The Commission may also, after Prescribe joint hearing on a complaint, establishTates through routes and joint rates as the maximum to be charged and prescribe the division of such rates as hereinbefore provided, and the terms and conditions under which such through routes shall be operated, when that may be necessary to give effect to any provision of this Act, and the carriers complained of have refused or neglected to voluntarily establish such through routes and joint rates, provided no reasonable or satisfactory through route exists, and this provision shall apply when one of the connecting carriers is a water line.

If the owner of property transported under this Act directly or railroads, etc. indirectly renders any service connected with such transportation, or furnishes any instrumentality used therein, the charge and allowance therefor shall be no more than is just and reasonable, and the Commission may, after hearing on a complaint, determine what is a reasonable charge as the maximum to be paid by the carrier or carriers for the service so rendered or for the use of the instrumentality so furnished, and fix the same by appropriate order, which order shall have the same force and effect and be enforced in like manner as the orders above provided for in this section.

The foregoing enumeration of powers shall not exclude any power of powers not which the Commission would otherwise have in the making of an order under the provisions of this Act.

SEC. 16. That if, after hearing Award of damon a complaint made as provided ages. in section thirteen of this Act, the Commission shall determine that any party complainant is entitled to an award of damages under the provisions of this Act for a violation thereof, the Commission shall make an order directing the carrier to pay to the complainant the sum to which he is entitled on or before a day named.

[SEC. 16, latter half of section given first, transposed from p. 30.] If the matters involved in any Enforcement such order or requirement of said Commission are founded upon a controversy requiring a trial by jury, as provided by the seventh amendment to the Constitution of the United States,

If a carrier does not comply with an order for the payment of money

and any such common carrier shall violate or refuse or neglect to obey or perform the same, after notice given by said commission as provided in the fifteenth section of this Act,

within the time limit in such order,

it shall be lawful for any company or person interested in such order or requirement

the complainant, or any person for
whose benefit such order was made,

to apply in a summary way by petition to the circuit court of the United States sitting as a court of law

may file in the circuit court of the
United States

in the judicial district in which the carrier complained of has its principal office, or in which the violation or disobedience of such order or requirement shal! happen,

for the district in which he resides or in which is located the principal operating office of the carrier, or through which the road of the carrier runs, a petition

alleging such violation or disobedience as the case may be;

setting forth briefly the causes for
which he claims damages, and the
order of the Commission in the
premises.
