any diseased or infested potatoes or any other diseased or infested farm seeds or products into the State of Colorado, or to sell diseased or infested farm seeds or products for seeding purposes, to be used within this State. [L. '13, p. 11, § 1.]

118-F. State Entomologist-Duties.

SEC. 68f. That the State Entomologist shall have authority, and it shall be his duty personally or through deputies or assistants he may appoint, to inspect potatoes, or any other farm seeds or products imported into the State of Colorado or sold or to be used for seed within this State, that, in his opinion, are a menace to the State of Colorado, for the purpose of ascertaining whether such potatoes or farm seeds or products are diseased, or infected with contagious diseases or injurious insects. [L. 1913, p. 11, § 2.]

SEC. 68g. Any person who shall knowingly import into the State of Colorado or who shall knowingly sell for use as seed, within this State, any diseased potatoes, or other diseased farm seeds or products, shall be guilty of a misdemeanor and shall be subject to a fine of not more than one hundred dollars, for the first offense, and not more than two hundred fifty dollars for each and every subsequent violation thereof. [L. '13, p. 12, § 3.]

118-H. Condemnation of seeds.

SEC. 68h. Any diseased or infested potatoes, or other diseased or infested farm seeds or products shipped into the State of Colorado or sold therein for seed purposes, shall be subject to condemnation, and if such potatoes or farm seeds or products are not removed within a time specified by the State Entomologist, his deputy or assistant, said potatoes or farm seeds or products shall be destroyed. 118-I. Farmers to select chemist

Certification-Duties.

SEC. 68. Hereafter a majority of the farmers raising sugar beets under contract or otherwise, for any sugar factory within the State of Colorado, may and hereby are authorized and empowered to select a thorough and competent chemist examined and certified by the Professor of Chemistry at the Agricultural College of the State of Colorado, to be paid by the farmers employing him. The duties of such chemist shall be to observe the weighing, docking, taking of samples, and analyzing of all beets delivered to the factory for which he is designated, and to observe and investigate all other matters necessary to determine the quantity, quality and value of the beets. Said chemist shall make and keep such records as he deems necessary for the purpose of comparing his readings and observations with the records of the sugar factory and for such other purposes as he may be directed by the farmers. Such chemist shall, further, possess all the powers of an inspector of weights and

measures for the purpose of testing all scales used at such sugar factory for weighing sugar beets or any materials used in making analyses of sugar beets. [L. '13, p. 13, § 1.]

118-J. Sugar Factory to post list.

SEC. 68j. Each and every sugar factory in the State of Colorado shall, not later than the first day of July of each year, post in its local office in a conspicuous and public place, for the inspection of the public, a list of the names of all the farmers raising beets for delivery to such factory, either by contract or otherwise, giving in connection with the name, the number of acres devoted to beets, and the location of the farm upon which said beets are growing or to be grown. 118-K. Chemist given access to scales, apparatus, etc.-Sample beets.

SEC. 68k. Whenever a majority of the farmers growing beets for said factory, either by contract or otherwise, shall, by writing, certify to any beet sugar factory the name of the chemist chosen by them as hereinbefore provided, the sugar factory through its proper officers, agents and employees, shall permit such chemist access to all scales, dumps, beet sheds, bins, chemical laboratories, apparatus and all other buildings or structures forming a part of or pertaining to the said sugar factory, and shall permit said chemist to secure samples of beets from each lot delivered by each farmer employing him, and shall permit said chemist to inspect all matters pertaining to the deductions made by said factory from the gross weight of said beets, and the system whereby the tare on said beets is measured and adjusted; shall permit said chemist to have full and complete access to each and all of the chemical laboratories pertaining to said factory, where the chemical analysis of beets is made, and shall permit said chemist to inspect the analysis of said beets as made by the sugar factory, and to check or compare therewith any analysis of the same lot or lots of beets made by him, PROVIDED, HOWEVER, that nothing herein contained shall be construed as giving said chemist any right, privilege or authority of making any inspection of any sugar factory further than to determine the matters herein before set forth. 118-L. Inspector of Laboratory apparatus.

SEC. 681. The Professor of Chemistry at the State Agricultural College is hereby made State Inspector of Laboratory Apparatus used in sugar beet analyses. It shall be his duty to test any instrument used in sugar beet analyses in any sugar factory of this State when requested to do so by any of the farmers selling beets to such a factory. The expense of making such tests shall be borne by the farmers making such request except when any of the apparatus so tested is found at fault, in which case the expense

shall be borne by the sugar factory at fault. Such expense may be collected in the name of the people of the State of Colorado, for the benefit of said State Inspector as any debt together with the cost of collection and the district attorney of the district in which such test was made shall bring the action in any court of competent jurisdiction. In no case shall said inspector receive more than ten ($10.00) dollars per day for time actually and necessarily spent in making such test and his necessary traveling expenses. Every owner or lessee shall without previous notice, give said inspector free and unobstructed access to all apparatus to be tested. No instrument found defective or incorrect shall thereafter be used until corrected. [L. '13, p. 14, § 4.]

118-M. State Inspector to Furnish Sugar Solution.

SEC. 68m. Whenever any local chemist desires to test any polariscope used in testing sugar beets in the factory where he is stationed, the State Agricultural College through said State Inspector of Laboratory Apparatus shall furnish to said local chemist at cost a sufficient quantity of a standardized pure sugar solution. Said chemist shall possess all the powers of the aforesaid State Inspector for testing such apparatus by means of said solution. [L. '13, p. 15, § 5.]

