t 9th fefl. ch. 40. An ACT fupplementary to an A, entitled, ‡ An All for emitting the Sum of Two Hundred Thoufand Pounds in Lills of Creat, for the Purposes therein mentioned.

HEREAS the county of Albany has, || fince the patting of the act, entitled, An act for emitting the fun of two hundred thousand pounds in bills of credit, for the purposes therein mentioned, been divided into two counties, by the names of Albany and Columbia; Therefore,

Regulating the loan

I. Be it enacted by the people of the fte of New-York, reprefented in fenale and affembly, and it is hereby enacted by the authority of the fame, That the bills of credit to be emitted in pursuance of the faid act, and of Money in Albany affigned for loan to the county of Albany, and all and every proceedings by virtue of the faid act, refpecting the loan of the faid bills, affigned as aforefaid, to the county of Albany, fhall be lent and had in like manner as if the act, entitled, An act dividing the county of Albany into two counties, had not pafied.

II. And be it further enaced by the authority aftred, Loan-officers when That it fhall and may be lawful for the judges of the inferior courts of common pleas, and supervifors ofthe everal counties, who shall not have appointed lan-officers in pursuance of the directions of the faid act, on the day for that purpose mentioned in the faid act, to make fuch appointments on the laft Tueiday of May inflant.

ND be it further enacted by the authority aforefaid, That it shall be, and it is hereby made the day of the late commitioners of lequel, tration, and of all other perfons poffefling books, papers, bonds, notes, or other evidences of debts due froin any perfon or perlons, to any eftate or eftates forfeited to the people of this flate, to deliver the fame to the treat rer of this flate without delay. And it is hereby made the duty of the tic furer to receive fuch books, papers, bonds, notes, or other evidences of celes due as aforefaid; and on neglect or refufal of any per on or perfons in who pofiction fuch books, papers, bonds, notes or other evidences of debts fell be, to deliver the fame, the faid treafter is hereby directed to profecute the

XXIX. And whereas the corporation of the Marine Society of the city of New-York, in the province of New-York, in America, have, by their petition to the legislature, fetting forth, that in confequence of the late happy revolution, feveral terms in the ftile and name of the corporation, are become improper, humbly praying, that the file and name of the faid corporation may be altered: Therefore, Be it enacted by the authority aforesaid, That the ftile and name of the faid corporation, fhall be altered from the prefent ftile and name, to the ftile and name of, The Marine Society of the city of New-York, in the itate of New-York; and that the faid fociety fhall, from and after the pailing of this act, be known by fuch ftile and name as last mentioned, and not by the file or name expreffed in their charter of incorporation.

LXVII.

See 12th feff. ch. 32. An ACT for the speedy Sale of the unappropriated Lands within this State, and for other Purposes therein mentioned. Pailed 5th May, 1786.

WHEREAS experiment has evinced, that the fettlement of the un

appropriated lands in this ftate, in the manner directed by former acts, is fubject to great embarraffiment and inconvenience, and productive of controverfy; for prevention whereof,

1. Be it enated by the people of the fate of New-York, reprefented in fenate and affembly, and it is hereby enated by the authority of the fame, That his excellency the governor, or perfon adminiftring the government of this ftate for the time being, the lieutenant governor, the speaker of the aflembly, the fecretary of the ftate, the attorney-general, the treasurer and the auditor of this ftate, refpectively, for the time being, fhall be, and they hereby are appointed cominillioners of the land-office, to direct the difpofing and granting of the unappropriated lands within this ftate, according to fuch powers and directions as hall, from time to time, be prefcribed by the legislature; and all and every of the powers and trufts to be vefted in them by this or any future act, fhall and may be lawfully executed by any three of them, the governor, or perfon adminiitring the government of this ftate for the time being, to be always one, and that the fecretary of this ftate fhall, ex officio, always be the fecretary of the faid commiflioners.

II. And be it further enacted by the authority aforesaid, Out-lines to be run That it fhall and may be lawful to and for the faid commiíîïprevious to the fale. oners, and they are hereby authorised, from time to time, to direct and require the furveyor-general of this ftate, for the time being, to caufe actual furvey of the out-lines of all fuch of the watte and unappropriated lands of this state, as they fhall deem proper for fale, and mot promotive But commiffioners of the intereft of this late, to be made. Provided always, may dire&ads to be That the id commiffioners, whenever they shall think proper, may direct the farveyor-general to lay down on a map, any tract of land for fale, without proceeding to the furvey of the out-lines thereof.

