shillings for every offence, to be recovered by any of the Constables, who are each in their turn to go round the City, one half thereof to be paid to the City Treasurer for the behoof of this City, the other half for his own use that shall sue for the same before the Mayor, Recorder or any one of the Aldermen of this City. Dated this 10 day of July, 1756.

Resolved by this Board, That the Clerk draw a deed to the Minister, Church wardens and Vestry men of St. Peter Church in the City of Albany, for them and their successors in trust for ever for a p of Ground for a Burying Place lying upon the hill adjoining the Fort, agreable to a Map made by John R. Bleeker, and that the Mayor execute a deed and cause the City Seal to be thereunto affixed in behalf of the Corporation. Ordered that the Clerk sign an order to pay the following persons, to wit:

At a Comon Council held for the City of Albany on the 24 day of August, 1756-Present, the Mayor, Recorder, Johannis H. Ten Eyck, Gerrit Marselis, Johannis Van Sante, Volkert P. Douw, John R. Bleeker, John Beekman, Jun', Evert Wendell, Jacob Van Schaick, Abraham Yates, Ha: Gansevoort.

An Ordinance published against fireing Guns or any other small Arms within this City or the Liberties thereof.

Be it ordained by the Mayor, Aldermen and Comonalty of the City of Albany in Common Council convened, and be it ordained by the authority of the same, that no person or person whatsoever from and after the publication hereof, shall presume to fire with a Gun or any other small Arms within the limitts of this City shall forfeit the sum of three shillings for every default, to be recovered by any person and for his use that shall sue for the same before the Mayor, Recorder or any one of the Aldermen of this City. Dated in Albany this 24 day of August 1756.

Mr. Joseph Van Sante delivered an Account to this Board of £2:1:8, which is allowed and ordered that ye Clerk draw an order upon the City Treasurer to discharge the same.

At a Common Council held for the City of Albany on 16 day of September, 1756-Present, the Mayor, Johs H. Ten Eyck, Abraham Douw, Jacob Ten Eyck, Johs Van Šante, Volkert P. Douw, John Beekman, Jun', Evert Wendell, Jacob Van Schaick, Abraham Yates, Jun", Ha: Gansevoort.

Whereas the Ordinance formerly made by the Mayor, Aldermen and Commonalty of this City for the electing two Constables in each ward of this City is expired of its own lemitation, it is hereby ordained by the Mayor, Aldermen and Assistants of this City, that on the 29 day of this instant, September, shall be chosen in each ward two petty Constables, of which the Aldermen in each ward or any of them shall make their return with the rest of the City officers.

The following Accounts were allowed and in order of Comon Council drawn on ye Treasurer to pay the same:

At a Comon Council held for the City of Albany at the City Hall of the said City on the 29 day of September, 1756-Present, the Mayor, Recorder, Volkert P. Douw, Johs H. Ten Eyck, Jacob Ten Eyck, Joh3 Van Sante, John R. Bleeker, Evert Wendell, John Beekman.

This day being appointed by the Charter for choosing and electing Corporation officers, the following persons were chosen to serve for the year ensueing, according to ye directions of ye Charter, viz1:

First Ward.-Johs Van Sante, Volkert P. Douw, Aldermen; Egbert Brat, Phelip J. Schuyler, Assistants; Jacobus Van Sante, Abraham I. Yates, Constables.

Second Ward.-John R. Bleeker, John Beekman, Jun', Aldermen ; Jacob Lansing, Jun', Hendrick Bleeker, Jun', Assistants; Hendrick Pruyn, Gerrit Van Yvere, Constables.

At a Common Council held for the City of Albany at the house of Jacob Sawyer, on the 11 day of October, 1756-Present, the Mayor, Volkert P. Douw, Johs H. Ten Eyck, Joh's Van Sante, John R. Bleeker, John Beekman, Jun1, Abraham Yates, Jun', Evert Wendell.

Resolved by this Board, That Peter Silvester Esqr, be made a freeman of the City of Albany for the reasons set forth in the Freedom.

Upon a consideration of the Small Pox breaking out in this City and fatal Consequence that may attend it, and being willing to remedy it as much as in us lay, we unanimously resolve That all and every person who now have the Small Pox be sent out of the City.

We further resolve immediately to endeavour to procure as convenient a place as can be had to accommodate the sick and to allow the person whose house shall be taken for the same what is reasonable.

At a Comon Council held for the City of Albany on the 12 day of October, 1756-Present, the Mayor, Johs H. Ten Eyck, Volkert P. Douw, Evert Wendell, John R. Bleeker, Abm Yates, Jun'.

