CHAPTER 55.

An Act to Amend the Law as to the Qualification for
Mayor and Aldermen in the City of Halifax.

(Passed the 13th day of April, A. D., 1922).

Be it enacted by the Governor, Council, and As-Sub-section sembly, as follows:

1. Section 15 of the Halifax City Charter of 1907 (Section 16 of the Charter of 1914) is hereby amended by adding thereto the following sub-section :

"For the purposes of this section a person who, although his residence is out of the City, has a shop, store or office in the City and has carried on business in the City either singly or as a member of a firm for three years previous to any election, shall be deemed to reside in the City, and being otherwise qualified, to be eligible for Mayor or Alderman, and it shall not be necessary that such person has occupied the same shop, store or office during such period of three years.'

CHAPTER 56.

An Act to Amend the Law Relating to the City of

Halifax.

(Passed the 13th day of April, A. D. 1922).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 21 of Chapter 86 of the Acts of 1920 is Sec. 21, Chap. hereby repealed.

CHAPTER 57.

Authority to borrow.

Debentures.

An Act to Enable the City of Sydney to Borrow

Money.

(Passed the 29th day of April, A. D. 1922.)

Be it enacted by the Governor, Council, and Assembly, as follows:

1. The City of Sydney is hereby empowered, notwithstanding the provisions of Section 223 of Chapter 174 of the Acts of 1903, to borrow on credit of the City, the following sums or any one or more or any part of any one or more of the same for the purposes mentioned, that is to say:

(a) $15,000.00 for a Detention House and Juvenile Court;

(b) $25,000.00 for sewers;

(c) $25,000.00 for water.

2. Such sums or any of them or any part of any of them shall be borrowed in one sum at one time or in instalments at different times on debentures to be issued in the form in accordance with the Schedule to this Act, in sums of one hundred dollars each, or any multiple thereof, and in such manner as may be determined by the City Council, from time to time, or at one time, and in such manner as may be determined by resolution of the City Council, bearing interest at such rate, not exceeding seven per cent. per annum, and repayable at such time, not exceeding thirty years, and at such place or places as the Council shall determine, which debentures shall be issued by the Mayor, under the seal of the City, and signed by the Mayor and City Clerk. And to each of such debentures shall be attached coupons or warrants for the payment of the interest, which coupons shall be signed by the Mayor and City Clerk of the City of Sydney, or their names may be impressed on said coupons by machinery or stamps provided for that purpose, by and with the authority of the City Council of the said City.

3. Such debentures shall be sold for such sums as; Lien. may be obtained therefor, and shall be a charge on all the property, real and personal, of the City, and its inhabitants, and the proceeds of such debentures shall be placed to the credit of the City, and shall be used only for the purposes mentioned in this Act.

4. The City Council shall annually add to the Interest. amount to be assessed and levied on the real and personal property in the City, for general expenses, a sufficient sum to pay the annual interest on such debentures.

5. The City Council shall annually add to the gen- Sinking fund. eral assessment to be levied on the ratepayers of the said City, subject to assessment, such sums as may by resolution be determined by the City Council for the purpose of providing a sinking fund for such debentures; not, however, in any case, to be less than two per cent. of the amount borrowed under this Act, and such sums shall be rated and collected in the same manner and with the same remedies as other rates and taxes in the said City are rated and collected; and such sums, when collected, shall be deposited in some chartered bank, or trust company, in the Province of Nova Scotia, on deposit, bearing interest, and such sums and interest thereon shall be used for the payment of the debentures issued under the provisions of this Act, and for no other purpose. This section shall not apply in respect of twenty-five thousand dollars for sewers.

An Act to Amend Chapter 174, Acts 1903, entitled, "An Act to Incorporate the City of Sydney," and Amending Acts.

Be it enacted by the Governor, Council, and Assembly, as follows:

Chapter 174 of the Acts of 1903, entitled, “An Act to Incorporate the City of Sydney," is amended as follows:
