EMPLOYEE FRINGE BENEFITS, net of receipts to the fringe benefit escrow accounts, including costs for those benefits which are related to employees paid from funds, accounts, or programs where the division of the budget has issued waivers. Notwithstanding any other provision of law to the contrary the comptroller is hereby authorized and directed to assess central service agency indirect costs based on estimated allocable costs on all nongeneral funds, other than federal funds, and to bill such assessments on such funds in connection with the fringe benefit rate. Such indirect costs assessments shall be based on rates promulgated by the director of the budget. Copies of such rates shall be provided to

the legislative fiscal committees. Receipts derived from such assessments, paid pursuant to appropriations, shall be deposited to the indirect cost recovery account. If any of the fringe benefit escrow accounts have available balances, such balances may be applied to other categories in the following sub-schedules and for the cost of generating a statewide fringe benefit and cost allocation rate

§ 2. Section 3 of chapter 50 of the laws of 1992, enacting the state operations budget, is amended by repealing the items hereinbelow set forth in brackets and by adding to such section the other items italicized in this section.

§ 3. The several amounts named herein, or so much thereof as shall be sufficient to accomplish the purpose designated, being the unexpended balances of the prior year's appropriations, are hereby reappropriated from the same funds and made available for the same purposes as the prior year's appropriations, unless herein amended, for the fiscal year beginning April 1, 1992. Certain reappropriations in this section are shown using abbreviated text, with leader dots ... used to indicate where existing law that is being continued is not shown. However, unless a change is clearly indicated by the use of brackets [ ] for deletions and italics for additions, the purposes, amounts, funding source and all other aspects pertinent to each item of appropriation shall be as last appropriated.

For the purpose of complying with the state finance law, the year, chapter and section of the last act reappropriating a former original appropriation or any part thereof was, unless otherwise indicated, chapter 50, section 3, of the laws of 1991. [Wherever in this budget act an amount is provided for in an item of reappropriation in excess of the amount that would actually be available for the purposes of such reappropriation by reason of the application of section 11 of chapter 407 of the laws of 1991, as added by chapter 408 of the laws of 1991, then the amount of such item of reappropriation shall be reduced to a lesser amount as calculated in accordance with the provisions of such section. The provisions of the preceding sentence shall not be construed as a modification to, or limitation upon, the application of the provisions of subdivision 6 of such section