Pursuant to a Resolution made yesterday, Messrs. Douw and Wendell endeavoured to get the house of Mr. Holland, out of Town, for to put in the sick of the Small Pox, but could not get the consent of the owner, and no other convenient place can be obtained.

Resolved, That every Family who now have the Small Pox in their houses shall not suffer any person to come in their houses nor go abroad themselves, but keep the house as close as possible.

At a Comon Council held for the City of Albany at the City Hall of the said City on ye 14 day of October, 1756-Present, the Mayor, Recorder, Jacob Ten Eyck, Johs Van Sante, Johs H. Ten Eyck, Volkert P. Douw, Evert Wendell, John Beekman, Jun', John R. Bleeker, Abm Yates, Jun'.

Sybrant G. Van Schaick, Esq, produced a Commission appointing him Mayor and Clerk of the Market for the City of Albany and Coroner of the said City and County for ye ensueing year, took the Oaths appointed by Law, signed ye Test, and was sworn to the due execution of said offices.

Abraham Yates, Jun', Esq, produced a Commission appointing him Sheriff for ye City and County of Albany, took the Oaths appointed by Law, signed the Test, and was sworn to the due execution of said office.

Volkert P. Douw, Johs Van Sante, John R. Bleeker, John Beekman, Jun', Johs H. Ten Eyck, being chosen Aldermen for the year ensueing, took the Oaths appointed by Law, signed the Test and sworn to the due execution of said office.

Egbert Bratt, Phelip J. Schuyler, Jacob Lansing, Jun', Abm Yates, Jun, Assistants, took said Oaths, signed the Test, and were sworn to the execution of their office.

Hendrick Pruyn took the Oaths, signed the Test, sworn to ye due execution of the office of High Constable.

Gerrit Van Yvere, Jacobus Van Sante, Johs Jacob Muller, Daniel Brat, Jun', took the Oaths, and sworn in the office as Constables for the ensueing year.

At a Comon Council held for the City of Albany at the City Hall of the said City on 6 day of November, 1756-Present, Sybrant G. Van Schaick, Mayor, Joh H. Ten Eyck, Johs Van Sante, John Beekman, Jun, Jacob Lansing, Jun, Phelip Schuyler, Egbert Bratt.

This Board appoints the following persons Fire Masters for this City for the ensueing year, viz':

Abraham Coeper, Joghum I. Staats, first ward.

John Jac Beekman, John H. Roseboom, second ward.

Johs Becker, Jun', Isaac de Foreest, third ward.

Ordered, That Warrents be given to the Fire Masters of each ward accordingly, and that the Clerk sign the same by order of Common Councill.

At a Comon Council held for the City of Albany on the 21 day of November, 1756.-Present, the Mayor, Johs H. Ten Eyck, John R. Bleeker, John Beekman, Jun', Abraham Douw, Johs Van Sante, Philip Schuyler, Jacob Lansingh, Jun', Ha: Gansevoort.

Resolved by this Board, That the Clerk draw an order upon the Treasurer to pay John I. Reatliff £5 for his service to ring the Bell this year, and that the Clerk sign the same in behalf of the Comon Council.

At a Common Councill held for the City of Albany at the City Hall of the said City on the 7 day of December, 1756-Present, the Mayor, Johannis H. Ten Eyck, John R. Bleeker, John Beekman, Volkert P. Douw, Phil: J. Schuyler, Ja: Lansing, Jun', Ab: Yates, Ha: Gansevoort. The following Letter wrote to his Excellency St Charles Hardy, Knight, Governour, Commander and Chief of the Province of New York, &c., &c., &c.

S-Mr. Stephenson having declined the Recordership and refused to qualify himself as such, makes it necessary that some other person should be appointed to fill up that office, for we cant hold a Mayors Court without the Mayor or Recorder is present, and the Mayor besides personal accident as Coroner he is lyable to be called abroad, we would therefore be glad if your Excellency would be pleased to appoint some other person to officiate as Recorder. We are with all due respect your Excellencys Humble Servants.

Signd by order of Common Council. An Ordinance for preventing the sale of Rum or any other Spirituous Liquor to the Soldiers.

Whereas, Sundry complaints have been made, and in particular by the Right Honourable Lord Viscount Howe, of the great abuse in selling Rum and other strong Liquors to Soldiers, which by means of their continual drinking impairs and weakens their constitutions and renders them unfit for duty, and we being conscious of the justness of the complaint as well as the mischiefs that may arise from the said abuse, and being willing to remedy it as much as in us lays, Be it therefore ordained by the Mayor, Aldermen and Commonalty of the City of Albany, and it is hereby ordained by the authority of the same, that no person whatsoever after publication
