By Vertue of the within warant I have warned all the freeHolders and Inhabitants of the town of Derryfield of the time and place of meeting acording to Law

Voted to fence the Grave-yeard thies year

Voted to Chuse a Committey to perfect the worke of the Meeting-house and fence the Graveyard this year agribal to the above votes

Voted Thomas Russ Abrham Mirall Handry Blisdal Committy

Voted that the Seclet men for thies corent year recive the Mony Due to the to the town and Settell all the accoumptes of the town a Cording as the Law Direcks in ther Capasity

An act for vacating the meetings of the Town of Derryfield for the year 1766 held there by the Inhabitants for the Choice of town officers and for Dericting & Authorizing a new meeting & the Choice of town officers for said year

(LS) Wheras Sundry of the Inhabitants of Said Derryfield have Pititioned the General Assembly Representing that Some designing men of Said Inhabitants Having Some purposes to affect Relative to the affairs of Said town which they Could not other wise accomplish hurrid on the anal meeting Sooner in the Day then is usual & before many of theprincipal Inhabitants were Come to the place of Sa meeting whereby a Set of officers were Chosen who were Disagrieable to the princibal Inhabitants that afterwards when the Said Inhabitants Came thy maid Choice of another Set of town affiecors who on bothe Sides wher Sworn & have proceded to act in ther Respective offices wherby the greatest Confusion was like to Ensue in the town & therefore they prayd that both of Said meetings might be vacated and maid void and a new meetinge Called for the choice of town officers for this year which having ben Examined and both partys heard theron and it appearing that the affaires of Sd town are by thies meanes Involved in Confusion & perplexety which would Isue in Dissotion of all the Legal Rights & preveliges of Sa town

FOR PREVENTION WHERE OF BE IT ENACTED BY THE GOVERNOR COUNSEIL & ASSEMBLY

That both the Said meetings & all the Electiones their made and the whole procedings of Each of them be and heareby is declairred to be null void and of none Effect but are utterly Vacated and Destroyed and that the persons Chosen to any office at Either and Each of Sd meetings are Hereby Disqualified & Rondred wholly uneable to act in them or any of them and it is here by further Enacted that a new meeting of Said Inhabitants Shall be Called for the Election of town officers for the Currant year and all parsons Quallifyed

as the Law Directes for the Qualification of Such as are authorized to vote in the Choies of town officars in the anueal town meetings Shall be permitted Weadnesday 13 Day of augut at 2 Clock in the afternoon if thy Shall See Caues to vote at Sa meeting but all others & all minors are hereby Excluded from Voting at Said meetings as the ought to be in all Such Cases and John Sheepard Juner of amhurst Esq is Hereby appointed to Call and Govern Sd meeting till the Whole busness thereof Shall be Ended & that no Parson Concerned may Justly Coomplain of want of Notices the Sd John Sheepard is Hereby Derected to Give a Notification to the Last years Constable of Sd town Seting forthe the time & place Designs of holding of Sd meeting with the purpous therof & that Sd meeting is Called by the authority of this act which Shall be Delivered to Said Constable at least fifteen Days before the Day appointed for holding Sd meeting and Sd Constable Shall Give parsonal notice to all the Qualified Voters of Sd Town as has Some Customary times ben the there or leave a Coppy of the Sd Notifiction at the Last usual place of the of the abod of Such of Said persons as he Cannot meet with at least ten Days before the meeting

And all the Town officers which Shall be Chosen pursuant Here unto Shall have the Same Power & authority as any other town offeers have Relative to the Duty of there Respective offces And the Said Constable is hereby Subjected to a penalty of three pounds for Refuseing or Neglecting his Duty herein to be Recovred by the Selectmen that Shall be Chosen by Said town for the use of Said town

The following petition and action of the General Assembly throw additional light on the controversy, and it is thought of sufficient importance to insert here.-Ed.

To his excelency Benning Wintworth Esq Governor & Commander In Chief of His Majestyes Provence of New Hampshir the honnorable his Majestys Councell and House of Representatives In General Assembly Conven'd

The pettetion of a number of the freeholders & Inhabitants of the Town of Derry field Humbly Sheweth that the first Monday of March annually is appointed by Charter to be the day for chusing of Town officers for the currant year and the usual costom of sd town hes ben to warn the Town of time and place and design of holding said Meeting with the several articles to be acted upon on sd day of posting up a coppy of Warrant at three several places in said town viz. one at John Goffe Esq one at John Hall & one at Mr Russes at Nameskeeg which was a vote of said Town for warning Town meetings in said Town but so it was that neither of the places had any notification set up and one of them particularly Nameskeeg had no coppy set up in that part of the town so that they knew not the time of Day the meeting was to be held yet notwithstanding two of the select men and town clarke did contrary to former custom with about ten or a dozen of the Inhabitants and boys & unqualyfied persons did enter and in about five minutes time chouse all the principals offi cersers for the town Notwithstanding one of the select men & the constable & several of the Inhabitants opposed them and told them it was not fair to hold the meetin before the Inhabitants came and that it was not the usual time of day that the meeting use to begin & that the Inhabitants that must pay the greatest part of the Taxes that shall come upon the town were not present-that they would be here presently yet they proceeded as aforesaid and at five minute's after eleven of the clock a considerable number came & in halfe an hour the Inhabitants chiefly came & upon hearing that the principal

officers were chosen by a small number of Voters and many of them not quallified they concluded as that was the day by charter to chuse town officers, they being the largest part of the Quallified Voters belonging to said town maid proclamation that they were going to hold the town meeting & all were desired to attend and they went to the Meeting house and maid choice of a Moderator & Town clark & select men & all town officers & they were sworn to the faithful discharge of their duty as the Law directs so that their is two set of officers in said town which makes confusition we most Humbly therefore pray your Excellency & Honrs To Take our case under your wise consideration and grant that there may be a Regular town meeting in said town & that we may have town Officers chosen as the law directs and that our confusion may be brought into order and might be enabled to Raise the province taxes & mend high ways & do the necessary business of the town and that your Petitioners may bring in a bill for that end-& your petitioners as in Duty bound shall ever pray

The foregoing Petition being Read and Considered

Voted-That the Petitioners be heard thereon on fryday the fourth day of July next if the General Assembly be then siting And if not then siting thereon the second day of their siting next after And that the petitioners at their own cost cause the selectmen and Town Clerk who served for Derry field for the year 1765, to be served with a Copy of this petition and Order of Court that they may appear and shew Cause if any they have why the prayer thereof should not be granted
