SEC. 5. Whenever, in the judgment of the Mayor of the city of Minneapolis, it shall be necessary for the preservation of the public peace and order to increase the police force of the city temporarily, the Mayor shall have power and is hereby authorized to appoint in writing such number of persons as he may think necessary to accomplish the object above stated, to be called "special policemen," and the appointment shall designate the time for which, and the place where their services are to be rendered. The person therein named shall accept in writing such appointment, and the same shall be forthwith filed with the City Clerk.

SEC. 6. At the next meeting of the City Council after such appointments have been made and filed as herein provided, the Clerk shall report to the Council all appointments made and filed with him of special policemen, and the Council shall have power to revoke any such appointments by resolution, and after such revocation, the person whose appointment is revoked shall no longer have authority to act as policemen.

SEC. 7. Any persons appointed special policemen, as aforesaid, shall, during the time for which they were appointed (unless their appointment be revoked), have authority to serve process and make arrests and do all acts authorized by law to preserve the public peace and order, that other policemen in said city have, and their duties and obligations in that regard shall be the same.

SEC. 8. This ordinance shall take effect and be in force from and after its publication.

RELATIVE TO FIRE WORKS AND DISCHARGE OF FIRE
ARMS WITHIN CITY LIMITS.

The City Council of the City of Minneapolis do ordain as follows: SECTION 1. No person shall hereafter explode, burn or fire off any rocket, fire-cracker, Roman candle, or other species of fireworks or pyrotecnic display within the corporate limits of the city of Minneapolis. Nor shall any person fire off, discharge or explode any gun, pistol, or other weapon, except as provided in this ordinance, within said city limits.

SEC. 2. Any person, corporation or association desiring to fire any salute, or exhibit any display of fireworks within the limits of May grant per- said city, shall obtain the permission of the City Council or Mayor of said city to the firing of such salute or display of such fire-works, which permission shall be in writing and shall designate the place where and the time when such salute shall be fired, or such display of fire-works shall take place.

SEC. 3 Nothing in this ordinance shall be construed to embrace to apply when. any firing of a gun, pistol or other species of fire-arms when done in the lawful defense of person, property or family, or in the necessary enforcement of the laws.

SEC. 4. Any person violating any of the provisions of this ordinance shall, upon conviction before the Municipal Court of said city, for each and every offense be punished by a fine of not less than one or more than seventy-five dollars and costs of prosecution, and be imprisoned until such fine and costs are paid, not exceeding ninety days.

SEC. 5. This ordinance shall take effect and be in force from and after its publication.

AN ORDINANCE

GRANTING TO THE CHICAGO, ST. PAUL, MINNEAPOLIS
AND OMAHA RAILWAY COMPANY THE RIGHT TO
CROSS CERTAIN AVENUES WITH ITS RAILWAY
TRACKS; AND ALSO TO TEMPORARILY CONSTRUCT
AND USE FOR RAILWAY PURPOSES ITS RAILWAY
TRACKS UPON AND ALONG A PART OF RIVER
STREET IN THE CITY OF MINNEAPOLIS.

The City Council of the City of Minneapolis do ordain as follows : SECTION 1. There is hereby granted to the Chicago, St. Paul, Minneapolis and Omaha Railway Company, its successors and assigns, the right to construct, maintain and use for railway purposes one track of its railway, across Third Avenue North, and two or more tracks across Fourth Avenue North and Fifth Avenue North, in the City of Minneapolis; but such tracks shall cross said avenues at points Northeast of a line running through the centres of blocks number seven (7), eight (8), and nine (9), of Minneapolis, as platted; and said Railway Company, its successors and assigns shall keep the traveled portion of Third and Fourth Avenues North, where the same shall be crossed by such tracks well planked between its tracks, and between the rails of each of its tracks, and in good condition for the crossing of teams; and shall not permit its cars to be left standing upon the crossing of either of the two avenues last above named.

