CHAPTER 71.

An Act to Amend Chapter 175, Revised Statutes, 1923,
entitled, "Of the Head Office of Nova Scotia
Companies and the Registering of Shares
and other Securities.

(Passed the 7th day of May, A. D., 1925).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Sub-section (2) of Section 4 of Chapter 175 of the Revised Statutes, 1923, is amended by adding thereto the following:

(d) in the case of the transmission of shares by the death of the shareholder, the names and the addresses and the occupations (if any) of the executors or administrators of the deceased.

2. Sub-section (3) of Section 4 of said Chapter 175 is amended by adding thereto the following:

(d) in the case of the transmission of such bonds, debentures or other securities by the death of the holder thereof,-the names and the addresses and the occupations (if any) of the executors or administrators of the deceased.

Sections 5 and 3. Sections 5 and 6 of said Chapter 175 are repealed and the following substituted therefor:

Share transfers, 5. No transfer and no transmission by death or otherwise of any shares of a company shall be valid, complete or effectual unless and until the entries in respect thereof required by this Chapter or otherwise have been made in the principal register of shareholders. No entries in any other register of shareholders shall be necessary to make such transfer or transmission valid, complete, or effectual.

Bond transfers, when valid.

6. No transfer and no transmission by death or otherwise of any bonds, debentures, stocks or other securities which have been or may hereafter be issued

by a company and which are not validly transferable solely by the delivery thereof shall be valid, complete, or effectual unless and until the entries in respect thereof required by this Chapter or otherwise have been made in the principal register of bond holders. No entries in any other register of holders of bonds, debentures, stocks or other securities issued by the company shall be necessary to make such transfer or transmission valid, complete, or effectual.

CHAPTER 72.

An Act to Amend Chapter 196, Revised Statutes, 1923, "The Rural Telephone Act."

(Passed the 23rd day of April, A. D., 1925).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 22 of Chapter 196, Revised Statutes, R., S., c. 196, 1923, "The Rural Telephone Act," is amended by adding thereto the following words:

"but shall not without its consent be compelled to provide individual line service for either its members or others, unless such persons defray the capital cost of providing the facilities necessary for the furnishing of such individual line service."

2. This Act shall be read and construed, and shall Construction apply as if the same had been enacted on the first day of February, A. D., 1924.

CHAPTER 73.

An Act to Amend "The Trustee Act," Chapter 212,
Revised Statutes, 1923.

(Passed the 23rd day of April, A. D., 1925).

Be it enacted by the Governor, Council, and Assembly, as follows:

R. S., c. 212, s. 1. Clause (b) of Sub-section (1) of Section 3 of 8 (1) amended. "The Trustee Act," is repealed and the following substituted therefor:

(b) in the debentures or bonds of the Dominion, of the province, or of any city, town or municipality in the province, or in any debentures or bonds if payment of the principal and interest payable thereunder is guaranteed by the Dominion or the province or any city, town or municipality in the province, or if the loan or debt contracted by means of the issue of the debentures or bonds and the interest thereon are a lien and charge upon the money, funds, revenues, property and assets of any city, town, or municipality in the province.

CHAPTER 74.

An Act to Amend Chapter 231, Revised Statutes, 1923, "Of Securing the Liberty of the Subject.'

(Passed the 7th day of May, A. D., 1925).

Be it enacted by the Governor, Council, and Assembly, as follows:

R. S., c. 231, 1. Section 8 of Chapter 231, Revised Statutes, ■. 8 amended. 1923, "Of Securing the Liberty of the Subject," is

amended by adding thereto the following sub-sections:

(2) The provisions of the foregoing sub-section shall apply on an application for a writ of certiorari

to remove a warrant, conviction or order for the purpose of being quashed and also on any motion to quash a warrant, conviction or order which has been previously removed by a writ of certiorari on an application to the Supreme Court or judge thereof.

(3) The preceding sub-sections of this section shall apply notwithstanding that the writ of certiorari may have been taken away by any Act or law in force in Nova Scotia.

CHAPTER 75.

An Act to Amend Chapter 242, Revised Statutes, 1923, "Of Tenancies and Distress for Rent."

(Passed the 7th day of May, A. D., 1925).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 18 of Chapter 242 of the Revised R. S. c. 242, Statutes, 1923, "Of Tenancies and Distress for Rent, is amended by adding thereto the following sub-section:

(3) Where an assignment is made under the Distress after Bankruptcy Act, being Chapter 36 of the Statutes of Assignment Canada, 1919, and the Acts in amendment thereof, Bankruptcy or where a petition for a receiving order is presented pursuant to the provisions of the said Bankruptcy Act, there shall be no right of the landlord to distrain or complete his distress for rent except for such rent as has accrued due during the three months immediately preceding such assignment or the presentation of such petition; provided, however, that where a petition for a receiving order is dismissed or withdrawn, or if for any other reason is not granted, the rights of the landlord affected by this sub-section shall be deemed not to have been so affected.

CHAPTER 76.

An Act to Amend Chapter 252, The Revised Statutes, 1923, "The Costs and Fees Act."

(Passed the 7th day of May, A. D., 1925).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Sections 8, 9, 10, 12 and 13 of Chapter 252 of c. 252 amended The Revised Statutes, 1923, "The Costs and Fees Act," are amended by striking out the words “Provincial Treasurer" wherever they occur in the said sections, and substituting therefor the words "Provincial Secretary."

CHAPTER 77.

An Act to Amend Chapter 21, Acts of 1918, being "An Act to Encourage the Growing of Wheat and other Cereals."

(Passed the 7th day of May, A. D., 1925).

Be it enacted by the Governor, Council, and As sembly, as follows:
