progress of such building or repairing; or to remove such building. And the Mayor may, in his discretion, when the necessities of the case seem to require it, grant such license under such conditions and restrictions (to be set forth in such license), as will, in his judgment, prevent needless inconvenience to the public. Such license shall be in writing, and may be revoked by the Mayor at will, but while in force shall protect the property from seizure, and the person or persons licensed from the penalties of this ordinance, so long as such person or persons shall rigidly observe the conditions and restrictions therein. Such license shall be presented to the City Clerk, and by him recorded in a book kept for that purpose; for recording which the person licensed shall pay the said clerk a fee of one dollar at the time of presenting such license to him, and until the license is so recorded it shall be of no force or effect; but in the removal of buildings, no building shall be permitted to be upon the track of any street railway, or so near the same as to obstruct the passage of cars at any time between the hours of five o'clock in the morning and eleven o'clock in the evening, nor shall any such building be allowed to stand in the same place in any street longer than twenty-four hours.

Provided, That no such permission shall be given to encumber with such material more than one third of the roadway of such streets, nor to permit such obstruction to remain for more than three months.

SEC. 5. No person or persons shall make any excavations in any of the streets, avenues, lanes, alleys or public grounds in said city, for any purpose, or remove the earth or soil therefrom, until he shall be first specially authorized to do so by permission of the City Engineer, with the two Aldermen of the ward wherein such excava- to be made tion or removal of earth or soil is sought to be made, which permission shall be in writing and filed with the City Clerk, and no person, when so authorized, shall make any excavation until he shall erect a suitable guard or fence about the place of such excavation, sufficient to prevent persons or animals from being injured by falling into the same; and every person making such excavation shall, when the purposes of such excavation are accomplished, or when so ordered by the City Engineer, without delay fill up the same, so that it shall at least be in as good condition as before said excavation.

SEC. 6. No person or persons shall leave, deposit, place or cause to be placed, left or deposited within or upon any street, avenue, alley, or public grounds of said city, any dead animals, or any animal, vegetable, excrementive or other substance which is offensive, or which by decomposition might become offensive; nor shall the same be left on any private ground, unless the same be buried at least three feet under the surface of the ground.

SEC. 7. No person or persons shall place or suffer to be placed upon or over any sidewalk in the city of Minneapolis, or suspend over any street in said city, any goods, wares, or merchandise for sale, show or otherwise, beyond the front line of the lot where such goods may be placed, suspended or exposed.

SEC. 8. No person or persons receiving or delivering goods, wares or merchandise in the city of Minneapolis shall place or keep upon, or suffer to be kept, deposited or placed upon any sidewalk, any goods, wares or merchandise which he or they may be receiving or delivering, without leaving a passageway clear upon such sidewalk where such goods may be, of not less than four feet wide, for the use of foot passengers; and no person or persons receiving or delivering such goods shall suffer the same to be or remain on such sidewalk (subject, nevertheless, to the foregoing restrictions) for a longer period than twenty-four hours.

SEC. 9. No person or persons shall sell or attempt to sell, or offer or cry for sale at a public auction in the city of Minneapolis, any goods, chattels, wares, merchandise or personal property whatever, to any person or persons, upon the sidewalks or streets within said city: nor shall any person, by ringing a bell, gong, or triangle, or any loud cries upon any of the streets or sidewalks, give notice of any auction or sale of any kind in said city. This section shall include licensed auctioneers of the city of Minneapolis or county of Hennepin; and it is hereby made the express duty of the Chief of Police, and all the police officers of said city, to cause the strict observance of this and all other ordinances relative to the obstruction of sidewalks and streets within the said city.

SEC. 10. No person or persons shall at any time fasten any animals in such a way that the horse, animal, reins, lines, or the vehicle to which such horse or animal may be attached shall be an obstacle to the free use of any sidewalk or crossing in the city of Minneapolis; and all crossings, crosswalks, and sidewalks in said city shall be kept and reserved free from any sleighs, wagons, carts, carriages or other vehicles, and horses or other animals being placed or suffered to remain thereon, except so far as the same may be necessary in crossing the same.

SEC. 11. No person or persons shall drive, wheel, draw or push any cart, wheelbarrow, velocipede or other vehicle of burden or pleasure upon or along any sidewalk within the limits of said city, except for the purpose of crossing such sidewalk to go to or out of some adjoining enclosure.

Provided, This section shall not apply to children's carriages drawn by hand.

SEC. 12. No person or persons shall stand with or permit any team under his care or control to stand across any public highway or street in said city in such manner as to obstruct the stand across travel over the same, and no person shall stop with any team in any public street, at the side of or so near to another team as to obstruct public travel; and no person shall stop with any team or carriage upon or across any crosswalk or street in said city.

SEC. 13. No person or persons shall throw or put, or cause to be thrown or put, any snow or ice in any street, lane or alley of snow or ice within the limits of said city, unless the same shall be broken up and spread evenly over the surface of such street, lane or alley.

SEC. 14. No person shall suffer his firewood, coal or other fuel to remain unnecessarily on any sidewalk or in any street, lane or alley in the principally inhabited part of said city over night or after twilight in the evening; and in case it must of necessity so remain after twilight or through the night, the said owner shall place and keep a sufficient light over or near the same through the night, to prevent injury therefrom.

SEC. 15. No person or persons shall coast or slide upon any sled, board or other thing upon any sidewalk or footwalk in said city.

SEC. 16. No person or persons shall, within the limits of any street or highway of said city, play at any game of ball or fly any kite or balloon, or throw any stone or missile, or engage in any other game, amusement or exercise interfering with the free, what not alsafe and convenient use of such street or highway by any person traveling or passing along the same; nor shall any person build or cause to be made any fire within the limits of any street or alley of said city.

SEC. 22. No person shall allow any gate or door belonging to premises owned or occupied by him, or under his control, to swing on, over or into any street or highway in said city.

SEC. 23. Three or more persons shall not stand together or near each other, in any street or on any footwalk or sidewalk in said city, so as to obstruct the free passage for foot-passengers, and any person or persons so standing shall move on immediately after a request to do so, made by the Mayor, Chief of Police, or any police officer or watchman.

SEC. 24. No person shall permit or suffer any horse, mule or team of any description, in his care or under his control, to be left standing in any street, lane or alley within said city, unless the same shall be in the immediate charge and custody of a suitable and competent person to control the same, or unless the same shall be securely fastened or hitched.

SEC. 25. No person shall drive any horse or horses. mule or mules, or other animal or animals, in any street, lane or highway within the limits of said city, at a rate of speed exceeding eight miles per hour, excepting on the Fair Grounds located at the east end of said city, and Park Avenue, from Tenth Street to its limit. SEC. 26. No person shall ride or drive any horse or horses, or other animals within said city, in such a manner as to endanger or unreasonably incommode any person; and when any street, lane or other public place is crowded with teams, wagons or other vehicles, or through which any civic, military or funeral procession is passing, any person having charge of any horse, team, wagon or other vehicle, shall obey any order for the removal of such horse, team, wagon or other vehicle, given by the Mayor, any Alderman, Chief of Police or any police officer.

SEC. 27. No person shall hitch any horse or horses, or other animals, to any lamp-post standing on any street, lane or alley, or public ground or highway of said city.

SEC. 28. No person or persons shall obstruct any street or alley in said city by leaving, placing, keeping, or causing to be left, placed or kept, any car on any street or alley, for the purpose of loading or unloading the same, or for any purpose or object what

ever.

SEC. 30. Whoever shall violate, offend against, or fail to comply with the provisions or any provision of this ordinance, shall, upon conviction thereof before the Municipal Court of said city, be

punished by a fine not exceeding fifty dollars and costs of prosecution, and be imprisoned until such fine and costs are paid, not exceeding sixty days.

SEC. 31. No person shall be prosecuted for any offense against any of the provisions of this ordinance, unless complaint for the same shall be instituted and commenced within three months from the time of committing such offense.

SEC. 32. All ordinances or parts of ordinances conflicting with the provisions of this ordinance are hereby repealed.

SEC. 33. This ordinance shall take effect and be in force from and after its publication.

TO PROVIDE FOR THE SEALING OF WEIGHTS AND
MEASURES.

As Amended June 18th, 1879.

The City Council of the City of Minneapolis do ordain as follows: SECTION 1. There shall be appointed by the City Council of the city of Minneapolis, in the month of April of each year, or as soon thereafter as may be, a City Sealer of Weights and Measures, who shall hold his office until the first day of May of the year next following his appointment, and until his successor shall be appointed and qualified. He shall before entering upon the duties of his said office, give a bond to the city, signed by two sureties, to be approved by the City Council, in the sum of five hundred dollars, conditioned for the faithful performance of the duties of his office.
