(a) all persons qualified to vote at an election of Mayor or Councillors of the Town of Berwick under Section 71 of this Chapter; and

(b) all persons resident in said annexed school section, qualified to vote at an election of councillors under Section 11 of the Municipal Act.

2. Section 153 of said Chapter 84 is amended s. 158 amended by striking out the words, "or the town council, as the case may be," in the third line thereof.

3. This Act shall come into force on, from and after a date to be named in a proclamation by the Governor-in-Council.

An Act to Amend Chapter 84, Revised Statutes, 1923, "The Towns' Incorporation Act."

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 49 of Chapter 84 of the Revised Statutes, R. S., c. 84, s. 1923, "The Towns' Incorporation Act" is amended by striking out Sub-sections (1) and (2) thereof and substituting the following sub-sections therefor:

(1) The Mayor shall hold office for two years, Term of office and until his successor is sworn into office, and shall be eligible for re-election.

(2) The Mayor elected at the first election after incorporation shall retire from office on the first Tuesday of the second February following such election, or as soon thereafter as his successor is sworn into office.

Elections, when held.

63. The election of Mayor shall be held on the first Tuesday of February, A. D., 1926 and of every second year thereafter, and, except in the case of the first election after incorporation, the election of councillors shall be held on the first Tuesday of February of each year.

CHAPTER 53.

An Act to Amend Chapter 86, The Revised Statutes, 1923, "The Assessment Act."

(Passed the 23rd day of April, A. D., 1925).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Sub-section (3) of Section 104 of Chapter 86 of the Revised Statutes, 1923, "The Assessment Act," is amended by inserting between the word "the" and the word "town" in the third line of said sub-section the words "municipality or."

S. 105 amend. 2. Section 105 of said Chapter 86 is amended by striking out the words "the next preceding section" and inserting in place thereof the words "this Chapter."

CHAPTER 54.

An Act to Amend Chapter 86, The Revised Statutes, 1923, "The Assessment Act."

(Passed the 23rd day of April, A. D., 1925).

Be it enacted by the Governor, Council, and Assembly, as follows:

Sub-sections (1) and (2) of Section 8 of Chapter R. S., c. 86, 86 of the Revised Statutes, 1923, "The Assessment Act," are repealed, and the following substituted therefor:

(1) In municipalities the council may by by-law divide the municipality into two or more districts for the purpose of assessment, and appoint one or more assessors for each such district, or may by by-law provide that the whole municipality shall be one district for the purpose of assessment, and appoint one or more assessors for that district.

(2) If no such by-law is made each polling district shall constitute an assessment district, for which one or more assessors shall be appointed.

CHAPTER 55.

An Act to Amend Chapter 86, Revised Statutes, 1923, "The Assessment Act."

(Passed the 7th day of May, A. D., 1925.)

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 80 of Chapter 86, Revised Statutes, R. S., c. 86, 1923, "The Assessment Act" is amended by adding s. 80 amended thereto the following sub-section :

(2) The council shall at the same time also provide Interest. that interest at a rate not exceeding six per centum

per annum shall be paid on any rates and taxes that are unpaid after the expiration of the time fixed by the council under the next preceding sub-section and such interest shall be added to the unpaid rates and taxes due by any person, firm, association or corporation and shall be collected or chargeable in the same manner as rates and taxes are collected and chargeable as though the said interest was a part of the said rates and taxes.

2. Sub-section (1) of Section 128 of said Chapter 86 is amended by striking out the word "three" in the third line of said sub-section and substituting therefor the word "six."

3. Section 129 of said Chapter 86 is amended by striking out the word "three" in the third line of said section and substituting therefor the word "six."

4. Sub-section (1) of Section 131 of said Chapter 86 is amended by striking out the word "May” in the second and eighth lines thereof and substituting therefor the word "April."

S. 132 amend- 5. Section 132 of said Chapter 86 is amended by striking out the word "July" in the tenth line thereof and substituting therefor the word "September."

6. Section 133 of said Chapter 86 is amended by striking out the word "July" in the second line thereof and substituting therefor the word "September."

7. Section 135 of said Chapter 86 is amended by striking out the word "July in the second line thereof and substituting therefor the word "September."

8. The provisions of Sections two and three of this Act shall be read and construed as if the same had been enacted and passed and formed part of said Chapter 86 on the twenty-first day of February, A. D., 1924.

CHAPTER 56.

An Act to Amend Chapter 86, The Revised Statutes, 1923, "The Assessment Act."

(Passed the 7th day of May, A. D., 1925).

Be it enacted by the Governor, Council and Assembly, as follows:

1. Chapter 86 of the Revised Statutes, 1923, R. S., c. 86, "The Assessment Act," is amended by inserting between Section 115 and Section 116 thereof the following section:

115A. Whenever a warrant of distress for non- Levy and sale payment of rates or taxes is issued under this Chapter the collector, constable or other officer executing the same shall, under such warrant, levy upon and sell so much of the timber, wood, poles, grass or other materials or personal property on the land as is sufficient to pay the amount of such rates or taxes and the costs and expenses connected with the levy and sale.

CHAPTER 57.

An Act to Amend Chapter 88, The Revised Statutes, 1923, "The Village Supply Act."

(Passed the 7th day of May, A. D., 1925).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Clause (c) of Section 2 of Chapter 88 of the R. S., c. 88, Revised Statutes of Nova Scotia, 1923, is repealed and 2 amended. the following substituted therefor:

"the word "Commissioners" means the Commissioners appointed or elected under this Chapter for any village.'