118-N. Definition of farmer-Only one vote.

SEC. 68n. The term farmer, under this act, shall be held to mean the person or persons in whose name the contract for the growing of beets is made with the sugar factory, in the event that they have a contract, and in the event that there be no contract, it shall include the person or persons actually farming the land upon which said beets were grown, whether said person or persons be owner or tenant.

PROVIDED, HOWEVER, That in determining a majority of the farmers as hereinbefore provided, but one vote shall be given to any and all persons having a joint interest in any specific acreage of beets, but that such persons having such joint interest, shall count as one farmer for such purpose. [L. '13, p. 15, § 6.]

118-0. Definition of sugar factory.

SEC. 68 0. The word sufar factory for the purposes of this act, shall include all persons, corporations or associations operating any plant for the manufacture of beet sugar and for the proper construction of this act, shall include the officers, agents and employees of any such person, corporation or association. [L. '13, p. 15, § 7.]

118-P. Organization voluntary - Violations - Penalty-District Attorney to prosecute.

SEC. 68p. The organization of the farmers for the purpose of selecting said chemist shall be voluntary, and all persons par

ticipating in the selection of such chemist shall contribute to the costs and expenses, including salary, of maintaining such chemist, and no sugar factory shall be required to accept or receive more than one chemist for each operating shift of said factory.

Each sugar factory violating the terms of this act shall suffer a penalty of One Hundred Dollars ($100.00) for each and every day of such violation, said penalty to be recovered in the name of The People of the State of Colorado, upon relation of any farmer or farmers included within the majority employing the chemist, designated pursuant to the terms hereof, for such factory, and shall be paid into the Road Fund of the County wherein such sugar factory is located.

The District Attorney of the District in which such sugar factory is located is hereby empowered and directed to prosecute all violations of this act. [L. '13, p. 16, § 8.]

118-Q. County agriculturist-Appointment.

SEC. 68q. The County Commissioners of each county of the State are hereby authorized and may upon the petition of one hundred taxpayers within the county or persons who are the owners of farms or engaged in actual agricultural operations, to appoint a County Agriculturist in and for such county. Such County Agriculturist shall possess a broad and practical knowledge of agriculture and allied industries, and shall hold a certificate of competence from the State Board of Agriculture. [L. '13, p. 17, § 1.]

118-R. Duties.

SEC. 68г. It shall be the function and duty of the County Agriculturist to study the farm management, and to give instruction to farmers of the county upon their own farms, and at neighborhood meetings; to aid in the development of the agricultural community; to cooperate, so far as practicable, with agricultural associations in the county whose object is the betterment of agriculture in the county; and generally to promote agricultural development of the county and its associated interests by all suitable and approved methods; to cooperate with and act under the general direction of the State Agricultural College of Colorado, and the United States Department of Agriculture. [L. '13, p. 17, § 2.]

118-S. Salary-Expenses.

SEC. 68s. The salary of the County Agriculturist shall be fixed by the Board of County Commissioners making the appointment, and shall be paid out of the general fund of the county in and for which he has been appointed or the county advertising fund as provided by Section 1212, Chapter 146, Revised Statutes, 1908, or either fund; and he shall hold office for the term fixed by the said Board of Commissioners, subject, however, to removal and discharge at any time by said Board for neglect of duty, misfeasance

or malfeasance in office. The actual expenses incurred by the County Agriculturist and authorized by the Board of County Commissioners shall be paid by the county on vouchers submitted by the County Agriculturist except so far as his said expenses shall be provided for out of funds furnished under cooperative agreement by the State Board of Agriculture and the United States. Department of Agriculture. [L. '13, p. 18, § 3.]

118-T. County authorized to appropriate money.

SEC. 68t. For the purpose of carrying into effect the provisions of this Act, the Board of County Commissioners of each county is hereby authorized to appropriate money to pay said salaries and expenses and to provide the necessary equipment, and to prescribe rules and regulations for the use and expenditure of said moneys not inconsistent with the provisions hereof. And it shall also be the duty of the State Board of Agriculture to cooperate with each Board of County Commissioners as aforesaid and to render all assistance possible to aid in carrying out the provisions hereof. [L. '13, p. 18, § 4.]

118-U. Investigation of disease.

SEC. 68u. Provided also that when the agricultural production of any county is seriously threatened by disease, pests or other agency, the Board of County Commissioners of such county is hereby authorized and empowered to appropriate and expend funds for the purpose of conducting investigations under the supervision of the State Agricultural College of the cause of such disease, pests or other agency and for the control thereof. [L. '13, p. 18, § 5.] 118-V. Definitions.

SEC. 68v. The words "agriculture" or "agriculturist" as used in this act, shall be deemed to include "horticulture" or a "horticulturist." [L. '13, p. 18, § 6.]

125. Congressional districts.

SECTION 1. For the election of Representatives to Congress the State of Colorado is hereby divided into four Congressional Districts as follows:

The City and County of Denver shall constitute the First District.

The counties of Adams, Arapahoe, Boulder, Cheyenne, Douglas, Elbert, El Paso, Kit Carson, Larimer, Lincoln, Logan, Morgan, Phillips, Sedgwick, Washington, Weld and Yuma shall constitute the Second Congressional District.

The counties of Alamosa, Baca, Bent, Clear Creek, Conejos, Costilla, Crowley, Custer, Fremont, Gilpin, Huerfano, Jefferson, Kiowa, Las Animas, Mineral, Otero, Park, Prowers, Pueblo, Rio Grande, Saguache and Teller shall constitute the Third Congressional District.