III. be it further enacted by the authority aforefaid, Lands to be laid out That it hall and may be lawful to and for the faid commiffioners, and they are hereby required, from time to time,

in townships.

to direct the furveyor-general to lay each and every of the tracts directed to be laid out by the faid commiflioners, into townships, on a map to be by him made; each township to contain, as nearly as may be, fixty-four thousand acres of land, and as nearly in fquares as local circumftances will permit.

IV. And be it further enacted by the authority aforesaid, That the faid furveyor-general, where any township fhall include lands heretofore granted under the great feal of the late colony of New-York, or under the great feal of this flate, or which may have been located as bounty lands, by virtue of any law of this ftate, or fhall have been granted or determined to be granted by the faid commiflioners on equitable claims, fhall lay down the fame on the map thereof, and the unappropriated lands in fuch township or townfhips only fhall be fold in manner herein after directed.

V. And be it further enacted by the authority aforefaid, That the faid furveyor-general, as foon as may be, fhall make a map of fuch tracts fo intended for fale, on which shall be laid out the townships contained therein, which townships fhall be numbered, from number one progreflively, to the laft inclufive; and each township fhall, on fuch map, be fubdivided into lots, as nearly fquare as may be, and each lot to contain fix hundred and forty acres, or as nearly fo as may be, and the lots in each township fhall be numbered, from number one to the laft inclufive, in arithmetic progreffion, and on every fourth township in fuch map, fhall be written, To be fold by fingle lots; and one copy of fuch map fhall be filed in the office of the fecretary of this ftate, and the original thereof in the faid furveyor-general's office; and the faid fecretary and furveyor-general refpectively, fhall caufe the maps fo to be filed, to be put up in fome confpicuous part of their respective offices, and fhall permit any perfon whatever freely to infpect fuch maps, between the hours of nine and twelve in the morning, and three and fix in the afternoon of every day, Sundays only excepted, on paying for infpection in morning, fix-pence, and the like in the afternoon.

VI. And be it farther enaked by the authority aforef.id, Surveyor-eneral That the faid furveyor-general fhall, immediately after having filed fuch map as aforefaid in the fecretary's office, give notice thereof by public advertisement, to be publifhed in at least three of the news-pipers printed in this flate, and fhall, in the faid advertisement, mention and appoint a day certain, not more than forty, nor less than thirty days from the day on which fuch advertisement fhall be firft publifhed, on which day he will commence the fale of the faid lands at public vendue, to the highest bidder, and fhall alfo mention in fuch advertisement, the place where fuch vendue will be held.

VII. And be it further enacted by the authority af refaid, That at every fuch ale, the faid furveyor-general fhall put up to fale, as nearly as may be, one quarter part of the unappropriated and unreferved lands in every townfhip, in lots contiguous to each other, and thall frike off the fame to the highest bidder, with a refervation of five acres of every hundred acres fo fold, for highways, and fhall continue to fell in such quarter parts until the whole No land to be fald of fuch townships are fold. Provided, That none of the for lets than is. per lands fo laid out, fhall be fold at a lefs price than one fhilling And every fourth per acre. And, Provided alfo, That the first fourth townhip, and every other fourth township in the faid tracts, shall be fold by fingle lots only, and not otherwife.

VIII. And be it further enacted by the authori y aforefaid, That every purchafer fhall, immediately after having made his purchase, pay unto the faid

furveyor-general, one fourth part of the purchase-money; and having paid the fame, the furveyor-general fhall give unto fuch purchafer, a certificate, containing fuch a defcription of the bounds of the land purchafed, as that the fame may be inferted in the letters patent to be granted therefore, and hall endorfe on fuch certificate the fum by him received, and alfo the fum ftill due on fuch purchase. And if the purchafer fhall not, within fixty days next after the date of fuch certificate, pay the fum fo ftill due to the treasurer of this flate, the purchase made by every fuch delinquent purchafer fhall be, and hereby is declared null and void, and the money fo paid fhall be forfeited to the ufe of the people of this flate; but if the fum fo remaining due fhall be paid to the faid treasurer within the time herein limited, he shall endorfe a receipt therefore on the faid certificate. Provided always, That none of the intereft arifing on any public fecurities with which fuch fum fo unpaid fhall be difcharged, and which fhall have accrued fubfequent to the date of fuch certificate, fhall be allowed by the faid treasurer. And provided alfo, That if any purchaser shall not, immediately after fuch purchase, pay the faid one fourth part, the faid furveyor-general fhall, at the fame vendue, again expofe the lands fo purchased, to fale; and every purchafer who fhall refufe or neglect, for the fpace of twenty-four hours next after fuch purchafe, to pay the faid one fourth part, fhall forfeit to the people of this flate, the fum of twenty pounds, to be fued for and recovered by the faid furveyorgeneral, in his own name, in any court of record within this flate; and fuch purchase fhall be, and hereby is declared to be null and void.

