CHAPTER 65.

An Act Relating to the Town of Dartmouth,

(Passed the 29th day of April, A. D., 1922).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. The Town of Dartmouth is authorized to borrow or raise by way of loan on the credit of the said Town the sum of fifteen thousand dollars for the purpose of completing and furnishing Hawthorne School in the said Town.

2. The Town is also authorized to borrow or raise to widen Wind-by way of loan on the credit of the said Town the sum of five thousand dollars for the purpose of widening Windmill Road in the Town.

3. Where any money is borrowed or raised by the issue and sale of debentures of the Town under this Act and the Municipal Debentures Act, 1914, as amended, the Council of the Town shall provide s sinking fund with respect to such debentures; provided that the amount to be paid annually into the sinking fund shall not be more than the Council deems sufficient to provide for the payment of the debentures when the same are payable.

4. Every sum required for,—

(a) interest on such debentures;

(b) the sinking fund so provided;

shall be held to be sums required for the ordinary lawful purposes of the Town and shall be raised, levied and collected in the same manner and in all respects as other sums required for the ordinary lawful purposes of the Town are raised, levied and collected.

5. No money shall be borrowed under Section 2 of this Act except with the consent of the Governor-inCouncil.

(a) seven hundred and fifty dollars to be paid for the year 1922 to an organization or committee approved of by the Town Council appointed to take charge of the celebration of the Hundredth Anniversary of the Founding of the Dartmouth Engine Company;

(b) five hundred dollars to be paid for the year 1922 to the Local Board of Management of the Victorian Order of Nurses of the Town in addi tion to any sums now payable under the provisions of Chapter 56, Acts of 1902, and Acts in amendment thereof;

(c) the Dartmouth Ferry Commission is hereby authorized to pay out of its revenues, for the year 1922, in the operation of said ferry, the sum of two hundred dollars to any organization appointed to take charge of the celebration of the Hundredth Anniversary of the Founding of the Dartmouth Engine Company;

(d) a sum not to exceed five hundred dollars to be used in the construction and erection of a base for the Memorial Tablet containing the names of Dartmouth men who fell in the Great War.

7. Section 125 of Chapter 56 of the Acts of 1902, Sec. 125, Chap. and Acts in amendment thereof, are repealed and the repealed, subfollowing substituted therefor:

The Board shall have power to establish Rates of fares rates of fares over such ferry or ferries for passengers, teams, horses, cattle and goods, and merchandize of all kinds, and may provide for the issue of season tickets, whereby the fares payable on such ferry may be commuted for a sum payable in advance, all such rates and fares to be subject to approval by the Governorin-Council. The Board shall have all the powers and be subject to all the liabilities of common carriers. No discriminating rates shall be adopted against per

sons not being inhabitants of the Town of Dartmouth, and no person or persons shall be permitted to travel free on the boats of the said ferry excepting members, officials and regular employees of the Board and school children residents of the School Section of the Town of Dartmouth actually attending a higher grade in any public school in the City of Halifax than provided in the public schools of the Town of Dartmouth; said school children, members, officials and regular employees shall be bound by and subject to all the bylaws, rules and regulations adopted by the Board and approved by the Governor-in-Council for the management of the ferry.

CHAPTER 66.

An Act to Amend Chapter 105, Acts of 1912, en-
titled, “An Act to Enable the Town of Digby to
Acquire, Install and Operate an Electric
Light and Power System."

(Passed the 29th day of April, A. D. 1922.)

Be it enacted by the Governor, Council, and Assembly, as follows:

1. The Preamble of said Chapter 105 of the Acts of 1912 is amended by striking out in the fifth line thereof the amount "$15,000" and substituting therefor the amount $18,000."

2. Section 12 of said Chapter 105 of the Acts of 1912 is amended by striking out in the tenth line thereof the word "four" and substituting therefor the word "five" and by striking out in the fourteenth line thereof the word "fifteen" and substituting therefor the word "eighteen."

CHAPTER 67.

An Act to Authorize the Town of Dominion to Borrow Money for the Purpose of Paying off Indebtedness on the School Building of the said

Town.

(Passed the 13th day of April, A. D. 1922.)

Be it enacted by the Governor, Council, and Assembly, as follows:-

1. The Town of Dominion is authorized to borrow Authority borrow $5000. or raise by way of loan on the credit of the said Town the sum of five thousand dollars for the purpose of paying off an indebtedness on the school building of the said Town.

2. Where any money is borrowed or raised by the issue and sale of debentures of the Town under this Act and the Municipal Debentures Act, 1914, as amended, the Council of the said Town shall provide for a sinking fund with respect to such debentures; provided that the amount to be paid annually into the sinking fund shall not be less than four per centum of the aggregate amount of said debentures, and shall not be more than the Council deems sufficient to provide for the payment of the debentures when the same are payable, and the first payment into such sinking fund shall be made within one year from the date of the debentures.

3. Every sum required for,

(a) interest on such debentures;

(b) the sinking fund so provided;

shall be held to be sums required for the ordinary lawful purposes of the Town, and shall be raised, levied and collected in the same manner and in all respects as other sums required for the ordinary lawful purposes of the Town are raised, levied and collected.

4. Such debentures shall be payable in twenty Debentures. years from the date thereof and shall bear interest at a rate not exceeding six per centum per annum.

CHAPTER 68.

An Act Relating to the Town of Glace Bay.

(Passed the 29th day of April, A. D. 1922.)

Be it enacted by the Governor, Council, and Assembly, as follows:

1. That in so far as the Town of Glace Bay is con1918, amended. cerned, Section 132 of Chapter 4 of the Acts of Nova Scotia 1918, The Towns' Incorporation Act, be amended by adding thereto, the following sub-section :

(s) expenses in connection with carrying out in the Town of Glace Bay, the provisions of Chapter 4 of the Acts of 1919, being the "Nova Scotia Housing Act."

CHAPTER 69.

An Act to Amend Chapter 95, Acts of 1913, entitled,
"An Act to Enable the Town of Hantsport to
Borrow Money to Construct a System of
Sewerage.'

(Passed the 29th day of April, A. D. 1922.)

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 6 of said Chapter 95 of the Acts of 1913 is hereby amended by striking out all the words after the word "said" in the sixth line thereof and inserting instead thereof, the words: "Town and for such purpose may use the money borrowed under this Act remaining unexpended."
