AN ORDINANCE

FURTHER AMENDING THE CERTAIN ORDINANCE OF
THE CITY OF MINNEAPOLIS ENTITLED "AN OR-
DINANCE REVOKING ALL AUTHORITY HERETO-
FORE GIVEN FOR THE USE OF STEAM AS MOTIVE
POWER ON FIRST STREET AND ON FIRST AVENUE
SOUTH IN THE CITY OF MINNEAPOLIS."

Time changed from June 1st,

1883 to January 1st, 1884.

The City Council of the City of Minneapolis do ordain as follows :

SECTION 1. That the certain ordinance of the city of Minneapolis entitled, "An ordinance revoking all authority heretofore given for the use of steam as motive power on First Street and on First Avenue South in the city of Minneapolis," and approved March 25th, 1882, as amended by an ordinance entitled "An ordinance revoking all authority heretofore given for the use of steam as motive power on First Street and on First Avenue South in the city of Minneapolis," and approved April 7th, 1883, be and the same is hereby amended by striking out the words and figures, “June 1st, 1883," where they occur in said amended ordinance and inserting in the place thereof the words and figures, January 1st, 1884. SEC. 2. This ordinance shall take effect and be in force from and after its publication.

XXV.

AN ORDINANCE

AUTHORIZING THE MINNEAPOLIS STREET RAILWAY
COMPANY TO PAVE BETWEEN THE RAILS OF ITS
TRACKS WITH COBBLESTONE.

The City Council of the City of Minneapolis do ordain as follows : SECTION 1. That the Minneapolis Street Railway Company is hereby authorized to pave the space between the rails of its tracks with cobblestone, the same to be laid in a good and substantial manner, and such pavement by said company shall be deemed and accepted as a full compliance with the terms of section six of an ordinance authorizing and regulating street railways in the city of Minneapolis, passed July 9th, 1875, and approved July 17th, 1875. SEC. 2. This ordinance shall take effect and be in force from and after its publication.

XXVI.

AN ORDINANCE

ESTABLISING A WOOD AND HAY MARKET IN THE
WEST DIVISION OF THE CITY OF MINNEAPOLIS.

Franklin

Steele granted right to keep wood and hay market ten years.

Boundaries of premises granted.

WHEREAS, It is deemed a matter of public interest and benefit that a suitable market for the sale of wood and hay be established in the West Division of the city of Minneapolis; and it is considered impracticable to purchase grounds for such market for a considerable time to come; and,

WHEREAS, Franklin Steele has proposed that he will, by the first day of November, A. D. 1877, or as soon thereafter as may be practicable, open and maintain such a market, and appropriate for that purpose suitable grounds, viz.: Lots two (2), three (3), four (4), five (5), and six (6), in block fourteen' (14), in Minneapolis; also, that part of lots one (1), two (2), and three (3), in block two (2), in Steele's addition to Minneapolis, which lies between econd Avenue South and the extension to Water Street of the line which separates lots (2) and three (3), in block (15), in Minneapolis, upon condition that the city of Minneapolis shall establish upon the said premises a public wood and hay market for the period of ten years from and after the first day of November, A. D. 1877, said premises to be prepared and kept as such market free of all charge to the said city by said Franklin Steele and his assigns, he and they receiving as compensation therefor all fees and emoluments arising therefrom during the said period of ten years; and upon the further condition that said city will not, during said period of ten years, establish any other market for the sale of wood or hay within any portion of the West Division of said city, which is within the following described boundaries, viz.: Bassett's Creek on the northerly side; the Mississippi river on the easterly side; Eighth Avenue South on the southerly side, and Tenth Street on the westerly side. And,

WHEREAS, Said propositions of said Franklin Steele are accepted by the City Council of said city; therefore,

The City Council of the City of Minneapolis do ordain as follows:

SECTION 1. That lots two (2), three (3), four (4), five (5) and six (6), in block fourteen (14), in Minneapolis, and that part of lots one (1), two (2) and three (3), in block two (2), in Steele's addition to

Minneapolis, which lies between Second Avenue South and the extension to Water Street of the line which separates lot two (2), from lot three (3), in block fifteen (15), in Minneapolis, be, and the same is hereby established and designated as a public market of said city for the sale of wood and hay in the West Division of said city; and that so much of Second Avenue South as adjoins the said premises as can be used as standing room for teams without inconvenience to public travel, may be so used.

