CHAPTER 42.

Sec. 11, repealed; substituted

Dowers.

An Act to Amend Chapter 30, Acts of 1919, "The
Fire Protection Act."

(Passed the 18th day of April, A. D., 1922).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Section 11 of Chapter 30 of the Acts of 1919, as amended, is repealed, and the following substituted therefor:

11. The Fire Marshal shall have full power and authority to enforce compliance with all laws of the Province and the by-laws and regulations made thereunder relative to:

(a) the prevention of fires;

(b) the storage, sale and use of combustibles and explosives;

(c) the installation and maintenance of automatic or other fire alarm system and fire extinguishing equipment;

(d) the construction, maintenance and regulation of fire escapes;

(e) the means and adequacy of exit, in case of fire, from factories, asylums, hospitals, churches, schools, halls, theatres and all other places where numbers of persons work, live or congregate, from time to time for any purpose;

(f) the suppression of arson and investigation of the cause, origin and circumstances of fires;

but nothing herein contained shall affect the right or duty of any other person to enforce all laws of the Province and all by-laws and regulations made thereunder relative to any or all of the matters enumerated in this section.

Sec. 14, repeal

2. Sub-section 1 of Section 14 of Chapter 30 of Sub-section 1, the Acts of 1919, as amended, is repealed and the fol- ed; sublowing substituted therefor:

14. (1) Every licensed fire insurance company Companies to shall furnish to the Fire Marshal on forms provided report to for the purpose a statement of every fire that occurs in the Province in which it is interested as insurer, showing in each case the name of the assured, his address, the location of the risk, the nature of the occupancy, the value of the building and contents, the amount of insurance carried, the amount of loss sustained, the probable cause of fire and the name of the person adjusting the claim. A preliminary report containing the foregoing information shall be filed in the office of the Fire Marshal within three days following the occurrence of a fire, this to be followed by a report of loss as when adjusted.

CHAPTER 43.

An Act to Amend Chapter 1, Acts of 1921, “Of Costs and Fees."

(Passed the 29th day of April, A. D., 1922).

Be it enacted by the Governor, Council, and Assembly, as follows:

Chap. 1, 1921,

1. Sub-section 2, entitled: "Medical Practitioners's. 8. 2, Sec. 5, Fees," of Section 5, entitled: "Coroner's Court," of to Part 1, the first schedule to Part 1 of Chapter One of the Acts repealed; subof 1921, "The Costs and Fees Act," is hereby repealed stituted." and the following substituted therefor:

(2) Medical Practitioners' Fees:

For attendance and evidence before coroner, $5.00.

For Post Mortem Examination, $10.00.

CHAPTER 44.

An Act to Amend Chapter 1, Acts of 1921, "The
Costs and Fees Act."

(Passed the 29th day of April, A. D., 1922).

Be it enacted by the Governor, Council, and Assembly, as follows:

1. Sub-section 3, entitled "Fees to be taken at the Department of Mines", of Section 2, entitled "Departments" of the said "Costs and Fees Act," is amended by striking out the words "other than gold or gold and silver" from line 21, and the words "other than gold and silver" from line 23 thereof, as the same appear on page 7 of the Acts of 1921.

CHAPTER 45.

An Act to Amend Chapter 2, Acts of 1921, "The
Forests and Game Act."

(Passed the 29th day of April, A. D., 1922).

Be it enacted by the Governor, Council, and Assembly as follows:

1. Sub-section (2) of Section 15 of Chapter 2 of the Acts of 1921 is amended by striking out the figures "$3.00" in the fifth line of the said sub-section and substituting therefor the figures "$2.00."

2. Sub-section (3) of Section 17 of the said Chaped; sub- ter is repealed and the following substituted there

"Every person who neglects or refuses to comply with the provisions of this section shall be liable to a penalty of not less than fifty nor more than two hundred dollars."

4. Section 27 of the said Chapter is amended by Sec. 27, adding thereto the following words:

"Provided that such surplus, as far as may be necessary, may be appropriated to reimburse the municipality for any money expended by it under this Act in any year in excess of the amount realized in such year from such assessment.

5. Section 27 of the said Chapter is further amend Sub-section ed by adding thereto the following sub-section :-

(2) Such surplus or any part thereof may, with the approval of the Commissioner, be appropriated by the municipality to the purchase or erection of any fire engine, pump, tower or other equipment or appliance suitable for fighting forest fires, and any equipment or appliance so acquired shall be used under the direction of the Chief Ranger.

Sec. 44,

7. Clause (b) of sub-section (1) of Section 44 of Clause (b), subthe said Chapter is amended by striking out the word section (1), "December" in the third line thereof and substituting, amended. therefor the word "November."

8. Sub-section (2) of Section 48 of the said Chap- Sub-section (2), ter is amended by striking out the words "thirtieth ce day of September" in the third and fourth lines thereof and substituting therefor the words "thirty-first day of December.”

Clause (a),

sub-section (1), Sec. 51, repealed; substituted.

Clauses (b), (c)

9. Section 49 of the said Chapter is amended by adding thereto the following sub-section :

(2) No person owning, possessing or having the care of any dog shall permit such dog between the fifteenth day of January in any year and the first day of May following to approach or enter upon the private grounds of the owner of any ranch or enclosure where fur-bearing animals are kept for breeding purposes within a distance of fifty yards of the outer fence or enclosure within which the dens of such animals are located, and any dog found at any time during the said period on the said private property of such owner within the distance of fifty yards of such fence or enclosure may lawfully be killed by the owner or caretaker of such ranch.

10. Clause (a) of sub-section (1) of Section 51 of the said Chapter is repealed and the following substituted therefor:

(a) any ruffed grouse (commonly called birch partridge) except between the first day of October in any year and the first day of November following.

11. Clauses (b) (c) and (d) of sub-section (1) of section (1), Sec. Section 51 of the said Chapter are repealed.