IX. And be it further enacted by the authority aforefuid, That if any purchafer, by himself or herself, or his or her legal reprefentative, fhall produce fuch certificate with fuch receipt as aforefaid endorfed thereon, to the faid commiffioners, it fhall and may be lawful to and for the faid commiffioners to direct letters patent to be prepared and illued for granting the lands defcribed in fuch certificate, to the purchafer thereof, or to the purchafer and fuch other perfon or perfons, as he fhall, under his hand and feal, fignify to be concerned in the purchafe fo by him made in the manner herein before

mentioned.

X. And whereas a tract of land, commonly called Jeffup's purchase, was heretofore laid out into town hips of fix miles fquare, and into tracts of lefs dimenfions, a great part whereof remains unpatented; Be it therefore enacted by the authority aforefaid, That it fhall and may be lawful to and for the faid commiffioners, to direct the furveyor-general to fell all or any of the faid townships and finaller tracts remaining unpatented, in fuch parts and parcels as they fhall direct; and the faid furveyor-general fhall advertise, fell and certify the fame, in manner herein before directed; and the treasurer fhall endorfe on every fuch certificate, on payment of the purchase-money, and letters patent fhall pais for the fame as herein before directed.

XI. Ad be it further enacted by the authority aforefaid, That in every townfhip io laid out, or to be laid out as aforefaid, the furveyor-general fail mark one lot on the map, gofpel and schools, and one other lot, for promoting lit rature, which lots fhall be as nearly central in every township as may be; and the lots fo marked fhall not be fold, but the lot marked, gofpel and schools, fhall be referved for and applied to promoting the gospel and a public fchool or fchools in fuch township; and the lot marked, for promoting literature, fhall be referved to the people of this ftate, to be hereafter applied by the legislature for promoting literature in this ftate.

XII. And be it further enacled by the authority aforefaid, That the faid furveyor-general fhall, within thirty days next after the fale of any of the lands herein before directed to be fold by virtue of this act, make return of every fuch fale to the treasurer of this ftate; and if the purchasers, or fome other perfons on their behalf refpectively, do not pay the purchase-money due on the fale, within the time or times herein before limited, the faid treafurer fhall tranfinit to the faid furveyor-general, the name of every delinquent purchafer; and the furveyor-general fhall thereupon advertife all the fands fo fold and not paid for, to be again fold at a time and place in fuch advertisement to be mentioned, and in manner aforefaid.

XIII. And it be further enacted by the authority aforefaid, Commiffioners to That the faid commiffioners fhall defignate every township name the townships. to be laid out by virtue of this act, or which is already laid out, by fuch name as they fhall deem proper; and fuch name fhall respectively be mentioned in the letters patent for granting a township, or part of a township.

XIV. And be it further enacted by the authority aforesaid, Lands which may That all lands for which letters patent have at any time heretofore been granted, and which have fince been vacated by laws of the late colony of New-York, all lands having been fo granted, and which have been refigned to the crown of Great-Britain, whilit this flate was a colony, and not re-granted, are hereby declared lands on which loca tions might have been and may hereafter be legally made.

XV. And whereas by virtue of acts heretofore pafled for granting bounty lands, fundry locations have been made on lands belonging to the Onondaga, Cayuga and Seneca nations of Indians; And whereas an attempt to fettle fuch lands by the perfons entitled to letters patent therefore, by virtue of the faid acts, may involve this flate in a difagreeable controverfy with the faid Indians: Therefore, be it enacted by the authority aforejaid, That it fhall Permission granted and may be lawful to and for any perfon having made to withdraw locations, fuch location as aforefaid, to withdraw fuch location, and each and every of them are hereby authorised to locate on Se 12th feff. ch. any of the lands to be fold by virtue of this act, excepting on the lands purchafed from the Oneida Indians as aforefaid; and to receive from the faid furveyor-general a certificate of fuch location, directed to the faid commiffioners, who fhall thereupon direct letters patent to be prepared; and having approved the fame, the governor, or perfon adminiftring the government of this ftate for the time being, fhall caufe the great feal of this ftate to be affixed thereto : Provided, That locations to be made for any bounty lands, in pursuance of any law of this flate, fhall not be made on any lands directed to be laid out for fale by the faid commiffioners, after fuch lands fhall have been directed by the faid commiffioners to be fet apart for fale, unless fuch locations fhall be made for any whole lots, or number of whole lots into which any township shall be fubdivided. And provided alfo, That no fuch locations, or grants in confequence of fuch locations, fhall be made for any lands included in the purchafe made of the Indians by the people of this flate, on the twenty-eighth day of June, in the year of our Lord one thousand feven hundred and eighty-five.