SEC. 2. There is hereby granted to the Chicago, St. Paul, Minneapolis and Omaha Railway Company, its successors and assigns, temporarily and until the City Council of the city of Minneapolis shall otherwise ordain, the right to construct, maintain and use for railway purposes its railway tracks upon and along that portion of River Street, in the city of Minneapolis passing through and between lands owned by said company, or occupied by it for railway purposes, and lying between Bassett's creek and the line of the St. Paul Minneapolis and Manitoba Railway, to such number as said company may deem necessary or convenient.

SEC. 3. The grant made in the foregoing second section of this ordinance is made upon the express condition that the City Council grant. of the city of Minneapolis has and reserves to itself, the right at

any time hereafter to amend, change or repeal said second section of this ordinance, or modify the same as it may deem advisable ; and that upon any such amendment, change or repeal all rights of the Chicago, St. Paul, Minneapolis and Omaha Railway Company upon said River Street, under or by virtue of said second section of this ordinance shall cease and determine, except so far as such rights may be continued by the ordinance which makes such amendment, change or repeal; and no use or occupancy of said River Street by said last named company, under the said second section of this ordinance shall have the effect, or be in any way construed to have the effect of passing to, or vesting in such company any permanent right to use, occupy or keep or maintain railroad tracks in said River Street; or to do so any longer than such permission shall be continued by said City Council. And this temporary grant is made upon the further condition that nothing therein shall be construed as granting to such company the right to leave cars standing upon its tracks upon said River Street, between the continuation towards the Mississippi river of the boundary lines of Fourth Avenue North across said River Street, or to otherwise improperly obstruct the crossing of said River Street by said Fourth Avenue North.

SEC. 4. It is the true intention and meaning of the second and third sections of this ordinance, that neither the rights of said city nor of said company are to be in any way permanently changed, added to nor diminished by virtue of the said second and third sections of this ordinance; but that the rights granted by said second section are, and are intended to be merely temporary, and as a matter of convenience to stand until in the judgment of the City Council of said city the interests of said city in view of the development of railroads, shall require, or render advisable some change. And no rights granted to said company by said second section shall vest in said company until it shall execute and file with the City Clerk of said city, an instrument in writing approved by the Mayor of said city accepting the terms of this ordinance and agreeing to abide by its terms and conditions.

SEC. 5. This ordinance shall take effect and be in force from and after its publication.

AN ORDINANCE

CHANGING THE GRADE OF CERTAIN STREETS TO EN-
ABLE THE ST. PAUL, MINNEAPOLIS & MANITOBA
RAILWAY COMPANY TO COMPLY WITH THE OR-
DINANCE GRANTING RIGHT OF WAY OVER CER-
TAIN STREETS IN THE CITY OF MINNEAPOLIS.

The City Council of the City of Minneapolis do ordain as follows: SECTION 1. In order to enable the St. Paul, Minneapolis & Manitoba Railway Company to comply with the conditions and requirements of the ordinance granting to said company the right of way over certain streets in the city of Minneapolis, and to facilitate the compliance of said company with the provisions of said ordinance in respect to laying and maintaining said railway tracks below the grade of the certain streets named, the grade of the streets named as follows, and at the points herein named, is hereby changed and re-established as follows:

The grade of Fifth Street Southeast at the crossing of said railway tracks is hereby established at one hundred and thirty-three feet above the datum heretofore by ordinance of said city established for the fixing of streets.

The grade of Sixteenth Avenue Southeast at the crossing of said railway tracks, is established at one hundred and thirty-three feet above said datum, and at the crossing of Fourth Street Southeast at one hundred and twenty-three feet above said datum.

The grade of Fourth Street Southeast at the crossing of said railway tracks is established at one hundred twenty-nine feet above said datum, and at the crossing of Fourteenth Avenue Southeast at one hundred twenty-one feet above said datum.

The grade of third Street or University Avenue at the crossing of said track is established at one hundred and twenty-five feet above said datum, and at the junction of Thirteenth Avenue Southeast at one hundred twenty-one feet above said datum. The grade of Sixth Avenue Southeast at the crossing of said tracks near said bridge is hereby established at twenty feet above the present roadway at the end of said bridge, at said crossing on Main Street at one hundred sixteen feet above said datum.