SEC. 2. The City Council shall, as soon as may be after this ordinance shall take effect, appoint such proper person as may be nominated by the said Franklin Steele, or his assigns, to be Market Master of said market, who shall have charge and supervision of said wood and hay market, and superintend the same, and all weighing and measuring upon said market, and collect all fees charged for such weighing and measuring; and who may appoint and employ such assistants as he shall deem proper. Such Market Master may at any time be removed either by the owner of said market or by the City Council, and in case of removal another suitable person nominated by the owner of said market shall be appointed in his stead by the City Council; provided that Thomas Duncan, the present wood-measurer, shall be wood-measurer until May 1st, 1878, unless sooner removed by the action of the City Council and shall receive the same compensation therefor as is now allowed for measuring wood.

SEC. 3. The said market place shall be kept open on every day except Sundays, and the Market Master or his assistant shall be at the said Market for the measurement of wood and weighing of hay and straw at all times between the hours of seven o'clock in the morning and half-past six o'clock in the afternoon; and he shall assign to every vehicle and team the place where it shall stand while it shall remain upon the said market, and may change the same in his discretion, giving to each a reasonable space.

SEC. 4. The person in charge of said market shall keep thereon all necessary implements for measuring wood, and also at some suitable and convenient place thereon have established and keep proper scales for weighing hay, straw and bulky articles, to be of at least sufficient capacity to weigh six tons; and the Market Master or his assistant shall, upon the request of any person and payment of his fees therefor, measure or weigh any wood, hay, straw or other articles brought to the said market to be weighed or measured.

SEC. 5. The rate of fees and charges for the measuring of wood shall be ten cents per load, and every person taking a load of wood upon said market shall at once have the same measured by the Market Master or his assistant, and receive from him a certificate of the amount of wood upon such load, dated on that day, and

pay to the Market Master or his assistant the fee therefor; and such Market Master or his assistant shall be entitled to measure such wood and demand his fees therefor, whether requested to do so or not, as soon as any load of wood shall come upon the market. In measuring wood the Market Master or his assistant shall allow for shrinkage where the wood is crooked or loosely packed, so as to make all loads equal to straight wood packed tight.

SEC. 6. The rates and fees for weighing hay, straw or other articles required to be weighed shall be ten cents for each load of hay, straw or other articles, and five cents for weighing the wagon, sleigh or vehicle after it shall be unloaded; also ten cents for weighing any animal. No certificate of the weight of any load of hay or straw shall be given by the Market Master or his assistant, purporting to contain a statement of the weight of the wagon, sleigh or vehicle, or net weight of any load of hay or straw, until after the hay or straw shall actually have been unloaded and the vehicle and all tackle again weighed. All certificates of weights and measures shall be signed by the Market Master or assistant measuring or weighing the load or article. All certificates shall be either printed or written with ink.

SEC. 7. No person shall, in the West Division of the city of Minneapolis, keep standing for sale upon any street or on any public or private grounds, or at any other place than the said Wood and Hay Market, or any other Wood or Hay Market hereafter to be established, any load of wood, hay or straw, but shall at once proceed with the same to such Wood and Hay Market, and procure the same to be there measured or weighed before selling or offering the same for sale to any one; and shall keep the same upon said market until the same shall be sold, or withdrawn from sale.

And no person who shall bring in loads with teams, any hay, straw or wood, into the West Division of said city, either for sale or for delivery therein upon previous sale, shall either sell or deliver the same until the same shall have been first taken to such Wood and Hay Market, and been there properly weighed or measured, as the case may be;

Provided, That nothing in this ordinance contained shall be construed so as to require any mill wood, slabs or edgings, or any hay or straw put up in bales, to be taken to said Wood or Hay market before sale.

SEC. 8. It shall be the duty of the Market Master to keep the Market master said Wood and Hay Market in a neat and clean condition, and to to keep said hay and wood observe and conform to all the directions of the City Council Commarket in neat condition and mittee on Markets, or the Mayor of said city, relative to the order have authority of police officer and cleanliness of said Market; and to see that all scales and measures used about the said Market are true and in accordance
