Article 3323.

FORM OF SUMMONS.

We, whose names are hereunto set and seals affixed, being two of the visitors appointed under and by virtue of section third of chapter fifth of title eighth of the Revised Statutes of the Province of Quebec respecting Private Lunatic Asylums, do hereby summon and require you personally to appear before

at the hour of noon of the same day,

and then and there to be examined, and testify the truth touching certain matters relating to the execution of the said section.

3346. He shall declare whether the asylum shall be devoted solely to habitual drunkards, or if he will receive other patients. 3347. He shall establish:

1. That the asylum is perfectly healthy in itself and its surroundings;

2. That it can always be supplied with a sufficient quantity of pure water;

3. That, by its subdivision, it allows of the complete separation of the sexes;

4. That every precaution has been taken, either in the building or in the number of guardians, to ensure proper attendance and supervision in the asylum. 47 V., c. 21, s. 1.

POWERS AND DUTIES OF DIRECTORS OF SUCH ASYLUMS.

3348. The director of the asylum may, in advance, agree with the Government upon a person who will undertake to replace him in case he ceases to carry out his duties owing to suspension, judicial interdiction, absence, insolvency or other

cause.

In case of death, his heirs or assigns shall be obliged, within eight days thereafter, to appoint a new director to perform, either temporarily or permanently, his duties; in default whereof, the asylum shall be closed within eight days after a notice to that effect given to them. 47 V., c. 21, s. 1.

3349. Whenever the director of any such asylum wishes to increase the number of the patients which he has been authorized to receive therein, he shall make application therefor and establish that the original or additional buildings and dependencies are suitable and sufficient. 47 V., c. 21, s. 1.

3350. The director shall live in or near the asylum, which shall, at all times, be submitted to the control of the Government and be subject to the visits and orders of the inspectors of prisons and asylums, approved by the Lieutenant-Governor in Council. 47 V., c. 21, s. 1.
